ADDITIONAL REPORT/S:

RE : APPEAL FROM TRAINER BEZAN CHENOY AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF SUSPENSION OF HIS TRAINER’S LICENSE AND A FINE OF RS.10,000/- IMPOSED ON HIM – ENQUIRY INTO THE POSITIVE FINDING OF ‘BOLDENONE’ IN THE URINE SAMPLE OF “DISRAELI” (RANDOM SAMPLE) COLLECTED ON 22nd JUNE 2015:

The Board of Appeal at its meeting held on 19th April 2016 considered the captioned subject matter.

The Board of Appeal having studied all documents and papers that were submitted and having heard the submissions made by Trainer Bezan Chenoy and his Spokesperson, Mrs. Bakhtawar B. Chenoy, and the explanation tendered by the Chief Stipendiary Steward and the Sr. V.O.  deliberated on the matter at length and having applied their minds to the entire facts of the case, noted that Trainer Bezan Chenoy was vicariously responsible for the positive finding of prohibited substance, Boldenone, in the Random Sample of urine collected from DISRAELI on 22nd June, 2015. However, the Board of Appeal considered that the submissions made by Trainer Bezan Chenoy and his Spokesperson can be summarized as follows:

1.    That Boldenone has not passed through the horse’s system but possibly it is a case of ‘mixed-up sample, spiked sample or contamination of the sample’ and Trainer Bezan Chenoy had submitted several scientific opinions of world renowned experts confirming that the chances of Boldenone passing through the horse’s system were minimal.

2.    That the test results of the hair follicle samples showed negative results. It was pertinent to note that this test was at the behest of the Stewards of the Club;

3.    That it was the case of the Appellant that notwithstanding the fact that there could have been a ‘mix up, spiking, contamination of the sample, he was framed by unknown persons;

Keeping the above points in mind and also noting various lapses and lacunae in the sample collection procedures, the Board noted that DISRAELI had tested positive for Boldenone even in the Confirmatory Analysis performed by the Reference Laboratory, hence, the question of the case not being treated as positive did not arise. Further, the Board also noted that despite suggesting ‘mix up/ Spiking / contamination of the sample’, Trainer Bezan Chenoy had not conducted any test or to substantiate his claim or bring evidence from his side to strengthen his submission.

Trainer Bezan Chenoy, whilst alleging ‘being framed up’, also had not filed any Police complaint nor conducted any private investigation from his side, if there was any ‘frame up’. Hence, keeping the above issues in mind, after lengthy deliberations the Board came to a unanimous decision on the fact that Trainer Bezan Chenoy, in the absence of an explanation of any mitigating circumstances, was vicariously liable and hence punishable under the Rules and regulation of the Club. Hence, it was decided that the Appeal be partially allowed to the extent of reduction in the punishment of 45 days meted out to him by the Stewards be reduced to 30 days since, there was no case of any satisfactory explanation for any mitigating circumstances.

Mr. Ardeshir Narielwala, whilst agreeing for the charge of vicarious liability, dissented on the reduction of punishment and stated that status quo i.e. the punishment of 45 days should not be altered.

Therefore, the Board decided to partially modify the penalty and reduce the punishment as under:

a)    To reduce the period of suspension from 45 days to 30 days and the same to take effect from 28th July 2016 to 26th August 2016 (both days inclusive);

b)    To retain the fine of Rs.10,000/- imposed on him by the Stewards of the Club.

The Deposit for the Appeal was ordered to be refunded.
