An objection was lodged by Jockey A.Imran Khan, the rider of GRAND ARCHITECT (Placed Second) against BRAVE (App.P.S.Kaviraj, placed First). The reason being, as soon as he jumped and tried to make a forward position, the winner BRAVE (Drawn-12) came in sharply and took his ground due to which he had to check his mount and lost balance at a very crucial stage in a 5 furlong race which cost him a certain race.

RE : TRAINER DALLAS TODYWALLA’S NON APPEARANCE BEFORE THE BOARD OF APPEAL ON WEDNESDAY, 24TH JULY, 2019 – APPEAL RECEIVED FROM JOCKEY P.TREVOR AGAINST THE DECISION OF THE STEWARDS OF THE CLUB CONFIRMING THE DECISION OF THE STIPENDIARY STEWARDS  SUSPENDING HIS JOCKEY’S LICENCE FOR 2 RACE DAYS FOR RIDING AN INCOMPETENT RACE ON “STRONG STORM” IN RACE NO.157 – THE NOBLE OPINION PLATE RUN ON 21ST FEBRUARY, 2019 AT THE MUMBAI RACE COURSE :

The Board of Appeal at its meeting held on 7th August, 2019 interviewed Tr.Dallas Todywalla in connection with the abovementioned subject.

The Board of Appeal considered all documents and papers that were submitted and heard the submissions made by Trainer Dallas Todywalla. The Board having deliberated on the matter at length had made the following observations:

a)            When the office had sent the call letter to Trainer Dallas Todywalla on 12th July, 2019, no explanation was given by him as to why did he delay his reply up to 23rd July, 2019, which inferred that there was no seriousness and the approach was casual;

b)            In the letter it was stated that “As I have operated my back”, which sentence was correct; however, it gave an impression that the operation had been done a month or two back but at the meeting Trainer Dallas Todywalla had clarified that it was done about 10 months back.

c)             The letter was a mere information to the Board as it did not show any trace of apology as advised by the Chief Stipendiary Steward.

The Board of Appeal had therefore come to a conclusion that Trainer Dallas Todywalla had not conducted himself well and referred to the norms related to the improper behaviour by professionals during an enquiry which attracted a fine of Rs.10,000/- or two months suspension.

Trainer Dallas Todywalla apologised for  his non-appearance and gave assurance that such an act would not be repeated in future and the Board took note of his apology as also the fact that it was not intentional on his part to disrespect the Officials and Board.

Having taken into consideration Trainer Dallas Todywalla’s good reputation as also his clean record, the Board decided not to impose a suspension but to fine him an amount of Rs.20,000/-.

RE: ENQUIRY INTO THE RIDING OF JOCKEY A.SANDESH ON “SUPER MARIO” (DRAWN-5) IN RACE NO.38 – THE DR.P.K.SARDEHMUKH MAHARAJ TROPHY (1200 METRES) RUN ON THURSDAY, 15TH AUGUST, 2019 – TRAINER SHAZAAN SHAH HAD LODGED A COMPLAINT THAT HE WAS NOT SATISFIED WITH THE RIDING OF JOCKEY A.SANDESH :

Trainer Shazaan Shah and Jockey A.Sandesh were questioned on 21st  August, 2019 in the above connection.  Trainer Shazaan Shah said that SUPER MARIO was earlier in the charge of Trainer Faisal A.Abbas and thereafter moved to Trainer Mansoor Shah but he did not race under him and subsequently, the horse came to his charge. He said that App.K.Nazil who had ridden the horse last time when he was in charge of Trainer Faisal A.Abbas, had informed him that the horse lugs in, hence he had instructed Jockey A.Sandesh to take a good jump and sit in 2nd/3rd position along the rails and not to fight him and to do his best in the straight. To a specific question, he said that he had fancied the horse and the Jockey was of the owners’ choice.

The video recording of the race was viewed. Trainer Shazaan Shah said that even though the interference at the start may have had a bearing in the Jockey not being able to position, especially considering that despite the interference at the start he had gradually improved and come the shortest way which was in his favour, however, he took exception to the Jockey’s riding in the straight. In that, entering the straight, Jockey A.Sandesh was in 4th/5thposition and when a gap opened along the rails, he felt that the Jockey was a bit late in taking the gap and also used the whip once and then put his whip down and picked it up again only when he realized that he was collared by another horse on the outside and he was feeble in his riding effort.

The video recording of the previous run of SUPER MARIO i.e. Race No.232 run during the Mumbai Meeting 2018/19 was viewed.

Jockey A.Sandesh confirmed the instructions and added that he received interference soon after the start and thereafter he gradually improved his position and coming into the straight when a gap opened along the rails, he waited for a couple of strides for Jockey Dashrath Singh (ARABIAN STORM) to move out and then took the gap and did his best. He said that due to the interference at the start, he was unable to sit well up or else he may have won the race.

Having heard the submissions made, viewing the video recording of the race in question also the horse’s previous run i.e. Race No.232 run during the Mumbai Meeting 2018/19  and scrutinizing the betting sheets, the Stipendiary Stewards are not satisfied with the explanation tendered by Jockey A.Sandesh and are reporting him to the Stewards for riding an injudicious race.

The Stewards of the Club at their meeting held on 14th September, 2019 interviewed Trainer Shazaan Shah and Jockey A.Sandesh in the above connection and having heard them and having viewed the video recording of the race, the Stewards were not satisfied with the explanation tendered by Jockey A.Sandesh and held him guilty of riding an injudicious race on a fancied runner. In that, entering the straight he was in 4th/5th position and when a gap opened along the rails, he waited for a few strides and was a bit late in taking the gap. Further, it was felt that his riding effort in the straight was feeble as compared to his standard, in that, nobody expected him to use the whip more than he did, however, he could have used it in a more judicious manner and at a more appropriate time to get the best out of the horse  Trainer Shazaan Shah had also expressed his dissatisfaction with the riding. Therefore, the Stewards of the Club decided to suspend his Jockey’s licence w.e.f. 5th October, 2019 to 6th October, 2019 (both days inclusive) for riding an injudicious race (permitted to ride work/mock race).

RE : MATTER REFERRED TO THE STEWARDS OF THE CLUB BY THE BOARD OF APPEAL SEEKING CERTAIN CLARIFICATIONS – APPEAL AGAINST THE DECISION OF THE STEWARDS OF THE CLUB CONFIRMING THE DECISION OF THE STIPENDIARY STEWARDS SUSPENDING HIS JOCKEY’S LICENCE W.E.F. 31ST AUGUST, 2019 TO 1ST SEPTEMER, 2019 (BOTH DAYS INCLUSIVE) (PERMITTED TO RIDE WORK/MOCK RACE) FOR CARELESS RIDING ON HIS MOUNT “GODSWORD” IN RACE NO.33 – THE TRUE ELEGANCE PLATE (DIV.II) RUN ON 15TH AUGUST, 2019 – APP.P.S.KAVIRAJ :

The Stewards of the Club at their meeting held on Saturday, 14th September, 2019  considered all papers and proceedings before them in the above connection and having deliberated the matter decided to give fresh dates of suspension, i.e. App.P.S.Kaviraj’s  licence now stands suspended w.e.f. 5th October, 2019 to 6th October, 2019 (both days inclusive) (permitted to ride work/mock race) for careless riding on his mount GODSWORD in Race No.33 .

RE : ENQUIRY INTO THE COMPLAINT LODGED BY TRAINER NAZZAK B.CHENOY THAT JOCKEY P.TREVOR, RIDER OF “GOLDEN GUEST” HAD DELIBERATELY INTERFERED WITH HER HORSE “ADELE” SOON AFTER THE START IN RACE NO.14 – THE HAWKE BAY PLATE (DIV.I) RUN ON 26TH JULY, 2019 :

The Stewards of the Club at their meeting held on Saturday, 14th September, 2019 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards noted that Jockey Akshay (THOMAS HARDY) had accepted that his mount shifted in after the start despite his efforts and went on to ROYAL ACE.  Further, App.M.Ayyar (ADELE)  had also accepted that soon after the start his mount initially shifted out and at the same time GOLDEN GUEST (P.Trevor) shifted in and they made contact and that the incident was not intentional.

The Stewards of the Club having heard Trainer Nazzak B.Chenoy and her Spokesman, Mr.Bezan Chenoy and having viewed the video recording of the race decided to close the matter.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “MONK” (A.SANDESH – FAILED FAVOURITE) IN RACE N0.28 – THE NELSON RIVER PLATE (DIV.I) RUN ON SUNDAY, 11TH AUGUST, 2019 :

The Stipendiary Stewards reported that they had questioned Trainer Sanjay Kolse.  He stated that in Mumbai this horse came off the pace to finish 2nd hence he had instructed Jockey A.Sandesh to keep him covered and then pull him out in the straight and to do his best. He said that Jockey A.Sandesh informed him after the race that the horse was trying to veer out. He felt that the horse was still green and the ground did not suit him.

The video recording of the previous run of the horse i.e. Race No.237 run during the Mumbai Meeting 2018/19 was viewed. Trainer Sanjay Kolse said that since the horse has run erratic in both his races, he would give him some time before running him again.

Race No.28 was viewed. Trainer Sanjay Kolse said that in this race the horse was very keen so the Jockey sat in 2nd position and coming into the straight when  he asked for an effort at the 300 metres, the horse dropped out and thereafter was flat. He felt that the horse was still green and was hesitating.

Having heard the submissions made, viewing the video recording of the race in question as also the horse’s previous run i.e. Race No.237 run during the Mumbai Meeting 2018/19 and scrutinizing the betting sheets, the Stipendiary Stewards noted the explanation.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “BERNICE” (C.S.JODHA, – FAILED FAVOURITE) IN RACE N0.30 – THE MOOSA M.HOOSEIN TROPHY, RUN ON SUNDAY, 11TH AUGUST, 2019 :

The Stipendiary Stewards reported that they had questioned Trainer S.K.Sunderji and Jockey C.S.Jodha in the above connection.  Tr.S.K.Sunderji stated that he had instructed Jockey C.S.Jodha to sit in 4th/5th position, gradually improve and to do his best. Jockey C.S.Jodha confirmed the instructions.

The video recording of Race No.30 was viewed.

Trainer S.K.Sunderji said that he cannot say that this was a disappointing run as the filly was running after one year. He said that he was contemplating to run in a mock race but since she was only 6 kg up from last year and she was fit and had worked well, he decided to run her here. He added that she was fractions and reluctant to be loaded and was sweating and was a spent force at the start itself and subsequent examination at the Equine Hospital after the race revealed fracture of the sesamoid, hence he would be retiring her to the Stud.

Considering that the filly had returned with respiratory distress and was diagnosed to have returned sore and in view of the above statement of Trainer S.K.Sunderji the Stipendiary Stewards decided to close the enquiry.

RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “TIMELESS DEEDS” (DASHRATH SINGH) IN RACE NO.30 – THE MOOSA M.HOOSEIN TROPHY (1400 METRES) RUN ON 11TH AUGUST, 2019  WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUN IN RACE NO.7 – THE SEASON OPENER PLATE (APP.A.S.PETER) (1400 METRES) – RUN ON 25TH JULY, 2019 WHERE SHE WAS PLACED THIRD:

The Stipendiary Stewards reported that they had questioned Trainer Narendra Lagad in the above connection.  He said that in Race No.7 he had instructed App.A.S.Peter to sit in 3rd/4th position in touch with the leaders, to keep away from the horses and to do his best in the straight.

The video recording of Race No.7 was viewed. Trainer Narendra Lagad said that between the 1000 and 800 metres, App.A.S.Peter should have moved up but he kept sitting till the final turn, however, he felt that he would not have beaten the winner HELLS BELLS.

Thereafter the video recording of Race No.30 was viewed. Trainer Narendra Lagad said that in this race TIMELESS DEEDS was drawn-10 and after the start Jockey Dashrath Singh has pushed the horse to get his position and the pace has slowed down. He said that this mare likes to come from the outside and he had informed App.A.S.Peter of the same and the owner was upset with the riding, however, he felt that in Race No.7 the winner was better whereas in Race No.30 it was a weaker field.

Apprentice A.S.Peter confirmed the instructions and added that he received interference soon after the start hence he lost position. Thereafter, since there was an opening on the inside, he moved in. Trainer Narendra Lagad objected to the Apprentice’s statement and pointed out that it was indeed App.A.S.Peter who  had shifted in and bumped the other horse. He further added that despite this, App.A.S.Peter could have sat in a better position and he reiterated that from the 1000 metres till past the 800 metrs App.A.S.Peter had made no effort to improve his position and kept sitting thus leaving the mare too much to do in the straight.

Having heard the submissions made, viewing the video recording of both the races and scrutinizing the betting sheets, the Stipendiary Stewards were not satisfied with the explanation tendered by App.A.S.Peter and decided to suspend his Apprentice Jockey’s licence w.e.f. 5th October, 2019 to 6th October, 2019 (both days inclusive) for riding an incompetent race (permitted to ride work/mock race).

The Stipendiary Stewards reported that they had questioned Trainer Sanjay Kolse on 21st  August, 2019 in the above connection.  He stated that in Mumbai this horse went to the front, hence , in this race he had instructed Jockey A.Sandesh to take a good jump and be in 1st/2nd position, save the filly a bit up the hill and to do his best. He said that when the filly won in her last run in Mumbai, it was her fourth run hence she was mush fitter whereas in Race No.40 it was her first run during the current Pune Meeting and the Jockey sat up up as instructed but when he asked her for an effort, she went flat and he was disappointed with her run.

The video recording of Race No.40 was viewed.

Having heard the submissions made, viewing the video recording of the race and scrutinizing the betting sheets, the Stipendiary Stewards have noted the explanation.

The Stipendiary Stewards reported that they had questioned Trainer Narendra Lagad and Apprentice Aniket Karande in the above connection.  Apprentice Aniket Karande said that he was instructed to sit in 4th/5th position and to ride out in the straight. He said that he had done his best.

The video recording of Race No.40 was viewed.

Thereafter, the video recording of the winning ride of App.Aniket Karande on ABRAXAS in Race No.33 was viewed and it was pointed out that in this race App.Aniket Karande was definitely more vigorous in his riding effort.

Having heard the submissions made, viewing the video recording of the race in question as also the winning ride of App.Aniket Karande on ABRAXAS i.e. Race No.33 and scrutinizing the betting sheets, the explanation tendered by the Trainer and Jockey was noted.

RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “IN IT TO WIN IT” (A.SANDESH, DR.5) IN RACE NO.47 – THE RAJARAM CHHATRAPATI TROPHY (1800 METRES) RUN ON 24TH AUGUST, 2019  WHICH THE GELDING WON AS COMPARED TO HIS PREVIOUS RUN IN RACE NO.17 – THE J.E.HUGHES TROPHY (APP.D.R.SHUBHAM, DR.4) (1400 METRES) – RUN ON 3RD AUGUST,  2019 WHERE HE WAS UNPLACED:

The Stipendiary Stewards reported that they had questioned Trainer Adhirajsingh Jodha in the above connection.  It was pointed out to him that IN IT TO WIN IT had shown an improvement of over 15 lengths vis-à-vis the two common horses VALEGRO and ZENON in a matter of 21 days. Further, the horse was at long odds in Race No.17 whereas this time in Race No.47  he put up a good Jockey and he was in the betting.  Trainer Adhirajsingh Jodha said that in the previous race the horse ran after a long lay off and App.D.R.Shubham who rode him, did not have a whip and he now felt that the horse requires the whip. Further, the horse received multiple checks in that race and passing the 600 metres, he was along the rails which the horse does not like and if the Jockey had to pull him out at that stage, he would have had to come from the outside of MOMENTUM. He said that as far as the improvement vis-à-vis the common horses was concerned, VALEGRO was running for the first time over the distance of 1800 metres in a handicap race and the horse did not settle in the race and as for ZENON, he has beaten him in Mumbai in a mile race.

The video recording of both the races were viewed.

Having heard the submissions made, viewing the video recording of both the races and scrutinizing the betting sheets, the Stipendiary Stewards were not satisfied with the explanation tendered by Trainer Adhirajsingh Jodha. In that, although the horse raced after a gap of 21 days and the distance was 400 metres extra, however, in Race No.17 he was ridden by an apprentice and was at long odds and subsequently he was ridden by Jockey A.Sandesh and he won well fancied showing an improvement of over 15 lengths vis-à-vis the two common horses. Therefore, the Stipendiary Stewards decided to fine him a sum of Rs.10,000/-.

RE: ENQUIRY INTO THE RIDING OF “ABERLOUR” (APP.S.A.AMIT, DRAWN – 4) –  IN RACE N0.54 – THE DR.K.VASUDEVAN TROPHY (1400 METRES) RUN ON SUNDAY, 25TH AUGUST, 2019 :

Immediately after the race, Trainer Altamaash A.Ahmed had lodged a verbal complaint that he was not happy with the riding of App.S.A.Amit on ABERLOUR in this race.

Trainer Altamaash A.Ahmed and App.S.A.Amit were questioned on 29th August, 2019 in the above connection.  Trainer Altamaash A.Ahmed said that he had instructed the Jockey to sit in 5th/6th position, keep one horse off the rails considering the underfoot condition,  come into the straight and to do his best.

App.S.A.Amit confirmed the instructions and added that soon after the start THEA’S PET (App. P. S. Kaviraj, dr.7) shifted in and went across him causing him to check his mount and drop back.

The video recording of Race No.54 was viewed. Trainer Altamaash A.Ahmed said that considering that this was a 1400 metres race, after the interference the Jockey had ample opportunity to improve his position, instead he made no effort to do so and further dropped back and thereafter made his move far too late.

When asked to respond, App.S.A.Amit had no response to the above.

Having heard the submissions made, viewing the video recording of the race and scrutinizing the betting sheets, the Stipendiary Stewards were not satisfied with the explanation tendered by App.S.A.Amit and decided to suspend his Apprentice Jockey’s licence w.e.f. 5th October, 2019 to 6th October, 2019 for riding an injudicious race (permitted to ride work/mock race).

RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “SASSY LASS” (APP.A.S.PETER, DR.6) IN RACE NO.54 – THE DR.K.VASUDEVAN TROPHY (1400 METRES) RUN ON 25TH AUGUST, 2019  WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUN IN RACE NO.13 – THE ALLEY CAT PLATE (APP.NIRANJAN S.PARMAR, DR.6) (1200 METRES) – RUN ON 26TH JULY,  2019 WHERE SHE WAS UNPLACED:

The Stipendiary Stewards reported that they had questioned Trainer Asad Siddiqui in the above connection.  It was pointed out to him that in Race No.13 SASSY LASS was at long odds and in Race No.54 the mare won well fancied. Trainer Asad Siddiqui stated that he had given similar instructions in both the races i.e. to sit in 3rd/4th/5th position and to make the run from the outside since she has always won that way. He said that in the previous race, SASSY LASS ran in a higher class over 1200 metres in a much better field whereas this time she ran in a lower class over 1400 metres. Also, when she ran the previous time the going was different. As regards the betting, he said that in Race No.13 it was a tough set and  he had fancied the mare in Place and this time she won in a weaker set and the odds have also drifted to 5/1.

The video recording of both the races were viewed.

Having heard the submissions made, viewing the video recording of both the races and scrutinizing the betting sheets, the explanation tendered by Trainer Asad Siddiqui has been noted.
