Trainer Bezan Chenoy has been fined Rs.1,000/- for using a Rubber ‘D’ Bit on his charge ACT OF WAR without declaring the same.

At the start, CLASSIC RULER (Ishwar Pardeshi) knuckled under.

ACT OF WAR (J.Fortune) has held up for a run near 250 metres.

Two objections were lodged in this race. The first objection was lodged by Jockey A.Ashhad Asbar, rider of GARARO (Placed Second), against Apprentice Prabhu Naidu (MON AMI, placed First). The reason being, right from 350 metres till the winning post, MON AMI constantly bumped and bored his horse whereby his horse continuously lost momentum and balance and in the last 25 metres App.Prabhu Naidu pulled his horse in twice thereby elbowing him due to which he could not use his whip and this had cost him a certain race, the verdict being a neck.

The second objection was lodged by Jockey Martin Dwyer, rider of EL CLASICO (Placed Third), against GARARO (A.Ashhad Asbar, Placed Second). The reason being, his horse was travelling very easy and GARARO came on to him and took his ground in the last 200 metres and gradually pushed him on to the rails whereby he was unbalanced and nearly fell off the horse and he was not able to ride out in the last 100 metres  or else he would have won the race.

The Stewards having considered the submissions made by the Jockeys concerned, in conjunction with that of the Stipendiary Stewards  and relying on their judgment, upheld the objection taken by the Second Placed horse viz. GARARO against the Winner, MON AMI. The Objection by the Third Placed horse viz. EL CLASICO against the Second Placed horse, GARARO, was not upheld as it was felt that the second placed horse  GARARO  passed on the interference caused by the original winner MON AMI. Therefore and arising out of a discussion, the original winner MON AMI was relegated to the Third Place. The Revised Order of placing is as under:-

GARARO                              -              FIRST;                                    MON AMI           -              THIRD;

EL CLASICO                         -              SECOND;                              SU O MOTO        -              FOURTH

The Stewards interviewed Apprentice Prabhu Naidu for careless and improper riding on his mount MON AMI and having heard him and viewing the video recording of the race, were not satisfied with the explanation tendered by him.

The Stewards noted that Apprentice Prabhu Naidu’s license already stands suspended in an earlier enquiry till the end of the Mumbai Meeting 2012/13 and thereafter if he applies for a license for Season 2013/14, it will be granted to him but his license will stand suspended till 15th November, 2013.

Therefore, for the present case of careless and improper riding on MON AMI,  the Stewards decided that should he apply for an Apprentice Jockey’s license for the Season 2013/14, it will be granted to him, however, his license will stand suspended for a further period covering six race days after 15th November, 2013 (permitted to ride work).

After the race, SOLI DEO GLORIA, CLASSIC RULER (examined on 11/02/2013) and JEN’S GLORY (examined on 11/02/2013) were found to be found.  CLASSIC RULER had a cut injury at the left fore coronet and NATIONAL PRIDE had a cut injury at the left hind cannon. ARMEL had lost its right hind plate.

RACE NO.9(192) –THE  FOUR SEASONS HOTEL MUMBAI SALVER: (About) 1600 Metres – Runners - 12

Jockey S.John (CHICHARITO) has been fined Rs.5,000/- for using an unapproved Safety Vest.

At the start, DELGADO (Malcolm Kharadi) jumped out awkwardly.

FAIRY EMPRESS (Nirmal Jodha) did not get a clear run between 400 metres and 300 metres.

The Sr.V.O. reported that after the race CHICHARITO was observed to be stiff. The gelding was taken to the saddling enclosure and was administered First Aid treatment and thereafter sent to the stables.

After the race, BRUNELLO and SCHWARTZ were found to be sound.

RE :  REQUEST TO REVIEW THE PUNISHMENT METED OUT TO HIM I.E. DEPRIVING HIM THE USE OF THE WHIP IN RACES WITH IMMEDITE EFFECT TILL THE END OF THE MUMBAI MEETING 2012/13 FOR USING THE WHIP IN EXCESSIVE OF THE PRESCRIBED LIMIT ON HIS MOUNT “PAPAKURA” IN RACE NO.178 RUN ON 03/02/2013 – JOCKEY P.TREVOR :

The Stewards of the Club at their meeting held on Sunday, 10th February, 2013 considered letter dated 4th February, 2013 from Jockey P.Trevor for review of his punishment on PAPAKURA and interviewed him as also Trainer S.S.Shah.

Trainer S.S.Shah brought to the notice of the Stewards that PAPAKURA had returned with a gum injury after the race and on examination by the Vet, the gelding  was found to have a loose molar cap which was subsequently extracted and it was possibly due to this reason that the horse may have hung during the race and Apprentice P.Trevor had used the whip as a corrective measure.

The Stewards reviewed the matter and in view of the fresh evidence, decided to give Apprentice P.Trevor the benefit of the doubt in this case and rescinded the punishment imposed on him on 03/02/2013. However, he was warned to be more careful in the future.

ENQUIRY INTO THE RIDING OF APPRENTICE TUSHAR NEMANE ON “CELSIUS” IN RACE NO.10 – THE GRAND PASSION PLATE (DIV.II) (1000 METRES) RUN ON 22ND NOVEMBER, 2012 – THIS RACE WAS DECLARED NULL AND VOID BY THE STEWARDS.

The Stewards of the Club at their meeting held on Wednesday, 6th February, 2013 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The  Stewards interviewed Apprentice Tushar Nemane/his Master, Trainer P.Shroff, Apprentice Prabhu Naidu/his Master, Trainer Altaf Hussain, Mr.Ravi Sahney and Mr.Amar Sahney.

1.    The Stewards considered that Apprentice Tushar Nemane had confessed before the Stipendiary Stewards and also in the presence of Mr.Ravi Sahney and Mr.Amar Sahney that he had not allowed his mount CELSIUS to run on its merits in Race No.10 – The Grand Passion Plate (Div.II) run on Thursday, 22nd November, 2012 at the behest of Mr.Ravi Sahney/Mr.Amar Sahney  and that he stood by his statement before the Stewards.

After considering all the proceedings in the enquiry and the written and oral submissions made in the matter, the Stewards accepted the confession made by App.Tushar Nemane and held him guilty of not allowing his mount CELSIUS to run on its merits in Race No.10, and as a consequence was guilty of dishonest, corrupt, fraudulent and improper practice and dishonorable action in connection with racing.

However, keeping in mind that Apprentice Tushar Nemane had turned an approver, the Stewards took a lenient view in the matter and decided :-

a)            that  the suspension of his Apprentice Jockey’s license that was imposed on him pending enquiry, shall continue till the end of the Mumbai Meeting 2012/13. Thereafter, should he apply for an Apprentice Jockey’s license for the Season 2013/14, it will be granted to him, however, his license will stand suspended up to and including 15th November, 2013 (permitted to ride work).

b)     To impose on him a suspended sentence of two years i.e.  if he was again found guilty of a similar offence within the next three years starting from 16/11/2013, this suspended sentence of two years would immediately come into force in addition to whatever further action the Stewards may take against him at that time.

2.    The Stewards inter-alia also considered that Apprentice Tushar Nemane had approached Apprentice Prabhu Naidu to introduce him to his contacts and Apprentice Prabhu Naidu introduced Apprentice Tushar Nemane to Mr.Amar Sahney, hence he was a co-conspirator. Therefore, under the Rules of Racing of this Club, held Apprentice Prabhu Naidu guilty of  dishonest, corrupt, fraudulent and improper practice and dishonorable  action in connection with racing.

The Stewards considered Apprentice Prabhu Naidu’s past record.

Taking an overall view, the stewards decided :-

a)     To suspend Mr.Prabhu Naidu’s Apprentice Jockey’s license w.e.f. 21st February, 2013 till the end of the Mumbai Meeting 2012/13. Thereafter, should he apply for an Apprentice Jockey’s license for the Season 2013/14, it will be granted to him, however, his license will stand suspended up to and including 15th November, 2013 (permitted to ride work).

b)     To impose on him a suspended sentence of one year i.e.  if he was again found guilty of a similar offence within the next three years starting from 16/11/2013, this suspended sentence of one year would immediately come into force in addition to whatever further action the Stewards may take against him at that time.

3.     The Stewards were not satisfied with the explanation tendered by Mr.Ravi Sahney. The Stewards accepted the confession made by Jockey Tushar Nemane that he had not allowed his mount CELSIUS to run on its merits in RaceNo.10 at the behest of Mr.Ravi Sahney and under the Rules of Racing of this Club held him guilty of  dishonest, corrupt, fraudulent and improper practice and dishonorable  action in connection with racing.

The Stewards noted that Mr.Ravi Sahney is a Club Member of the R.W.I.T.C., Ltd, therefore, as per the Rules, the Stewards decided to refer his case to the Committee of the Club for such action as they may deem fit.

4.     The Stewards were not satisfied with the explanation tendered by Mr.Amar Sahney. The Stewards noted that it was Mr.Amar Sahney who had asked Apprentice Tushar Nemane to contact Mr.Ravi Sahney, therefore, under the Rules of Racing of this Club held him of  dishonest, corrupt, fraudulent and improper practice and dishonorable  action in connection with racing.

Taking an overall view and after having deliberated  the matter at length, the Stewards decided to exclude him off the premises of the Racecourses at Mumbai/Pune and all other places where the Rules of Racing of the Club are in force, w.e.f. 7th February, 2013 to 6th February, 2018.

ENQUIRY INTO THE RUNNING AND RIDING OF “HEAVENLY PRIZE” IN RACE NO.10 – THE GRAND PASSION PLATE (DIV.II) (1000 METRES) RUN ON 22ND NOVEMBER, 2012 – THIS RACE WAS DECLARED NULL AND VOID BY THE STEWARDS.  AFTER THE RACE TRAINER SUNDERJI HAD COMPLAINED THAT HE WAS NOT SATISFIED WITH THE RIDING OF JOCKEY M.A.ROUSHAN ON “HEAVENLY PRIZE” :

The Stipendiary Stewards reported that they had questioned Trainer S.K.Sunderji and Jockey M.A.Roushan in the above connection. Trainer Sunderji said that he had instructed the Jockey to hit the front and if some other horse is going too fast, then not to fight for the lead but sit in second position and to do his best.  He said that the Jockey had ridden contrary to his instructions and he was not satisfied with his riding.

Jockey M.A.Roushan confirmed the instructions. When asked as to why he had not followed the instructions, Jockey Roushan said that he had seen the previous winning race of this horse where the Jockey had settled him in second position and hence he too had made up his mind to ride like wise and he tried to settle him in this race. Jockey Roushan was informed that since he was given specific instructions in this race, it was his duty to ride as instructed and not use his discretion, to which he had no explanation.

The video recording of the race was viewed and it was pointed out to Jockey M.A.Roushan that the horse was very keen after the start and he had all the opportunity to hit the front as instructed and sit along the rails but for no apparent reason he kept fighting with the horse and holding him back in 2nd/3rd position. Further, on entering the straight, instead of making his move, he continued to hold the horse and kept waiting for no apparent reason and made his move when it was too late. Jockey M.A.Roushan admitted that it was his mistake that he had tried to settle the horse in the early part but there was no mala-fide intent. He said that on entering the straight, he started improving his horse gradually and just when he was about to make his move, the horse on the inside took him out. Jockey M.A.Roushan was told that had he hit the front as instructed or made his move at the top of the straight, he would have had a clear run without any interference, but he had ridden totally contrary to the Trainer’s instructions.

When asked for his observation of the race, Trainer S.K.Sunderji said that after the start the horse was very keen and fighting for his head and the Jockey had all the chance to hit the front as instructed but he unnecessarily held him back. Also, the Jockey is aware that this horse has a soft mouth and he took grave exception to the Jockey’s riding even at the back stretch when he kept yanking at the horse and thus disappointing him whereby the horse was not able to perform well. He reiterated that he was not satisfied with the Jockey’s riding.

The Stewards at their meeting held on Sunday, 10th February, 2013 interviewed Trainer S.K.Sunderji and Jockey M.A.Roushan in the above connection and having heard them and having viewed the video recording of the race, were not satisfied with the explanation tendered by Jockey M.A.Roushan and held him guilty of unsatisfactory riding and decided to suspend his Jockey’s license w.e.f. 27th February, 2013 to 13th April, 2013 (both days inclusive) (permitted to ride work/mock race).
