ADDITIONAL REPORT/S:

RE: APPEAL FROM JOCKEY C.S.JODHA AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 23RD AUGUST 2015 TO 5TH SEPTEMBER 2015 FOR UNSATISFACTORY RIDING ON HIS MOUNT – ENQUIRY INTO THE RUNNING AND RIDING OF “SHADOWFAX” IN RACE NO 31 RUN ON 2nd AUGUST 2015 AT THE PUNE RACECOURSE:

The Board of Appeal at its meeting held on 24th August 2015 considered the captioned Appeal. The Board of Appeal considered all documents and papers that were submitted and heard the submissions made by Jockey C.S.Jodha and his Spokesman, Mr. S Kapoor, and viewed the video of the race in question with its relevant angles as also Race No.309. The Board of Appeal having deliberated on the matter at length, gave Jockey C.S.Jodha benefit of grave doubt between Unsatisfactory Riding and not allowing his mount to run on its merits. The Board of Appeal, therefore, decided to reject the Appeal and forfeit the Deposit. Accordingly, the decision of the Stewards of the Club stands.

In view of the Stay granted to Jockey C.S.Jodha, his Jockey’s License now stands suspended w.e.f. 29th August 2015 to 6th September 2015. (Both days inclusive).

RE: APPEAL FROM TRAINER C.RAJENDRA AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF SUSPENSION OF HIS TRAINER’S LICENCE W.E.F 23RD AUGUST 2015 TO 22ND SEPTEMBER 2015 (BOTH DAY INCLUSIVE) WITH A SEVERE WARNING FOR BEING GUILTY OF MISCONDUCT AND GROSS NEGLIGENCE AND NEGLECT IN DISCHARGE OF DUTIES AS A LICENCED TRAINER IN CASES OF “MISS SENORITA” AND “EX- ARMETTA” UNDER HIS CHARGE:

The Board of Appeal at its meeting held on 24th and 25th August 2015 considered the appeal from Trainer C Rajendra dated 12thAugust 2015. The Board of Appeal considered all documents and papers that were submitted and heard the submissions made by Tr.C.Rajendra and his Spokesman, Mr. Pervez Andhyarujina. Whilst deliberating on the matter, the Board felt that Rule 202(i) was not applicable in this case since the Board did not find him guilty of any dishonest, corrupt, fraudulent or improper practice or dishonorable action in connection with racing but the Board did feel that Rule 202 (xvi) is applicable in the case since there was an infringement of the provisions of the license issued to him by the Stewards of the Club. The Board also felt that he had been negligent in discharging his duty as a Trainer and was complacent in not getting a second opinion from another Veterinarian with regard to the deteriorating condition of MISS SENORITA and 2 year old Ex-ARMETTA.

In view of the above, the Board of Appeal decided to modify the punishment meted out to Tr.C.Rajendra by the Stewards of the Club by imposing Rule 202(xvi) of the Rules of Racing and not Rule 202(i) and also to set aside the suspension of his Trainer’s License and instead levied a fine of Rs.1 lakh on him. The deposit was ordered to be refunded.

RE : ENQUIRY INTO THE RIDING OF JOCKEY SANDEEP JADHAV ON HIS MOUNT “SPEED BABY” IN RACE NO.268 – THE ROMAN ROSE PLATE RUN ON THURSDAY, 19TH MARCH, 2015  AND HIS ASSOCIATION WITH A WARNED OFF PERSON – JOCKEY SANDEEP JADHAV WAS SUSPENDING PENDING ENQUIRY :

The Stewards of the Club at their meeting held on Saturday, 29th August, 2015 noted with displeasure that despite five months being lapsed since Jockey Sandeep Jadhav was told to submit his itemized incoming and outgoing calls to the Stipendiary Stewards, he failed to do so, due to which the Stipendiary Stewards have not been able to conclude the enquiry. The Stewards of the Club decided to give him further time up to Friday, 4th September, 2015 to submit his itemized incoming and outgoing calls to the Stipendiary Stewards, failing which the Stewards would take up the matter next week and take such action as they deem fit.

_______________.

RE : NEGLIGENCE IN THE YARD OF TRAINER DALLAS TODYWALLA :

The Stewards of the Club at their meeting held on Saturday, 29th August, 2015 considered note dated 27th August, 2015 from the Stipendiary Stewards in reference to the above incident. They interviewed Trainer Dallas Todywalla and having heard him, were not satisfied with the explanation tendered by him. The Stewards noted that despite being aware of the Notice in the Racing Calendar “Re : Tampering with Electrical Fitting, etc. in the Stable area” Tr.Dallas Todywalla carried out changes in the electrical fitting in his stable through a private electrician without informing the Club Authorities. This act of his led to an incident which caused electrocution of an equine. Hence the Stewards viewed this incident very seriously and held him guilty of gross negligence in discharge of his duties as a Trainer and fined him a sum of Rs.50,000/-.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “OCEAN SPARKLE” IN RACE NO.74 – THE SEA RULER PLATE RUN ON SATURDAY, 22ND AUGUST, 2015 – AFTER THE RACE THE TRAINER HAD REPORTED THAT HE WAS NOT SATISFIED WITH THE JOCKEY’S RIDING :

The Stipendiary Stewards reported that they had questioned Trainer S.K.Sunderji and App.R.Ajinkya in the above connection. The video of the race was viewed and when questioned, Tr.Sunderji said that he had instructed the Jockey to sit in 3rd / 4th position and to do his best. He added that he had also told the Jockey to ride out in the first 50 metres after the start and then settle in a good position. App.R.Ajinkya confirmed the instructions.

When asked about his observation of the race, Tr.Sunderji said that the Jockey rode contrary to his instructions, he has not made any effort in the initial part to get into a good/advantageous position and he was not satisfied with his riding. He said that in the previous race i.e. Race No.20, the filly was ridden by Jockey Vikram.Jodha who was able to sit well up despite it being a 1000 metres race.

The video of Race No.20 was viewed.

On further questioning, App.R.Ajinkya stated that after the jump, he was well placed, however, approaching the 1000 metres, he was hampered for room or else he would have been in a good position.

After reviewing the video of both the runs of this filly and having heard the submissions made, the Stipendiary Stewards felt that App.R.Ajinkya should have made more efforts to follow his instructions. As such, App.R.Ajinkya was informed that failing to follow instructions in the future, would entail severe action.
