RE : MERCY PETITION FROM TRAINER M.K.JADHAV :
The Board of Appeal at its meeting held on 4th February, 2016, considered Mercy Petition dated 22nd January, 2016 from Trainer M.K.Jadhav in the above connection.
The Board of Appeal considered the matter and having applied minds to the entire facts of the case and having heard Tr. M. K. Jadhav, was of the opinion that his Mercy Petition with regard to the penalty imposed on him for the positive findings of Venlafaxine in the horses under his charge lies with the Board of Appeal whereas penalty imposed on him for the positive finding of Flurbiprofen, which was not appealed against, did not lie with the Board of Appeal, therefore the matter was not under the realm of the Board of Appeal.
Since Trainer M. K. Jadhav had already undergone a suspension of beyond 60 days when the Board of Appeal considered his Mercy Petition, therefore, no action was called for in the matter.

RE : ENQUIRY INTO THE AWKWARD JUMP OUT OF “GOOD MEMORY” IN RACE NO.109 – THE BLUE RIBBON PLATE RUN ON 7TH JANUARY, 2016 :
Jockey S. Mosin was questioned in the above connection. He stated that his instructions were to take a good jump and sit 1st or 2nd. He said that the gelding took a fly jump and he could not control his mount. To a specific question, he stated that his reins were loose and he had not tried to hold the gelding in the gates.
The video recording from the starting gate cameras was viewed and it was pointed out to Jockey S. Mosin that it does appear that he was holding his reins tight just before jump out, which was primarily the reason for the horse taking an awkward jump. It was also pointed out to him that GOOD MEMORY subsequently won in his very next outing wherein he showed no signs of bad behavior at the gates and the Stipendiary Stewards were not satisfied with the explanation tendered by him. However, considering that the horse was at longer odds, the Stipendiary Stewards took a lenient view and decided to suspend his Jockey’s license for 2nd March, 2016 for incompetent handling of his mount (permitted to ride track work and mock race).

Nadeem that he had looked back twice and thereafter shifted in and caused the interference, to which he agreed to his mistake.
Not being satisfied with the explanation tendered by App. N. Nadeem, his Apprentice Jockey’s license has been suspended for 20th February 2016 for careless riding (permitted to ride work/mock race).

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “GOLD DREAM” IN RACE NO.131 – THE APRIL BLOSSOM PLATE RUN ON 14TH JANUARY, 2016 :
Trainer H. J. Antia and Jockey Amyn Merchant were questioned in the above connection. Trainer H. J. Antia stated that he had instructed the Jockey to sit in 6th or 7th position and to do his best in the straight. The Jockey confirmed the instructions. The video of the race was viewed and it was pointed out to Jockey Amyn Merchant that after turning for home, he was six horses off the fence and he could easily have made a run from the outside and that there was no need for him to shift in and find himself in a tightly packed field. Jockey Amyn Merchant said that he wanted to travel the shortest way home and therefore he shifted in. Jockey Amyn Merchant was informed that by shifting in at that stage he was not taking the shortest way home.
Not being satisfied with the explanation tendered by Jockey Amyn Merchant for his riding in the straight, which was supported by the Trainer who also felt that the Jockey could have been more vigorous, his Jockey’s license has been suspended for 2nd March, 2016 for not being vigorous in the straight (permitted to ride work/mock race).

Trainer Nirad Karanjawala stated that he had instructed Apprentice Yash Narredu to go to the front or sit second. App. Yash Narredu confirmed the instructions. The video of the race was viewed and it was pointed out to Apprentice Yash Narredu that he had not made an effort after the start to get into position as instructed. Apprentice Yash Narredu stated that though he was asked to jump and sit well up, the gelding, in its previous outing was too keen after the start and had bolted with the rider. Therefore, as a precautionary measure, he elected to jump out smartly and give the gelding a chance. However, since the initial pace was too fast he could not keep up with the field. He stated that he had not worked the gelding. Further, after the race he had informed the Stipendiary Stewards of his error in judgment.
After considering the submissions made and viewing the video of the race, the Stipendiary Stewards were not satisfied with the explanation tendered by App. Yash Narredu. Trainer M. Narredu and App. Yash Narredu were questioned in the above connection. Trainer M. Narredu stated that the gelding is very erratic during morning track work and therefore he asked the Apprentice to give the gelding a chance in the early part of the race and to do his best in the straight. He said that he had also asked Jockey Colm O’Donoghue to work the gelding in the morning and the gelding behaved in a similar manner and Jockey Colm O’Donoghue had advised him to change the Bit. However, even after changing the Bit, the gelding has yet run all over the place. He said that after the race in question, the gelding ran in the ARF Million where he again ran erratic. The Trainer went on to add that after the ARF Million he had the gelding scoped which revealed that he has a soft palate issue. Besides that, the gelding also has a kissing spine for which he intends to get him operated soon.
After going through the medical records of the gelding and taking into account that the gelding was at longer odds, the explanation tendered by Trainer M. Narredu was noted for future reference

To a specific question, Trainer Antia stated that the mare was a favorite due to her having placed third in her last two races. He added that the mare was only 5 lengths away from the winner in the race in question and she is a maiden till date and he has been doing his best with her. The explanation tendered by Tr. H. J. Trainer Arif Patel and Jockey Altaf Sayyed were shown the video of the race and on being questioned, Trainer Arif Patel stated that his instructions to the Jockey were to sit 4th/5th and to do his best. Jockey Altaf Sayyed confirmed the instructions. To a specific question, the Jockey stated that the mare was running erratic and when he used the whip from the left she shifted in and vice versa, as such, he could not ride her out. Trainer Arif Patel said that SEACAUCUS came to him from Tr. M. Narredu and this was her first run under his charge. Further, when the mare was under the charge of the previous trainer, she used to run with certain special equipments which he has removed as she was working well without the same.
After hearing the submissions made and watching the video of the race and keeping in mind the submissions of Jockey Altaf Sayyed that the mare was running erratic, no action was taken against the Trainer and Jockey for the running and riding of the horse. However, Trainer Arif Patel has been asked to take remedial measures and to show the mare to the satisfaction of the Stipendiary Stewards in a Mock Race before next accepting with her to race.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “SHINING MELODY” IN RACE NO.164-THE YALE UNIVERSITY TROPHY, RUN ON SATURDAY 30th JANUARY 2016.
Trainer S. K. Sunderji and Apprentice R. Ajinkya were shown the video of the race and thereafter on questioning, App. R. Ajinkya stated that he was instructed to go to the front or else to sit 2nd. Trainer S. K. Sunderji, while confirming the instructions, added that he had instructed the Apprentice to preferably go to the front, if necessary, to push the horse and go to the front. Tr.S. K. Sunderji added that he took exception to the riding of App. R. Ajinkya in the initial part of the race, wherein he has pushed the horse and then sat next to the front horse instead of going to the front.
Apprentice R. Ajinkya stated that soon after the start KOROL (App. G. Amit) had already taken over the running and when he pushed his horse and came alongside KOROL, App. G. Amit further made a forward move, therefore he decided to sit behind KOROL and not to fight him. However, as soon as he had settled his mount in the 2nd position, App. G. Amit slowed the pace down.
When questioned about his ridding effort in the straight, App. R. Ajinkya stated that he had worked the filly twice and in the first workout he had carried the whip and after the work out he had informed the trainer that the filly needs to be alerted to get going. He said that the race in question was a “no whip race” and coming into the straight the filly was not responding initially as she was all by herself. Thereafter, as soon as the other horses came on to her haunches, she started moving. Trainer S. K. Sunderji stated that he had planned to race the filly in this particular ‘No Whips Race”, hence he had worked her without the whip twice, both the times ridden by App. R. Ajinkya and he was satisfied with both her workouts without the whip.
After considering the submissions made and keeping in mind that the Trainer took exception to the Jockey’s riding as he had not followed his riding instructions and he could have been more vigorous in his ridding efforts in the straight, the Stipendiary were not satisfied with the explanation tendered Apprentice R. Ajinkya and decided to suspend his Apprentice Jockey’s license w.e.f. 20th February, 2016 to 21st February 2016 (both days inclusive) for riding an incompetent race (permitted to ride work/mock race).
