RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “SHABDEEZ” IN RACE NO.47 – THE SECRET STAR PLATE RUN ON 1ST DECEMBER, 2011 AS COMPARED TO HER FOUR RUNS DURING THE PUNE MEETING 2011 ;

Trainer Asad Siddiqui to explain the improvement shown by SHABDEEZ in Race No.47 as compared to her four races in Pune all over 1000 metres in Class IV, wherein she had finished unplaced in three out of the four races.

Trainer Asad Siddiqui explained that SHABDEEZ was not a very sound mare, she has tendon problem and also has hoof problem which he had explained in an earlier enquiry pertaining to the same mare.  Therefore, he raced the mare sparingly in Pune, her first run being on 11th September, 2011 and he had given her many workouts before racing her. He said that he always preferred to race her in her own age group. He added that in one race the mare had finished fourth and in her last run at Pune she had met with interference. He said that he was one of the Trainer’s who shifted horses early to Mumbai and having spurted her once he came across this 1200 metres race for her own age group and decided to run her here, however, he did not fancy her and she was at longer odds. He added that SHABDEEZ was lucky to win this race since the favourite (MARINE ZONE) returned sore after the race and the other fancied runner (SEEN IT ALL) was withdrawn at the Gates.

Trainer Asad Siddiqui’s attention was drawn to the Calendar Notification regarding the use of bandages and he was asked to explain why he had used bandages in all her four races in Pune and discontinued the same in this race without obtaining prior permission. Trainer Asad Siddiqui admitted his error and went on to explain that the mare has tendon problem and she always raced with bandages, however, after coming to Mumbai, his Jamadar had a reaction of some medication he took when he was unwell and his face was swollen and there was nobody to tie the bandages, therefore he raced the mare without the bandages this time since he was not used to tying bandages himself and he was afraid the bandages may come off during the race.

Trainer Asad Siddiqui further pointed out that SHABDEEZ has won four races in her career, all in her own age group and all in Mumbai and possibly the mare goes well for the Mumbai Track. When asked as to why he raced the mare in Pune over 1000 metres, Tr.Asad Siddiqui said that whenever the mare was ready to race, he chose the best race available for her during that week and even claimed allowance once and he gave similar instructions to all his Jockeys i.e. to set well up and to do the best. He added that for her unplaced runs, the Handicap has not come down much (from 31 points to 27 points).

The matter is reported to the Stewards for such action as deemed fit.

The Stewards at their meeting held on Sunday, 11th December, 2011 considered the above report and having deliberated on the matter,  noted the explanation tendered by Trainer Asad Siddiqui with regard to the comparative performance of SHABDEEZ.

However, as directed by the Stewards, the Stipendiary Stewards fined Trainer Asad Siddqui a sum of Rs.3,000/- for contravention of the Calendar Notification regarding use of Bandages.

The Board of Appeal at its meeting held on 9th December, 2011 considered the Appeal preferred by Trainer Vinayak. The Board of Appeal at its meeting held on 9th December, 2011 having considered all the documents and papers that were submitted including his grounds of appeal and having heard him and his spokesman, Mr. Balam  Mohla, decided to reject his appeal and forfeit his deposit. Further the Board of Appeal felt that the punishment meted out by the Stewards of the Club appeared to be lenient considering the gravity of the offence and also the fact that the appellant was caught three times earlier for unauthorized use of mobile phone. Further he was reported to have been extremely rude and abusive towards the Club’s Officials. The Board of Appeal felt that the punishment meted out to him should be enhanced.

The Board therefore decided to issue a show cause to Mr.Rishi Didwania asking him to show cause as to why the punishment meted out to him should not be enhanced.

The Chairman of the Board of Appeal explained to him the abovementioned decision of the Board of Appeal in detail including the reasons for issuing a show cause to him and gave him time to come before the Board of Appeal with his submissions / response to the show cause. He was requested to withdraw. Mr. Rishi Didwania was ready with his response and he was recalled along with his spokesman and their submissions were heard by the Board of Appeal. The Board of Appeal having deliberated on the matter and having applied their minds decided to enhance the punishment and accordingly decided not to admit Mr.Rishi Didwania at the abovementioned places till 31st December, 2012.
