RE : ENQUIRY INTO  THE POSITIVE REPORT IN RESPECT OF dk b g “URBAN WARRIOR” (UNPLACED) IN RACE NO.79 – THE HAWKE BAY PLATE RUN ON SATURDAY, 21ST AUGUST, 2010 –REPORTED POSITIVE FOR “BOLDENONE”:

The Stewards of the Club at their Meeting held on Friday, 22nd October, 2010 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry. They interviewed Trainer S.Shaikh and having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and submissions made in the matter and also having permitted Tr.S.Shaikh to make submissions in the subject matter, found that he had no mitigating circumstances to offer in the subject case and as such, held him guilty of breach of the Medication Rules.

Further,  the circumstantial evidence in the enquiry leads the Stewards  to believe that :-

1)   Trainer S.Shaikh was unable to give a reasonably satisfactory explanation as to how the drug BOLDENONE was found in the urine sample of URBAN WARRIOR. However, the fact remained that the horse was administered BOLDENONE.  Also, BOLDENONE, an anabolic steroid, is a banned substance for racing horses as per the notification received from the Government of India and its presence in the urine sample of URBAN WARRIOR is also a  breach of the Medication Rules and therefore more serious than the mere finding of a prohibited substance;

2)         By his own admission in the enquiry, his horse URBAN WARRIOR needed pick-ups to improve his condition.

3)         By his own admission, the security in his stable was good and one of his staff was always present in the stable to keep security of the horses and it was not possible for an outsider to enter his stable and give an injection to his horse. Also, Tr.S.Shaikh stated that he had full faith in his staff and he was confident that they were not involved in giving BOLDENONE to his horse URBAN WARRIOR.

4)         The drug BOLDENONE does not have an immediate effect on a horse and Tr.S.Shaikh admitted in the enquiry that except him, no other person was aware of the racing schedule of the horse. Therefore, there could be no motive for an outsider to give a drug like BOLDENONE to his horse URBAN WARRIOR.

5)     The Stewards also held Tr.S.Shaikh guilty of not maintaining a Veterinary Log Book which was a serious lapse on his part.

Taking an overall view  and in view of the circumstantial evidence as stated above, the Stewards decided :-

(a)     To suspend Mr.S.Shaikh’s Trainer’s license with immediate effect i.e. from 23rd October, 2010 till the end of the Mumbai Meeting 2010/11. Thereafter, should he apply for a Trainer’s license for the Season 2011/12, he will not be granted a license up to and inclusive of 22nd October, 2011; and

(b)     To fine him a sum of Rs.10,000/-;

(c)     To further impose on Tr.S.Shaikh a suspended sentence of one year i.e.  if he was again found guilty of a breach of the Medication Rules within the next three years and cannot prove mitigating circumstances, this suspended sentence of one year would immediately come into force in addition to whatever further action the Stewards may take against him at that time.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “SEA SHOWER” IN RACE NO.210 – THE PUNE POLICE COMMISSIONER’S TROPHY RUN ON SUNDAY, 10TH OCTOBER, 2010 :

The Stipendiary Stewards reported that they had questioned Trainer Imtiaz A.Sait and Jockey C.Rajendra in the above connection. Trainer Imtiaz A.Sait said that he had instructed the Jockey to ride his own race. He said that the horse walked into the Gates with the blindfold and had jumped out slowly and he took no exception to the Jockey’s riding.

Jockey C.Rajendra stated that his horse had banged the front Gate of its Stall as he was walked blindfolded and the horse was slowly out and soon thereafter STAR TRAINER (B.Prakash) shifted in whereby he had no option but to settle his horse behind. He added that near 1400 metres, he he had to check his mount when AMOURESQUE (P.Kamlesh) shifted in. Tereafter, near 1100 metres, he again had  to steady his mount as he raced keenly and he had AMOURESQUE in front of him and he had to avoid clipping the heels of AMOURESQUE. Jockey C.Rajendra explained that at that stage, his mount became keen and due to him having horses on his side and in front, he had no option but to check his mount and he was inconvenienced by SOLOR. He added that in the straight he had ridden out but the horse had not improved. To another question, Jockey C.Rajendra stated that he had ridden his mount in check near 1000 metres as it was a bend and he could not have given his mount more reins. He said that he had ridden this horse in its previous run in Race No.41 over 1600 metres where he rode the  horse from the front since the horse was keen and nobody else was wanting to go to the front.

The explanation tendered by the Trainer and Jockey was noted and Jockey P.Kamlesh (AMOURESQUE) has been fined Rs.2000/- for causing interference to SEA SHOWER.

RE: RACE NO 2. (222) THE KOJAGIRI PLATE (About) 1200 Metres. (RUN ON 17TH OCTOBER 2010) – JOCKEY NIRMAL JODHA :

Jockey Nirmal Jodha, the declared Rider of ROYAL STYLE, had failed to report at the Scales to be weighed out, as such he was replaced with Jockey Amyn Merchant. Since Jockey Nirmal Jodha was unavailable for questioning at that time, the pending matter was taken up and after questioning Jockey Nirmal Jodha and considering that he had a medical emergency at home, he has been only cautioned for his lapse.

-------------------------

RE: RACE NO 224 – THE CLASSIC ROCK PLATE – RUN ON 17TH OCTOBER 2010 – TRAINER C.D. KATRAK:

Before the start of the 4th race of the Day, it was informed that a change of equipment was lodged for STAR GLORY and due to shortage of time the same could not be verified and considering the welfare of the horse, the use of Tongue Strap was permitted on STAR GLORY. On enquiring the next day, it was found that no application was received for a change of equipment as claimed by Trainer C.D.Katrak’s Assistant Trainer. As such, Trainer C.D.Katrak has been fined Rs.5000/- for using an equipment without applying for the same.
