RACE DAY REPORTS

 

RAILS WERE PLACED 4 METRES  AWAY FROM ITS ORIGINAL POINT FROM 1400 METRES (MILE CHUTE) LEADING TO 6 METRES AWAY AT 1200 METRES, 8 METRES AWAY AT 1000 METRES, 10 METRES AWAY AT 800 METRES AND THEREAFTER 12 METRES AWAY UP TO THE WINNING POST.  FOR THE RACES RUN AT THE BACK STRETCH, RAILS WERE PLACED AT ITS ORIGINAL POINT FROM 1400 METRES LEADING TO 4 METRES AWAY AT 1200 METRES AND 8 METRES AWAY AT 1000 METRES.

 

On a request from Trainer M.Narredu, permission was granted to Trainer Deepesh Narredu  to saddle his charges SPEED AIR (6th race) and EXCELLENT SORRENTO (7th race), at his own (Trainer M.Narredu’s) risk and responsibility.

RACE NO.1(93) –THE PERCEIVED VALUE PLATE: (About) 1600 Metres – Runners - 10 

 

ETERNAL MEMORIES (Robbie Downey) jumped out slow losing about 4 lengths at the start. Trainer Imtiaz A.Sait has been asked to give the filly more gate practice and show her to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

ROSPOMARE (Neeraj Rawal) and DOUBLEDOWN (App.A.S.Peter) jumped out slow losing about 3 lengths each respectively.

 

At the start, SAFFRON FLOWER (S. S. Baria, dr.2) jumped out throwing its head up, thereby shifted in and made contact with GOLD MEDALIST (C. S. Jodha, dr.1).

 

On arrival at the start, the surcingle used on GOLD MEDALIST (C. S. Jodha) was observed to have been broken and the same was replaced with the Clubs equipment. After questioning, Jockey C. S. Jodha has been fined Rs.1,000/- for using unserviceable equipment.

 

RACE NO.2(94) – THE ONASSIS PLATE: (About) 1600 Metres – Runners - 6

 

Passing 300 metres, TILL END OF TIME (A. Sandesh) shifted out under urgings and carried TRULY EPIC (C.S.Jodha) outwards. Jockey A.Sandesh has been cautioned.

 

After the race, Jockey Neeraj Rawal (SASSY LASS) reported that his mount was inclined outwards soon after the start. Trainer Asad Siddiqui has been asked to take remedial measures before next accepting to race the mare.

 

After the race, TIMELESS DEEDS and SASSY LASS were trotted and found to be sound.

 

RACE NO.3(95) – THE BOURBON KING PLATE (DIV.II): (About) 1000 Metres – Runners - 11 

 

On arrival at the start, JIGAR (Amyn Merchant) and ZEEMO (App.K.Nazil) were examined by the Club’s Sr.V.O. who certified them fit to race.

 

App. K. Nazil (ZEEMO) was observed to have used the whip prior to the horse been loaded despite the Starter directing him not to do so. After questioning, App.K.Nazil has been fined Rs.2,000/- for the improper use of the whip.

 

Soon after the start, GOLDEN TOWER (App. Aniket Karande, dr.4) leaned inwards on to PADMAKOSA (App.P.S.Kaviraj, dr.3) and was steadied.

 

Soon after the start, ZEEMO (App. K. Nazil, dr.5) shifted out under urgings and went across CECELIA (App.Niranjan S. Parmar, dr.6), causing the latter to stumble. After questioning, App.K.Nazil has been cautioned.

 

Passing 400 metres, ZEEMO (App. K. Nazil) shifted in and made contact with OUTSTANDING (C. S. Jodha). On being questioned after the race, App. K. Nazil stated that his mount hung in despite his efforts. Trainer S. Waheed has been asked to take remedial measures before next accepting to race the mare.

 

Jockey Hanumant Singh (MANDRAKE ) has been fined Rs.500/- for failing to wear the racing goggles.

 

After the race, MANDRAKE and ZEEMO were trotted and found to be sound.

 

RACE NO.4(96) – THE  INDIAN AIR FORCE TROPHY: (About) 1000 Metres – Runners - 8 

 

At the start, BETWEEN THE WATERS (C. S. Jodha, dr.4) jumped inwards and made contact with TRIPLE THREAT (App.B. Nikhil, dr.3). Thereafter GOLD FIELD (App. D. R. Shubham, dr.5) shifted in due to which BETWEEN THE WATERS (C.S.Jodha) was tightened for room and dropped back.

 

Passing 250 metres, TRIPLE THREAT (B. Nikhil) was observed to have broken down and stopped galloping. The Sr.V.O. reported that TRIPLE THREAT broke her right fore fetlock.  The mare was euthanized on humane grounds after obtaining consent of the Trainer.

 

From the 200 metres JOPLIN (P.S.Chouhan) was observed to be inclined outwards. Trainer Nosher Cama has been asked to take remedial measures before next accepting to race the filly.

 

An objection was lodged by Jockey C.S.Jodha, the rider of BETWEEN THE WATERS (Placed Second) against JOPLIN (P.S.Chouhan, placed First). The reason being, on jump out TRIPLE THREAT (App.B.Nikhil) owned by the same owners, bumped him twice and took his ground with his horse’s head towards the left, obviously trying to give easy passage to JOPLIN by virtue of which he lost his position to almost last, had to cover 5 to 6 lengths coming on the outside which cost him a certain race.

 

After considering the submissions made by the Jockeys concerned in conjunction with that of the Stipendiary Stewards and relying on their judgment, the Stewards decided to over-rule the objection and forfeit the deposit.

 

After the race, PRINCESS P was trotted and found to be sound.

 

RACE NO.5(97) – THE  RAMNIWAS RAMNARAIN RUIA GOLD CUP (GR.3): (About) 2000 Metres – Runners- 5 

 

Jockey A. Sandesh (TASAWWUR) was observed to have used the whip in excess of the prescribed limit on his mount. This being his second offence during the current Mumbai Meeting 2018/19, he has been fined Rs.5,000/-.

 

After the race, Jockey Suraj Narredu (STAR SUPERIOR) reported that his mount hung out from the 1000 metres onwards. Trainer Rajesh Narredu has been asked to take remedial measures before next accepting to race his charge.

 

After the race, STAR SUPERIOR was trotted and found to be sound.

 

RACE NO.6(98) – THE ROCHESTER TROPHY: (About) 1200 Metres – Runners – 13

 

Soon after the start, BEEMER (Suraj Narredu dr.4) shifted out and carried DREAM (Amyn Merchant, dr.5) outwards, due to which MISSING YOU (Neeraj Rawal, dr. 6) was tightened for room and dropped back. After the race Jockey Suraj Narredu reported that his mount was running green.

 

Passing 900 metres, SILVER KING (Robbie Downey) shifted in thereby tightening PRINCIPESSA (Sunny Chenoy) who had to be checked. Jockey Robbie Downey has been cautioned.

 

Passing 500 metres, THAILAND  (P. Trevor) shifted out and at the same time BEEMER (Suraj Narredu) leaned inwards thereby inconveniencing MISSING YOU (Neeraj Rawal).

 

Passing 200 metres, SPEED AIR (Yash Narredu) shifted in on to MEMORABLE MEMORIES (S.Zervan) who had to be steadied. After the race, Jockey Yash Narredu  reported that his mount was lethargic in the early part of the race and also ran green.

 

An objection was lodged by Jockey Neeraj Rawal, the rider of MISSING YOU (Placed Second) against THAILAND (P.Trevor, placed First). The reason being, at the 500 metres he was on the outside of THAILAND who has moved out and changed course and came in front of him whereby  his mount clipped the heels of THAILAND and he checked his mount at a crucial stage of the race when he was about to make his running. Due to this, his filly lost her momentum and never picked up her stride, which cost him the race.

 

After considering the submissions made by the Jockeys concerned in conjunction with that of the Stipendiary Stewards and relying on their judgment, the Stewards decided to over-rule the objection.

 

RACE NO.7(99) – THE RM MANDAL TROPHY: (About) 1400 Metres – Runners - 9 

 

WILSHIRE (C.S.Jodha) jumped out slow losing about 2 lengths at the start.

 

At the start, STRONG STORM (P.Trevor, dr.5) who was drawn between JUNO’S GUEST (A. Sandesh, dr.6) and RED CARNATION (App. Aniket Karande, dr.4) was tightened.

 

After the race, HELLS BELLS was observed to have a cut injury at the left fore elbow. JUNO’S GUEST was found to be sound in the trot.

 

RACE NO.8(100) –THE BOURBON KING PLATE (DIV.I): (About) 1000 Metres – Runners - 11 

 

After being stalled, GOOD THING (Neeraj Rawal) started lashing out. The mare was taken out and examined by the Club’s Sr.V.O. who certified her fit to race. Trainer C.Rajendra has been asked to give the mare more gate practice and show her to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

At the start, TRUE GRIT (App. Parbat Singh, dr.6) jumped outwards on to ABRAXAS (App. Aniket Karande, dr.7).

 

Soon after the start, GOLDEN HORDE (App.Vishal N Bunde, dr.5) shifted in under urgings thereby tightening BRAVE (Dashrath Singh, dr.4), forcing the latter to be checked and drop back. App.Vishal N.Bunde has been cautioned.

 

Approaching 600 metres, due to a tightly packed field, BLITZKRIEG (App.Malam Singh) was tightened along the rails and dropped back thereby inconveniencing DYNAMITE (Amyn Merchant) and SILVER CAP (S.Zervan).

 

From the 400 metres, GOLDEN HORDE (App.Vishal N.Bunde) shifted out on to TRUE GRIT (App.Parbat Singh) and thereafter shifted in and went across GOOD THING (Neeraj Rawal). After questioning, App.Vishal N.Bunde has been cautioned.

The urine samples of the winner of the 1st, 3rd, 5th and 7th race, viz. WESTERN FRONT, ISINIT, STAR SUPERIOR  and LORRAINE,  as also that of  SACRED ROMAN (5th race), were collected for detection of prohibited substance.

RE : RACE NO.88 – THE  RHAPSIDION SNOW PLATE (DIV.I) RUN ON 10TH JANUARY, 2019: 

 

GRAND ARCHITECT was declared to run with a Dexter Ring Bit, however, the gelding raced with an Egg Butt Bit. Trainer Bezan Chenoy has been fined Rs.1,000/- for the lapse on his part.

RE : POSITIVE REPORT IN RESPECT OF  dk b f “LORRAINE” (WINNER) IN RACE NO.68 – THE WAR COMMAND PLATE (DIV.I) RUN ON SATURDAY, 25TH AUGUST, 2018 – IN THE CHARGE OF TRAINER MANSOOR SHAH :

 

The Stewards at their meeting held on Saturday, 8th December, 2018 and thereafter at their meeting held on Friday, 21st December, 2018 interviewed Trainer Mansoor Shah in the above connection.

 

The Stewards of the Club considered all the submissions made by Trainer Mansoor Shah. He was given the opportunity to bring in witnesses/cross question any person he wished, which he declined. The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings reports and records and also having permitted him to make submissions in the subject matter, were not satisfied with the explanation tendered by Trainer Mansoor Shah and he was informed that he will be issued a Show Cause to which he has to reply in writing and thereafter the Stewards of the Club would deliberate and decide on the matter.

 

The Stewards of the Club at their meeting held on 6th January, 2019 considered letter dated 29th December, 2019 in response to the Show Cause Notice dated 23rd December, 2018 issued to him and interviewed Trainer Mansoor Shah. The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings reports and records and also having permitted him to make submissions in the subject matter, found that Trainer Mansoor Shah had no mitigating circumstances to offer in the subject case and as such, held him vicariously responsible for the positive finding of Flunixin,  a Class-IV substance, in the urine sample of his horse LORRAINE (Winner) in Race No.68 – The War Command Plate (Div.I) run on 25th August, 2018. Therefore, as per the Medication Rules, the Stewards decided to fine him a sum of Rs.20,000/-.

 

 

1.         Further, in the course of enquiry into the positive report in respect of dk b f LORRAINE (Winner) in Race No.68 – The War Command Plate (Div.I) run on Saturday, 25th August, 2018, certain facts came to light, which revealed serious and material breaches of Trainer Mansoor Shah’s obligations as a trainer including the following :-

 

a)                   Contravention of the Calendar Notification Re : Maintenance of the Medical Log Books wherein he had admitted that he did not maintain a physical Medical Log Book. On searching for the same in his stable and asking his Jamadar about its whereabouts and not finding it, he looked for it in Trainer Shazaan Shah’s stable. Subsequently when it was not found there, he thought of searching for it in his house and finally many hours later Tr. Shazaan Shah appeared in the Sr. Stipendiary Steward, Mr. Niranjan Singh’s office with a computer printout which does not qualify as a log book and which was not acceptable since the Calendar Notification requires Trainers to maintain a physical log book which has to be filled in by the Trainer himself or his Assistant.  The fact that he did not know the whereabouts of his log books, showed gross negligence & mismanagement and no awareness at all of what is happening in his stable.

 

b)                   This was Trainer Mansoor Shah’s second offence of a similar nature, his earlier case being that of HIDDEN ASSET who was reported positive for PENTOZOCIN in Race No.177 run on 02/02/2014 where he had given similar explanation for not maintaining a physical log book that there is a challan book kept in the stable which had the details of all the treatment given to his horses and also he had brought up his health issues in a past enquiry. The then Stewards had suspended his Trainer’s license for a period of 30 days for the said offence, however, on an appeal filed by him and his assurance to the Board that in future he would maintain a physical log book, the Board of Appeal had modified his punishment by reducing the period of suspension to 7 days and imposing on him a fine of Rs.50,000/-. Despite the assurance given before the Board of Appeal, he had again showed blatant disregard to the Rules of Racing and Calendar Notifications and repeated the same offence within a period of five years.

 

c)                   During the course of the stable search after receipt of the positive report in respect of LORRAINE from the Primary Lab, QuantiLab, various feed supplements and additives were found lying in the stable which were stored in deplorable condition. Further, when asked to identify the feed supplements/additives, neither Trainer Mansoor Shah nor his staff could do so and relied upon tasting and smelling them, which showed gross negligence (breach of duty of care) and total lack of responsibility on his part. Also, neither he nor his stable staff were aware where his Log Books were kept and his Work Log Book was subsequently found in the yard of another Trainer i.e. Mr. Shazaan Shah which again showed total lack of responsibility on his part in the management of his stable and showed scant regard for the Rules and Regulations of the Club.

                               

d)                   Trainer Mansoor Shah also admitted in the Enquiry that due to health issues he was absent from the stable for a long period of time without informing this office or seeking prior permission for the same, thus contravening the Calendar Notification “Re : Trainers Leaving Centre” wherein Trainers are required to inform the office in writing details of their departure and the reason thereof and also the name of the person who would be responsible for looking after the horses in their absence.

 

The above acts and omissions amounted to gross negligence on the part of Trainer Mansoor Shah as a licensed trainer towards his horses, owners and the Club.

 

2.             In reply to the Show Cause Notice, Trainer Mansoor Shah did not deny the correctness of the facts set out in the Show Cause Notice,  but pleaded that he had a bad health condition and he was unable to comply with his duties as a Trainer. Trainer Mansoor Shah was granted a personal hearing thrice before the Stewards on 8th December, 2018, 21st December, 2018 and 6th January, 2019  when he again admitted that he had not been able to comply with his obligations and duties as trainer due to his health problems and the stress he was undergoing. He did not deny that he had failed to maintain the Medical Log Book as also that he had been unable to take proper care of the feed, supplements and additives lying in his stable (Instead of labeling and classifying, he and his staff were identifying substances by tasting and smelling them). He also admitted that he was frequently absent from his stable for long periods due to his health situation.

 

3.             Trainer Mansoor Shah’s attention was drawn that about four years ago, in another inquiry, he had admitted not maintaining the Medical Log Book, for which he had been suspended and fined.

 

4.                   Before the Stewards, Trainer Mansoor Shah failed to provide any coherent explanation for his habitual negligence and lack of duty of care. He was not even aware of the communications acknowledged by him from the Club, indicating that he was simply not aware as to what was happening in his stable. His son, an independent Trainer having his own stable, appears to be partially running his stable too.

 

5.             The Stewards examined Trainer Mansoor Shah’s disciplinary record since April, 2001.

 

6.             In one particular episode, sometime in 2004, during a surprise raid on Trainer Mansoor Shah’s stable, insulin syringes were found, both of which are not permitted in the stables as per the Rules,  which he tried to explain away by stating that he was severely diabetic and the insulin was for his own use.

 

7.             Recently, there was another episode wherein Trainer Mansoor Shah presented the wrong horse in Race No.132 – The K.Raghunath Plate run on 6th October, 2018 i.e. the horse declared to race was “TOBASCO” but the horse that he presented was identified as “SUZIE Q” (trained by his Son, Mr.Shazaan Shah), indicating gross negligence on his part and implying that his Son, Mr.Shazaan Shah was partially running his stable.

 

8.                   Having regard to the above facts and circumstances and after examining Trainer Mansoor Shah and considering his submissions, both oral and in writing, as also his track record, the Stewards unanimously concluded:-

(i)                   that Trainer Mansoor Shah has consistently and habitually been grossly negligent in discharge of his duties and obligations as a Trainer as is evident by failing to maintain Medical Log Book; not being aware of the highly unsatisfactory state of affairs in his stable, presenting the wrong horse, etc.;

 

(ii)                 Trainer Mansoor Shah, therefore, posed a serious risk to the life, safety and welfare of the horses under his charge as also to members of his staff including himself and third parties;

 

(iii)                having regard to Trainer Mansoor Shah’s admittedly serious medical condition and age, he was not fit and proper to handle race horses as the same poses a serious hazard to both animals and men under his charge and control. In addition, he had been suspended and fined for unfair racing practices and material breaches of the Rules of Racing. Despite being given several opportunities, he has repeated the same offences over and over again and refused to mend his ways;

 

(iv)                after detailed deliberations, and in the interest of fair racing as well as animal welfare as also the safety of his staff and third parties, including himself, he cannot be allowed to function as a Horse Trainer. Accordingly, in terms of Rule - 113 of the Rules of Racing, the Stewards decided to cancel Trainer Mansoor Shah’s license dated 22nd June, 2018 issued to him (which expires on 30th April, 2019) with immediate effect.

 

The Stewards have exercised the powers vested in them under Rule - 113 of the Rules of Racing to cancel Trainer Mansoor Shah’s license in the interest of all stakeholders in racing and in the public interest.
