RE : ENQUIRY INTO THE RIDING OF JOCKEY MARTIN DWYER ON “ICE AGE” IN RACE NO.210 – THE ICE MAGIC PLATE (DIV.I) RUN ON SUNDAY, 17TH FEBRUARY, 2013 – AFTER A STEWARDS’ ENQUIRY “ICE AGE” WAS DECLARED A NON-STARTER :

The Stewards of the Club at their meeting held on Thursday, 21st March, 2013 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. They interviewed Jockey Martin Dwyer and his Spokesman, Mr.S.Padmanabhan as also Trainer C.D.Katrak and having considered all the submissions made by them and having viewed the video recording of Race No.210 as also the previous runs of the filly and having deliberated the matter, the stewards were not satisfied with the explanation tendered by Jockey Martin Dwyer and held him guilty of not allowing his mount ICE AGE to run on its merits in Race No.210.. The Stewards noted that :-

1) When Jockey Martin Dwyer rode the filly in Race No.183, the filly showed no signs of erratic behavior;

2) In the race in question, travelling about 50 metres from the start, he had a chance to improve his position but for no apparent reason he checked his filly. The Stewards did not accept his explanation that he held his filly for a stride or two since SHERLOCK HOLMES had come in his path. It is evident on the video recording that he checked his filly even before SHERLOCK HOLMES started to shift in.

3)  Near 1000 metres an incident took place along the rails wherein BLUE CASPER over reached the horse in front i.e. ZOE and got unbalanced, however, ICE AGE was nearly 2  to 3 lengths behind and almost 3 horses away from the rails at that stage but for no apparent reason he again checked his filly and pulled her out thereby breaking her stride.  The Stewards did not accept his explanation that his filly shied away on her own due to the incident to BLUE CASPER at that stage.

4)    In the home straight, when he pulled the filly out at the 300 metres to make his move, he had a clear run and the filly was responding well but for no apparent reason he allowed the filly to shift in and kept her covered behind SHERLOCK HOLMES for an unreasonable period of time.

5)     In the last 100 metres, the filly had a clear run and responded well when he used the whip a couple of times, but for no apparent reason he pulled her in after which she ducked and twice bumped the horse on the inside.

Even he is given the benefit of doubt for the incidents from 300 metres, his intention throughout the race were to have the filly unbalanced and not run her best.

6)            The Club’s V.O. reported that after the race the filly was observed to have broken a blood vessel. However, the Stewards were not impressed that this could have affected her running through the race. The Stewards felt she would have stopped when the blood vessel broke,  however, ICE AGE was the best moving horse at the finish. Further, the filly was reported to be sound for mouth and limbs.

Taking an overall view and keeping in mind Martin Dwyer’s previous clean record and the fact that he rides in U.K. where racing is conducted every day, the Stewards took a lenient view in the matter and decided to suspend his Jockey’s license from 6th April, 2013 to 31st May, 2013 (both days inclusive).

M/s Champaklal Zaveri, Geoffrey B.Nagpal and Tariq Vaidya dissented because they found that the suspension was somewhat lenient given that the Stewards had unanimously agreed that Martin Dwyer  had not allowed his mount to run on its merits. Moreover, they felt that given the suspensions meted out in previous cases to both Indian and Foreign Jockeys, the suspension awarded in this case was inadequate.
