Jockey S.P.Ranjane confirmed the instructions. The video recording of the race was viewed and it was pointed out to Jockey S.P.Ranjane that the horse was slightly inconvenienced on jump out and he had to steady his mount but thereafter he had made no effort to improve his position and sit well up as instructed. Further, on entering the straight twice he had the opportunity to take an opening but he made no attempt to take the gap and instead went behind horses thereby denying his horse a clear run and took the horse out when the race was nearly over. Further, he had not used the whip even once and he was feeble in his riding efforts. Trainer Antia said that he had not told the Jockey not to use the whip. He expressed his dissatisfaction with the Jockey’s riding. Not being satisfied with the explanation tendered by Jockey S.P.Ranjane, he was reported to the Stewards for not allowing his mount VIVA LA DIVA to run on its merits in the above race.
The Stewards after the last race interviewed Trainer H.J.Antia and Jockey S.P.Ranjane in the above connection. Having heard the submissions made by Trainer H.J.Antia and Jockey S.P.Ranjane and having viewed the video recording of the race, the Stewards were not satisfied with the explanation tendered by Jockey S.P.Ranjane and held him guilty of not permitting his mount VIVA LA DIVA to run on its merits. However, before taking a decision in the matter, the Stewards wished to give Jockey S.P.Ranjane one more opportunity to defend himself and hence adjourned the hearing to Thursday, 22nd December, 2011. The Stipendiary Stewards were directed to issue a letter to Jockey S.P.Ranjane to show cause in writing as to why necessary/appropriate action should not be taken against him by the Stewards of the Club in connection with the captioned matter and also to appear before the Stewards of the Club after the last race on Thursday, 22nd December, 2011

RE : DE-NOVO ENQUIRY INTO THE RUNNING AND RIDING OF “STARLIGHT MAGIC” IN RACE NO.235 – THE K.RAGHUNATH PLATE (DIV.II) RUN ON 22ND OCTOBER, 2011 - CASE REMANDED BACK TO THE STEWARDS OF THE CLUB BY THE BOARD OF APPEAL – APPEAL PREFERRED BY TRAINER VINAYAK AND JOCKEY R.SHELAR –:
The Stewards of the Club at their meeting held on 15th December, 2011 considered the above matter. the Stewards considered all papers and proceedings before them. Having considered all the submissions made by Jockey R.Shelar/his Spokesman as also Trainer Vinayak/his Spokesman and having viewed the video recording of the race (all angles) including the back view of the start which was the fresh evidence produced before the Board of Appeal, the Stewards were not satisfied with the explanation tendered by Jockey R.Shelar in the subject case and held him guilty of not allowing his mount STARLIGHT MAGIC to run on its merits in Race No.235. The Stewards noted :-
1) This was the first time that STARLIGHT MAGIC was slow out and Trainer Vinayak has claimed that the horse had jumped out well during Gate practice with Blinkers. Thereafter he continuously gagged the horse as evident on the video recording that the horse’s mouth was open and he was fighting for his head. Further, he unnecessarily travelled wide all through the race thereby losing further ground and he was very feeble in his riding effort in the straight.
2) The back view of the start of this race confirmed that he continuously gagged the horse for nearly first 80 metres after start and thereafter the horse on the inside had shifted out and forced him out at that stage.
3) The Stewards noted that he had been fined/cautioned on three occasions during the Pune Meeting 2011 for failing to ride out his mounts to complete advantage.
4) The Stewards noted that there were two horses of the same connection running in this race viz. LAKE LEADER and STARLIGHT MAGIC. The morning odds on STARLIGHT MAGIC were 10/1 and LAKE LEADER was at 13/10. Subsequently, a lot of betting came on STARLIGHT MAGIC and the horse was backed down to 9/4 and the odds on LAKE LEADER drifted. Thereafter, LAKE LEADER was backed down and won the race and the odds on STARLIGHT MAGIC went up to 15/4 and his riding suggested that he was not interested in winning the race.
Taking an overall view, the Stewards decided to maintain the quantum of punishment as decided earlier. Accordingly, his Jockey’s license now stands suspended w.e.f. 1st January, 2012 till the end of the Mumbai Meeting 2011/12. Thereafter, should he apply for a Jockey’s license for the Season 2012/13, the same shall be granted to him, however, his license shall stand suspended w.e.f. 18th July, 2012 to 14th August, 2012 (both days inclusive) for not permitting his mount STARLIGHT MAGIC to run on its merits in Race No.235. (not permitted to ride work/mock race).
Further, the Stewards were also not satisfied with the explanation tendered by Trainer Vinayak and held the view that the Jockey would not have ridden in this manner unless he had the Trainer’s tacit approval.
The Stewards noted that he had been fined on two earlier occasions in the recent past for similar offences.
Taking an overall view, the Stewards decided to maintain the quantum of punishment a decided earlier. Accordingly, Trainer Vinayak was fined a sum of Rs.50,000/-.
