ADDITIONAL REPORT:
RE : ENQUIRY INTO THE POSITIVE REPORT IN RESPECT OF b f “SOUL CENTRIC” (WINNER) IN RACE NO.86 – THE RAPHAELA PLATE (DIV.II) RUN ON 29TH AUGUST, 2015 – POSITIVE FOR “CATHINONE” :
The Stewards of the Club at their meeting held on Wednesday, 13th January, 2016 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry and interviewed Tr.S.S.Shah and his Spokesman, Dr.Prashant Wandhare.
The Stewards considered all submissions, papers, proceedings, documents and various scientific opinions before them and heard Tr.S.S.Shah/his Spokesman, Dr.Prashant Wandhare. Having applied their minds to the entire facts and circumstances of the case and all submissions made, the Stewards found and the Trainer confirmed that he had no mitigating circumstances to offer in the subject case, and held him vicariously responsible for the positive finding of Cathinone, a Class-I substance, in the urine sample of his horse SOUL CENTRIC (Winner) in Race No.86 – The Raphaela Plate (Div.II) run on 29th August, 2015.
Nevertheless, taking an overall view and taking into account Tr.S.S.Shah’s excellent track record of 46 years, the Stewards took a lenient view and instead of imposing on him the applicable suspension of 90 days for the first offence for a Class-I substance, they decided to suspend his Trainer’s license for a period of only 30 days i.e. with effect from 28th January, 2016 to 26th February, 2016 (both days inclusive) and to fine him a sum of Rs.15,000/- for vicarious liability since Rule-XIII of the “Medication Control For Horses in Training and Racing” states “The Trainer is always responsible for the protection and security of the horses in his care. Trainers are warned that they will be held responsible if an examination of a horse results in the finding of any prohibited substances.”
The Stewards took this opportunity to compliment Tr.S.S.Shah on his good attitude and approach during this enquiry.
