ADDITIONAL REPORT:

RE:ENQUIRY INTO THE RUNNING AND  RIDING OF “PERSIAN PRINCE” IN RACE NO.150 - THE IRISH THROUGHBRED MARKETING MULTI-MILLION, RUN ON SUNDAY 24th  JANUARY  2016 :

Trainer P. Shroff and Jockey P. Trevor were shown the video of the race and were questioned on 3rd March, 2016. Trainer P. Shroff stated that he had instructed the Jockey to jump and settle the horse as he felt it would be a fast run race and to do his best. He opined that Jockey P. Trevor should have sat further up since the pace was not as fast as they had expected. He added that PERSIAN PRINCE is a horse with ability but everything went wrong for him in this race.

Jockey P. Trevor stated that he was asked to try and settle the hose but if he fights too much for its head, then to let him go to the front. He attributed the poor performance of the horse to the slow pace of the race. He said that when the horse was on the inside, he was not galloping well and he could not spurt in the last two furlongs. To another question, Tr. P. Shroff stated that the horse generally bolts in work and he is a big made horse weighing over 500 kg. He said that he is planning to run him next weekend.

Having heard the Trainer and Jockey, the enquiry was kept open until the horse raced next.

PERSIAN PRINCE (P. S. Chouhan) subsequently won by 5 lengths in Race No.174 – The Kingfisher ULTRA – Emperor of Good Times Challenge on 6th February, 2016 after which the above enquiry was re-opened and Trainer P. Shroff and Jockey P. Trevor were again questioned on 13th March, 2016.

Trainer P. Shroff and Jockey P. Trevor were informed that further to the enquiry held on 3rd February 2016 wherein the gelding had run below expectation in Race No.150 and also the running pattern of the gelding was different from his previous start in Race No.65, they had been informed that the enquiry was being kept open. Now that the gelding had won twice after Race No.150, did they have anything further to say on the subject.

Trainer P. Shroff stated that as mentioned earlier, the race in question had not gone the way they had expected and that may be the reason why the gelding had not galloped to its true potential and he attributed the same to the circumstances of the race. He said that PERSIAN PRINCE was a strong horse and bolts very often during morning work and the boys who work him are aware of his habit and this was always at the back of their minds, however, in the race the gelding settles better than the way he behaves in morning work. He added that in the race in question (150) they had expected HOLY SMOKE (Colm O’Donoghue) to go to the front and that it would be a fast run race. He

said that although Jockey Colm O’Donoghue went to the front, he slowed down the pace and coming into the straight he quickened away which has made them look bad and the gelding looked flat footed. He reiterated that they expected the pace to be fast and therefore instructed the Jockey to settle him. When asked for his opinion on the Jockey’s riding effort, Trainer P. Shroff said that things did not work out as they had planned and the run of the race went against them. He reiterated that he was disappointed that the horse ran a poor race but attributed it to the circumstances of the race.

The video of Race No.65 (previous) as well as Race No 174 (subsequent) were viewed.

Jockey P. Trevor reiterated that he was asked to settle his mount as the gelding gets very keen in work also. He said that the gelding was throwing his head as he tried to settle him, the pace was too slow in the early part and when he asked for an effort, the horse failed to quicken instantly and was taking his time.

Having heard the Trainer and Jockey, the Stipendiary Stewards were not satisfied with the explanation tendered and keeping in mind that the gelding was a favourite and the pattern of running in Race No.150 was different from both the previous as well the subsequent race, the matter was reported to the Stewards for unsatisfactory running and riding of PERSIAN PRINCE. Further, any change of tactics should have been brought to the attention of the Stipes, especially on a favourite.

The Stewards of the Club at their meeting held on 17th March, 2016 interviewed Tr. P. Shroff and Jockey P. Trevor  in the above connection. Having heard the submissions made and having viewed the video of the race in question as also Race Nos.65 and 174, i.e. the previous and subsequent run of the horse, the Stewards were not satisfied with the explanation tendered by Jockey P. Trevor and held him guilty of unsatisfactory riding on his mount.. In that, conceding that he was instructed to settle the horse, however,  he was riding a fancied runner and settled the horse too far behind and made no effort to be in a striking position. Therefore, the Stewards decided to fine him a sum of Rs.20,000/- and severely cautioned him for the future.

Further, the Stewards were also not satisfied with the explanation tendered by Trainer P. Shroff and held him guilty of unsatisfactory running of his charge, wherein his instructions to the Jockey on a fancied runner were not consistent with his running pattern in recent races that the horse won. If he wanted to change the running tactics in Race No.150, he should have informed the Stipendiary Stewards before the race, which he failed to do. Also, if it was his intention to school his charge to come from behind, the same was not substantiated since the horse subsequently won two races hitting the front. Therefore, the Stewards decided to fine him a sum of Rs.20,000/- and severely cautioned him for the future.

RE: APPEAL FROM JOCKEY S. ZERVAN AGAINST THE DECISION OF THE STEWARDS OF THE CLUB IN RESPECT OF SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 12th MARCH 2016 TO 26th MARCH 2016 IMPOSED ON HIM FOR UNSATISFACTORY RIDING ON “IN MY DREAM” IN RACE NO 176 – THE KUNIGAL STUD BREEDERS’ PRODUCE STAKES (GR. 3) – RUN ON 6th FEBRUARY 2016

The Board of Appeal at its meeting held on 10th March 2016 considered Appeal from Jockey S. Zervan in respect of the captioned subject matter. The Board of Appeal having studied all documents and papers that were submitted and having heard the submissions made by Jockey S. Zervan as well as Trainer C. D. Katrak, having viewed the video replay of the races of IN MY DREAM, deliberated on the matter at length and having applied their minds to the entire facts of the case, the Board of Appeal held the view that this was not a case of Unsatisfactory riding but of ill-judged/injudicious riding as his ride on IN MY DREAM was not malafide and the filly has a peculiar way of running and gallops in the last 200 metres or so. The Board felt that the Instructions given to the Jockey were optimistic. Nevertheless, the Board felt that there was lack of effort from Jockey S. Zervan in the first 200 metres from the start which he has admitted before the Stewards of the Club. The Board was also seized of the fact that he had the opportunity to include his comments on the running of this filly in Race no 226 and include the same in his Grounds of Appeal which was not available to the Stewards of the Club and therefore cannot be relied upon.

Therefore, the Board decided, by majority, to partially allow his Appeal.

In view of the above, his Jockey’s License stood suspended w.e.f. 12th March 2016 to 13th March 2016 (Permitted to ride work/ Mock race) and he was fined a sum of Rs.10,000/-. His Deposit for the Appeal was refunded.
