RE: APPEAL AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF THE SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 12TH SEPTEMBER 2010 TO 16TH OCTOBER 2010 FOR FOUL RIDING ON HIS MOUNT “SEA TREASURE” IN RACE NO 46 RUN ON 7TH AUGUST 2010 – JOCKEY JE PEREIRA.
The Board of Appeal at its meeting held on 12th September 2010 and having considered all documents and papers that were submitted and having heard the submissions made by him and having deliberated on the matter at length and having applied their minds decided to reject his Appeal and forfeit the deposit. Accordingly, the decision of the Stewards of the Club stands. In view of the stay granted to him on his punishment till Sunday, 12th September 2010, his punishment would now be w.e.f 13th September 2010 to 17th October 2010 (both days inclusive) (not permitted to ride work / mock race).
However, the Board of Appeal felt that the punishment meted out by the Stewards of the Club for foul riding in his case appeared to be lenient considering the gravity of the offence.
The Board therefore decided to issue a show-cause to him asking the Jockey to show-cause as to why punishment i.e., suspension of his jockey’s licence imposed on him by the Stewards of the Club should not be enhanced.
The Chairman of the Board of Appeal explained to him the abovementioned decision of the Board of Appeal in detail and informed him that he could take his own time to prepare his reply and appear before the Board of Appeal during the next week and accordingly, a meeting of the Board of Appeal could be fixed to hear him on the show-cause. However, he had indicated that he would like to reply to the show cause notice immediately and with the permission of the Chairman and consent of the Members present, he had made his submission in response to the show cause at the abovementioned meeting which was considered by the Board of Appeal.
Since his reply to the show-cause notice was not satisfactory, the Board decided to enhance the period of suspension of his jockey’s licence for a further period of 3 months i.e. w.e.f 18th October 2010 up to 17th January 2011 (both days inclusive) (not permitted to ride work / mock race). However, the incremental punishment of three months was decided to be kept pending as a suspended sentence for the next 3 years commencing from 18th October 2010 and if he was found guilty of a similar offence of foul riding during the aforesaid period of 3 years, then, in such event, the abovementioned suspended sentence of 3 months will be invoked and added on to any other punishment that may be imposed on him by the Stewards of the Club for that offence.
