RACE NO 1. (348) THE  HIGH PARTY PLATE: (About) 1000 Metres. Runners – 7

Jockey Kishore Kadam (TEASE ME) reported that his mount lugged-in in the straight. It was observed that the Jockey did not use his whip as a corrective measure and continued to carry the whip in left hand and had also eased up his mount which may have cost him the 4th Place. As such Jockey Kishore Kadam has been fined Rs.2000/- for riding an Incompetent race.

After the race, TEASE ME & HANNAH MONTANA were found to be sound.

RACE NO 2. (349) THE GOLD DUST PLATE (DIV.II): (About) 1200 Metres.  Runners – 8

CAVALRYMAN (C.S.Jodha) was slow in the strides, losing about 2 lengths at the start.

Jockey Suraj Narredu (INSITE SOUL) reported that his mount was sluggish at the start, and the horse was with the field till the bend and then did not improve in the straight and dropped back in the final furlong.

Trainer Mansoor Shah was questioned with regard to the poor performance of his charge INSITE SOUL. The Trainer stated that the horse should have not run such a poor race and the reason that he could think of was that the horse may have bled internally and he had requested for the horse to be scoped. He added that the horse had broken a blood vessel earlier during the Mumbai Meeting. On a report from the Sr. VO that on scoping, the horse was found to have suffered EIPH of Grade 3 and which may have had a bearing on the performance of the horse, the explanation tendered by the Trainer was noted and the enquiry was closed.

Trainer HJ Antia was questioned with regard to the comparative performance of STUD OF GOLD which the gelding won as compared to the pervious run in Race no 312 run on 4th April 11 over a similar distance of 1200 metres. It was pointed out to Trainer H.J.Antia that there were two common horses, BEMISAAL and RAJDOOT, who had run 3rd (about five lengths from the winner) and 4th (about six lengths from the winner) last time,  whereas his horse had finished seventh, about 16 length from the winner and today STUD OF GOLD had beaten RAJDOOT and BEMISAAL hence his horse has shown marked improvement. Trainer stated that even he was surprised with this win and added that the horse was available at longer odds; in fact the odds had drifted and the horse was available at 8 to 1 or even more. Not being satisfied with the explanation, the matter was reported to the Stewards. Consideration of the matter was deferred to Sunday, 24th April, 2011.

Trainer Anil Kumar was questioned with regard to the comparative performance of his charge CHIEF WARRIOR who finished second in this race as compared to its three previous runs where he was unplaced. Trainer Anil Kumar said that he had changed the training pattern in which he had not worked the horse on the Track for about a week or so and had kept the horse in swimming, and he raced fresh which may have probably helped the horse to run better this time. He added that he had not fancied the horse at all as he had run poorly in the previous outing. The explanation was noted.

After the race, THE RIGHT MAN was observed to be sore by the right fore leg and  CHIEF WARRIOR was observed to be sore by the left fore leg. Both the horses have to be passed fit by the Club’s VO before next accepting to race.

Trainer Narendra Lagad has been asked to take remedial measures before next accepting to race the filly.

Trainer Imtiaz A.Sait and Jockey S.S.Baria were questioned with regard to the running and riding of SILVER SOUL. Trainer stated that he had asked the Jockey to be along the rails as he was drawn 2 and sit behind CROWNED PRINCESS and VIVA LA DIVA who would go to the front and to ride out in the last 300 metres from the inside.  Jockey S.S.Baria confirmed the instructions. It was observed that the Jockey did not start to ride out his mount as instructed and the horse has shown improvement in the remaining part of the race. The Trainer opined that the Jockey had lost a certain place and hence he was not satisfied with the riding of the Jockey. The matter was reported to the Stewards. Consideration of the matter was deferred to Sunday, 24th April, 2011.

ENQUIRY INTO THE COMPLAINT LODGED BY MR.KHUSHRO K.JALNAWALA AGAINST MR.NIRAD KARANJAWALA/TRAINER JAYANTILAL K.GOR :

The Stewards of the Club at their meeting held on Saturday, 23rd April, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards heard the submissions made by Mr.Nirad Karanjawala and his Spokesman Mr.Dallas Todywalla as also by Mr.Khushro K.Jalnawala and his Spokesman Mr.Narendra Lagad, Trainer Jayantilal K.Gor and his Clerk Mr.Sainath. At this meeting, Mr.Nirad Karanjawala admitted his guilt and apologized for the same.

The Stewards having considered all the papers and proceedings before them and having heard all persons concerned,

a)         Held Mr.Nirad Karanjawala guilty of an extremely serious breach of the Rules of Racing in that a disqualified person interfered in the training of race horses and as a consequence was guilty of Gross Misconduct. He admitted before the Stewards having interfered with the management of the horses owned by Mr. K Jalnawala in the charge of Trainer Jayantilal K.Gor, during the period of his suspension by giving instructions through the Clerk Mr. Sainath. The instructions covered the Track Work, horses to be Entered, Scratched and Declared in races and also choosing the Jockey to be declared on ENCHANTED in Race no 176 and giving the said Jockey instructions as to how to ride in the race.

The Stewards noted that in an earlier enquiry in respect of his actions in the matter of the Sale of b c (2005) Libor – Diamond Dreams (MOUNTAIN KING) it was decided that he would be ineligible for grant of Trainer’s License up to inclusive of 20th January 2012. Further in the said Enquiry, the Stewards had also imposed on him a suspended sentence of 2 years i.e. if he were again found to be guilty of committing irregularities and breaches of the Club’s Rules and Procedures or flouting the Rules of Racing / notifications etc. of the Club, within the next five years, then the aforesaid suspended sentence of punishment of two years would ipso facto come into force and effect.

Further, as intimated to him vide this Office letter dated 13th December 2010, the Stewards informed him that as per the previous order cited above the suspended sentence of two years ipso facto comes in to effect i.e. he shall not be granted a Trainer’s License, should he apply, for a further period of two years starting from 20th February 2012 to 20th February 2014.

b)         The Stewards were not satisfied with the explanation tendered by Trainer Jayantilal K.Gor in the subject case and held him guilty of breach of the Rules of Racing as a consequence guilty of gross misconduct. In that, he had allowed Mr.Nirad Karanjawala, a suspended Trainer, to interfere in the management of his horses by accepting instructions from him which were sent through his Clerk Mr.Sainath. Further, he had totally disregarded the directions of the Owner and declared Jockey Towfeeq R.Shaikh on ENCHANTED in Race No.176 when he was specifically told not to declare the said Jockey. The Stewards also held him guilty of tendering false and misleading evidence in the enquiry. The Stewards noted that Mr.Jayantilal K.Gor was holding a Trainer’s license under the Rules of this Club for the last 16 years and therefore did not accept his contention that this was an act of ignorance since he was illiterate and unaware of the Rules of Racing.

In view of the above, the Stewards decided that should Mr.Jayantilal K. Gor apply for a Trainer’s license for the Season 2011/12, the same will be granted to him, however, his Trainer’s license shall stand suspended w.e.f.  21st July, 2011 to 21st August, 2011 for breach of the Rules of Racing as a consequence guilty of gross misconduct.

c)         The Stewards were also not satisfied with the explanation tendered by Trainer Jayantilal K.Gor’s Clerk, Mr.Sainath in the subject case. However, considering that he was new to racing, the Stewards decided to give him the benefit of the doubt in the subject case and severely warned him for the future.
