RE : DE NOVO ENQUIRY - MATTER REMANDED BACK TO THE STEWARDS OF THE CLUB BY THE BOARD OF APPEAL – ENQUIRY INTO THE RIDING OF JOCKEY MARTIN DWYER ON HIS MOUNT “ICE AGE” IN RACE NO.210 – THE ICE MAGIC PLATE (DIV.I) RUN ON SUNDAY, 17TH FEBRUARY, 2013

The Stewards of the Club at their meeting held on Monday, 12th August, 2013 conducted a de-novo enquiry into the riding of Jockey Martin Dwyer on “ICE AGE” in Race No.210 – The Ice Magic Plate run on 17th February, 2013. As requested by Jockey Martin Dwyer vide his email dated 9th August, 2013, his Spokesman, Mr.S.Padmanabhan was given the opportunity to cross examine all witnesses.

The Stewards of the Club heard the submissions made by Mr.S.Padmanabhan, Trainer C.D.Katrak as also Dr.P.T.Khambatta, Jockey Suraj Narredu, Jockey S.Shinde, Jamadar Hemsingh Ladhusingh and Syce Babu Singh.  The Stewards of the Club also viewed the video recording of Race No.210 and several still pictures of Jockey Martin Dwyer’s riding actions in the last 150 metres along with Mr.S.Padmanabhan. Having considered all the papers and proceedings before them and having considered the submissions tendered by the Spokesman Mr.S.Padmanabhan,

the Stewards of the Club were not satisfied with the explanation tendered by Mr.S.Padmanabhan and held Jockey Martin Dwyer guilty of not allowing his mount ICE AGE to run on its merits in Race No.210.  The Stewards noted that :-

1) When Jockey Martin Dwyer rode the filly in Race No.183, the filly showed no erratic behavior;

2) In the race in question, travelling about 50 metres from the start, Jockey Martin Dwyer had a chance to improve his position but for no apparent reason he checked his filly. The Stewards did not accept his explanation that he held his filly for a stride or two since SHERLOCK HOLMES had come in his path. It is evident on the video recording that he checked his filly even before SHERLOCK HOLMES started to shift in. Further, this filly was at no stage balanced by him.

3)  Near 1000 metres an incident took place along the rails wherein BLUE CASPER over reached the horse in front, ZOE and got unbalanced. However, ICE AGE was nearly 2  to 3 lengths behind and almost 3 horses away from the rails at that stage and for no apparent reason Jockey Martin Dwyer again checked his filly and pulled her out thereby breaking her stride. Another example of unbalancing his horse. The Stewards did not accept his explanation that his filly shied away on her own due to the incident to BLUE CASPER at that stage.

4)    In the home straight, when he pulled the filly out at the 300 metres to make his move, he had a clear run and the filly was responding well but for no apparent reason he allowed the filly to shift in.

5)     In the last 100 metres, instead of balancing the filly he used the whip a couple of times and twice bumped the horses on the inside. He would have lost the race in any case on objection.

Even if he was given the benefit of doubt for the incidents from 300 metres,  his intention throughout the race were to have the filly unbalanced and not run her best.

6)         The Club’s V.O. reported that after the race the filly was observed to have broken a blood vessel. However, the Stewards were not impressed that this must have effected her running style through the race. The Stewards felt she would have weakened/stopped when the blood vessel broke, however, ICE AGE was the best moving horse at the finish.

7)         The Stewards of the Club did not accept his contention that the filly had bled in the race as she was under prepared and unfit because if that was so, the filly would have tired at the finish, however, in the race in question ICE AGE was the best moving horse at the finish.

Taking an overall view, the Stewards of the Club decided to suspend his  Jockey’s license from 31st August, 2013 to 30th April, 2014 (both days inclusive).
