RACE DAY REPORTS

 

RAILS WERE PLACED 8 METRES AWAY FROM ITS ORIGINAL POINT FROM 1600 METRES (MILE CHUTE) TO 1200 METRES, 10 METRES AWAY AT 1000 METRES AND THEREAFTER 11 METRES AWAY UP TO THE WINNING POST. FOR THE RACES STARTING FROM THE BACK STRETCH, RAILS WERE PLACED FROM ITS ORIGINAL POINT FROM 1400 METRES LEADING TO 4 METRES AWAY AT 1200 METRES, 7 METRES AWAY AT 1100 METRES AND 10 METRES AWAY AT 1000 METRES.

 

On a request from Trainer Janardhan, permission was granted to Trainer P.Shroff to saddle his charge WILDERNESS in the 1st race, at his (Trainer Janardhan’s) risk and responsibility.

On a request from Trainer Altamaash A.Ahmed, permission was granted to Trainer Damodaran D.Pillai to saddle his charge AN ACQUIRED TASTE in the 7th race, at his (Trainer Altamaash A.Ahmed’s) risk and responsibility.

RACE NO.1(30) – THE  MUNICIPAL COMMISSIONER’S TROPHY (DIV.II): (About) 1400 Metres – Runners - 12

 

At the start, STAYING ALIVE (App. Akshay Gaikwad) jumped awkwardly inwards.

 

Near 1200 metres, WILDERNESS (S.Zervan) shifted ground inwards and went on to MAJESTERIAN (Vikram Jodha) who in turn went on to SNOW BLAST (App.Yash Narredu) who was steadied.

 

Near 1000 metres, SNOW BLAST (App.Yash Narredu) was inconvenienced as MAJESTERIAN (Vikram Jodha) shifted ground inwards.

 

MAJESTERIAN (Vikram Jodha) was inclined to lug-in in the early stages of the race. Trainer Karthik G has been asked to take remedial measures before next accepting to race the gelding.

 

At about 100 metres, MAJESTERIAN (Vikram Jodha) was tightened as DIESEL DON (Dashrath Singh) shifted inwards. Jockey Dashrath Singh has been cautioned.

 

After the race, MOHEGUN SUN was observed to have broken a blood vessel and is not to race for the stipulated ban period of four weeks. The gelding has to be passed fit by the Club’s V.O. before next accepting to race.

 

After the race, WIND AND RAIN, ACKER BILK, PADMAKOSA and MAJESTERIAN (examined on 01/12/2014), were found to be sound.

 

RACE NO.2(31) – THE ROTARY CLUB OF THANE NORTHEND CUP: (About) 2000 Metres – Runners - 4

 

Jockey D.K.Ashish (FIRE ENGINE) and App.Yash Narredu (THE GENERAL) have been fined Rs.1,000/- each for using the whip in excess of the prescribed limit on their respective mount.

 

RACE NO.3(32)  – THE RED RUFUS DOUBLE STAKES : (About) 1400 Metres – Runners – 8

 

At the start, VANGUARD (App SJ Sunil) jumped out awkwardly.

 

At the start, DELIGHTFUL LADY (App.Yash Narredu, dr.3) jumped awkwardly inwards and at the same time SHAUGHNESSY (Dashrath Singh, dr.2) jumped out awkwardly and went on to the former and then went across it.

 

Jockey S.G.Prasad (ESSENCE OF LOVE) reported the loss of his whip near 250 metres.

 

After the race, ESSENCE OF LOVE was observed to have lost its right hind plate. VANGUARD and BON VIVANT were found to be sound.

 

RACE NO.4(33) – THE GRACIAS SALDANHA MEMORIAL MILLION: (About) 1000 Metres – Runners -  6

 

Trainer Dallas Todywalla has been fined Rs.2,000/- for declaring Jockey Colm O’Donoghue on DANCING PHOENIX, whereas the Jockey was ineligible to be declared as per the Employment Visa conditions.

 

At the start, CELSIUS (C.S.Jodha, dr.5) leaned inwards and a few strides later, WAY OUT (App.Yash Narredu, dr.4) also leaned inwards and tightened GREEK GOD (A.Sandesh, dr.3) on to VICTORIOUS MARCH (Neeraj Rawal, dr.2) due to which GREEK GOD lost position.

 

 

 

DANCING PHOENIX (Dashrath Singh) leaned outwards in the straight and made contact with WAY OUT (App.Yash Narredu). Trainer Dallas Todywalla has been asked to take remedial measures before next accepting to race the gelding.

After the race, WAY OUT was observed to have an injury at the wither CELSIUS was found to be sound.  .

 

RACE NO.5(34) – THE  G2 GOLD CUP: (About) 1000 Metres – Runners - 7

 

While negotiating the bend, AEOLUS MAXIMUS (Darren Williams) became keen and shifted out, due to which PHOENIX TIGER (Colm O’Donoghue) travelled wide.

 

After the race, EVIDENCE was observed to have an abrasion at the left hind fetlock.

 

RACE NO.6(35) – THE  METRO MOTORS AUTO HANGAR SIR H.M.MEHTA MILLION:

FAST LADY (D.K.Ashish) jumped out awkwardly thereby losing about 3 lengths at the start.

 

The Sr.V.O. reported that SPIDER MAN was examined at the stables in the morning and found to be sound.

 

RACE NO.7(36)– THE  A.C.ARDESHIR TROPHY (GR.3):(About) 1600 Metres – Runners -  8

 

After the race, MASTER SHIFU was found to be sound.

 

RACE NO.8(37)– THE  MUNICIPAL COMMISSIONER’S TROPHY (DIV.I):(About) 1400 Metres – Runners -  12

 

STAR LIGHTNING (Colm O’Donoghue) ducked the front gates due to which the saddle was displaced completely. In view of the above and considering that the gelding had cast in an awkward position under the front gates before coming out, STAR LIGHTNING was withdrawn from the race before coming under the Starter’s Order. Trainer Dallas Todywalla has been asked to give the gelding more gate practice and show him to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

At the start, GHALIB (App.Yash Narredu, dr.9) jumped out awkwardly. GREAT EXPECTATION (Vikram Jodha, dr.8) also jumped awkwardly outwards and went on to GHALIB.

 

LUCKY PINEAPPLE (Darren Williams) commenced to hang out soon on entering the straight and then drifted out and raced along the outer rails. Trainer Altaf Hussain has been asked to take remedial measures before next accepting to race the colt.

 

STRAWBERRY CRUSH (C.S.Jodha) lugged-in in the straight. Trainer M.K.Jadhav has been asked to take remedial measures before next accepting to race the gelding.

 

After the race, SEVEN SEAS was observed to have an abrasion at the left fore and right hind bulb of heel. LUCKY PINEAPPLE and STRAWBERRY CRUSH were found to be sound.

The post race urine sample of the winner of the 1st, 2nd, 4th, 6th & 7th race, viz. WILDERNESS, FIRE ENGINE, WAY OUT, SOLOMON and CIRCLE OF BLISS, as also that of DANCING PHOENIX & GREEK GOD (4th race), JOSHUA & PRAELECTOR (6th race) and MARIINSKY & SILVER STREAK (7th race), and the special sample of MOHEGUN SUN (1st race), CELSIUS (4th race), PHOENIX TIGER & CALISSA (5th race) and SPIDER MAN (6th race), were collected for detection of prohibited substance.

ADDITIONAL REPORTS:

 

RE : CASE REFERRED BACK TO THE STEWARDS OF THE CLUB DUE TO FRESH EVIDENCE – APPEAL PREFERRED BY TRAINER MANSOOR SHAH TO THE BOARD OF APPEAL AGAINST THE DECISION OF THE STEWARDS OF THE CLUB – ENQUIRY INTO THE POOR PERFORMANCE OF “TUSCANIA” IN RACE NO.237 – THE WASHINGTON IRVINE PLATE (DIV.II) RUN ON 6TH MARCH, 2014 – DE-NOVO ENQUIRY :

 

The Stewards of the Club at their meeting held on 20th November, 2014 interviewed Trainer Mansoor Shah who was accompanied by his Spokesman, Mr.Haresh N.Mehta. The Stewards considered all the submissions made by Trainer Mansoor Shah and his Spokesman. Trainer Mansoor Shah was given the opportunity to bring in witnesses, however, he stated that his witness Dr.Hasneyn Mirza could not attend the meeting but had given his opinion which was enclosed in his written submissions. The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings reports and records, including Trainer Mansoor Shah’s written submissions received in this office on 15th November, 2014 and also having permitted him/his Spokesman to make submissions in the subject matter, were not satisfied with the explanation tendered by Trainer Mansoor Shah and under Rule 202 (ii) of the Rules of Racing, held him guilty of  dishonest, corrupt, fraudulent, improper practice and dishonorable action in connection with racing for the following reasons:-

1)            On going through the record of weights for the past two years, it was noted that in every Racing Season TUSCANIA started racing at a particular weight and thereafter consistently lost about 2 to 3 kg. weight after every run till end of the season, except in the race in question i.e. Race No.237 where the filly suddenly showed an increase of 22 kg. over the weight at which she ran in the previous race. Trainer Mansoor Shah was not able to satisfactorily explain the above sudden increase of 22 kg. weight in Race No.237.

 

2)            It was noted that TUSCANIA was not shifted to the Security Stable and thus she was beyond the domain of the surveillance camera. Trainer Mansoor Shah’s explanation that he has only nine stalls in the Security Yard and he had ten runners on 6th March, 2014  and he did not shift TUSCANIA to the Security Yard since he did not wish to disturb her and let her remain in her own stall since the Jamadar resides close to her stall and could keep a watch over her, was not accepted by the Stewards. The Stewards also did not accept his explanation that he did not fancy the filly TUSCANIA in the race in question keeping in mind that she had bled in the past and also had finished nearly 10 lengths behind in her earlier run i.e. Race No.190. By Trainer Mansoor Shah’s own admission, some of his runners on 6th March, 2014 did not have any chance to win. Whereas TUSCANIA had shown decent form during the Mumbai Season 2013/14 having placed in three out of the four races. Therefore, the right thing for him to do would have been to keep one of such runners who did not have a chance to win, outside the Security Yard and to shift TUSCANIA to the Security Yard under surveillance cameras. Also, the filly opened a favourite in Race No.237 and if he gave the filly no chance because of her history of breaking a blood vessel, then he would not have declared a top Jockey like Dashrath Singh.

 

3)     The Stewards of the Club have no reason to disbelief the Report from the Chief Veterinarian of the Equine Hospital in respect of the endoscopy done at the Equine Hospital on TUSCANIA which states that “Multiple injuries noticed on the inner wall of nasal cavity suggestive of induced trauma”. This finding was confirmed by Trainer Mansoor Shah’s private Vet Dr.P.T.Khambatta when he accompanied him to the Equine Hospital to view the recording of the endoscopy to give his expert opinion. 

 

4)  The Stewards noted Trainer Mansoor Shah’s contention that he was not informed by the Club’s Equine Hospital before the endoscopy was done. However, he was aware that the filly TUSCANIA had bled profusely in the race and she was kept under observation, therefore, he was duty bound to either visit the Equine Hospital himself to check on her condition and help in the investigation or to depute his Jamadar/senior staff to be with the filly, instead of leaving her under the care of the Syce, which he failed to do.

 

5) The Chief Veterinarian of the Club’s Equine Hospital and the Sr.V.O. have both confirmed that the multiple injury marks noticed on the inner wall of the nasal cavity suggested induced trauma. The Stewards noted that an Endoscope is made of a very soft compatible specialized latex which is designed after a lot of research and is very pliable. Further, it has a camera enclosed at the tip and it only views whatever is ahead, when it is slid through the nostril of a horse. Both the Vets have confirmed that an endoscopy cannot create these injury marks especially since the insertion of the endoscope can be clearly monitored from outside through a camera and therefore there is absolutely no possibility of the insertion of endoscopy causing an injury.

 

Trainer Mansoor Shah’s contention that the injury marks could have been as a result of the filly playing up is ruled out by the fact that the endoscope slid through the nostril of TUSCANIA smoothly as is evident on the CD recording. Had the filly been fractions at the time of endoscopy, the scope would have moved forward and backward which was not the case.

 

 

6)            The Chief Veterinarian of the Club’s Equine Hospital and the Sr.V.O. have both confirmed that the injury marks are of a recent origin which according to them could be the result of an attempt being made to tube the filly prior to her race. The Stewards have no reason to disbelieve the opinion given by two Senior Veterinary Officers of the Club.

 

The opinion of Dr.Hasneyn Mirza submitted by Trainer Mansoor Shah on the endoscopy done on TUSCANIA by the Equine Hospital, confirms that there were some abrasions on the mucosal surface of the turbinate bones in the nasal passage. Dr.Hasneyn Mirza states that these abrasions could not have necessarily been caused by the passage of a stomach tube, however, he has not explained further as to the cause of these injuries.

 

7)            The Stewards noted that there was a drift in the odds on TUSCANIA in Race No.237 from 5/2 to 4/1 although there was no other horse backed down in that race.

 

In view of the above, the circumstantial evidence leads the Stewards to believe that there appears to be an attempt made to tube the filly although the tubing may have been successful or not. The Stewards believe that the filly was deliberately not shifted to the Security Stable and kept outside the domain of the surveillance camera. The Endoscopy Report from the Club’s Equine Hospital states “Multiple injuries noticed on the inner wall of the nasal cavity suggestive of induced trauma” and the Chief Veterinarian of the Club’s Equine Hospital and the Sr.V.O. have opined that these multiple injury marks noticed  were of recent origin,  which suggests that an attempt was certainly made prior to the race to tube the filly.   The Stewards have no reason to disbelief the expert opinion of the Club’s two senior Officials.  As such, under Rule 202 (ii) of the Rules of Racing, the Stewards held Trainer Mansoor Shah guilty of  dishonest, corrupt, fraudulent, improper practice and dishonorable action in connection with racing” .

 

However, taking an overall view and considering the submissions made by Trainer Mansoor Shah and his spokesman, the Stewards took a lenient view and decided :-

 

a)       To suspend his Trainer’s license w.e.f. 5th December, 2014 till the end of the Mumbai Meeting 2014/15 and thereafter not to grant him a Trainer’s license, if he applied for the same, till 30th October, 2015;

b)       To fine him a sum of Rs.1,00,000/-.

RE : POSITIVE REPORT IN RESPECT OF  dk b g “ZODIAC” (PLACED THIRD) IN RACE NO.154 – THE S.A.POONAWALLA MULTI-MILLION (GR.2) RUN ON SUNDAY, 21ST SEPTEMBER, 2014 :

 

Vide this office letter Ref : Rd/SS-114 dated 21st November, 2014 Tr.Dallas Todywalla was requested to inform this office in writing latest by 25th November, 2014 whether he wished the split sample of his charge ZODIAC to go to The Hong Kong Jockey Club Lab, or L.C.H., France,, for Confirmatory Analysis and also the name of the Witnessing Analyst, if any, failing which the Stewards shall treat the report of the Primary Laboratory as conclusive.

 

Trainer Dallas Todywalla failed to reply to the above letter by 25th November, 2014. As such, the matter was therefore reported to the Stewards for such action as deemed fit.

 

The Stewards of the Club at their meeting held on Sunday, 30th November, 2014 interviewed Trainer Dallas Todywalla in the above connection, at which time he confirmed that he did not wish to send the split sample of his charge ZODIAC for Confirmatory Analysis.  In view of the above, as per the Medication Rules, the Stewards  decided to treat Positive Report dated 30th October, 2014 from LGC, Newmarket, UK, in respect of the sample of urine taken from your charge ZODIAC (Placed Third) in Race No.154 – The S.A.Poonawalla Multi-Million (Gr,2) run on Sunday, 21st September, 2014,  as conclusive and binding on Trainer Dallas Todywalla.

 

Trainer Dallas Todywalla was asked to conduct his own enquiries and to lead evidence, if any, to prove mitigating circumstances, within 15 days and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.Veterinary Officer of the Club, as and when he would be required to.

 

Further, as per the Medication Rules,  the Stewards of the Club decided to disqualify ZODIAC (Placed Third) in Race No.154 – The S.A.Poonawalla Multi-Million (Gr,2) run on Sunday, 21st September, 2014 and to revise the order of placing of the race as under :

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “CUT DIAMOND” (S.G.PRASAD) IN RACE NO.366 – THE GOODBYE PLATE (DIV.I) RUN ON 27TH APRIL, 2014 :

 

The Stewards of the Club at their meeting held on Sunday, 30th November, 2014 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards interviewed Trainer Altaf Hussain and Jockey S.G.Prasad, who was accompanied by his Spokesman, Mr.H.J.Antia. Having considered all papers and proceedings before them and having viewed the video recording of Race No.366, decided that no action was called for in the matter.

RE : INCIDENT THAT TOOK PLACE IN THE PASSAGE LEADING TO THE PADDOCK AFTER THE RUNNING OF THE 7TH RACE I.E. RACE NO.21 – THE ROTARY CLUB OF BOMBAY QUEENS NECKLACE CUP RUN ON 23RD NOVEMBER, 2014 :

 

The Stewards of the Club at their meeting held on Sunday, 30th November, 2014 considered a Report from the Stipendiary Stewards in reference to the captioned subject matter. The Stewards interviewed Jockey A.Sandesh and having deliberated the matter, decided not to initiate any action against Jockey A Sandesh.
