ADDITIONAL REPORTS:
RE: ENQUIRY INTO THE RIDING OF JOCKEY N.S.PARMAR ON “ARMAITY” IN RACE NO.33 – THE KHEEM SINGH GOLD CUP - RUN ON SUNDAY, 15th DECEMBER, 2019 :
Trainer P. Shroff and Jockey N. S. Parmar were questioned in the above connection. Trainer P. Shroff said that ARMAITY is a small filly and likes to be along the rails and he had instructed Jockey N. S. Parmar that STAR COMRADE (App. A. Prakash, dr.5) and KHARTOUM (App. H. Zeeshn, dr.3) being fast horses will go to the front and he should sit behind them in 3rd/4th position along the rails and do his best. Jockey N. S. Parmar confirmed the instructions.
The video recording of Race No.33 was viewed and when asked for his observation, Trainer P. Shroff felt that since this was a slow run race Jockey N. S. Parmar should have used his judgement and followed the winner, STAR COMRADE instead of sitting in 3rd/4th position and he had informed the Jockey accordingly after the race.
Jockey N. S. Parmar said that ARMAITY is a difficult filly to handle, sometimes she hangs in and sometimes hangs out. He said that in the race in question, he wanted to follow the second horse, KHARTOUM in the straight, however, that horse started dropping back and hence he decided to make his move from the outside which, on hindsight, he felt was a mistake. Jockey N. S. Parmar was told that by changing course in the straight he had lost valuable ground which had possibly cost him the race, the verdict being ¾ length.
When asked as to why he did not make an attempt to sit second on the inside of KHARTOUM, Jockey N. S. Parmar said that if there is a horse on the outside, the filly hangs in and hence he preferred to sit behind KHARTOUM and not on his inside.
The winning race of ARMAITY i.e. Race No.107 run during the Pune Meeting 2019 was viewed and it was pointed out to Jockey N. S. Parmar that in this race run over 1200 metres where the pace was fast, he was able to sit well up, hence he could have easily sat behind STAR COMRADE in Race No.33 which he failed to do.
Trainer P. Shroff reiterated that conceding that ARMAITY is a difficult filly to ride and she does have the habit of hanging, however, in the race in question the Jockey should have realized that the pace is slow and the front horse is not going to stop, there is a good chance that he may gallop on and the mistake he committed was not following that horse.
Having heard the submissions made, viewing the video recording of the race in question as also the filly’s winning race i.e. Race No.107 run during the Pune Meeting 2019 and scrutinizing the betting sheets, the Stipendiary Stewards were not satisfied with the explanation tendered by Jockey N. S. Parmar and decided to suspend his Jockey’s licence for 2 Race Days i.e. from 1st February, 2020 to 2nd February, 2020 (both days inclusive) for riding an incompetent race. In that, he should have realized that the pace was slow and sat behind STAR COMRADE. Further, by changing course in the straight he had lost valuable ground which possibly cost him the race, the verdict being ¾ length.
Vide his letter dated 7th January, 2020 Jockey N. S. Parmar informed this office that he did not wish to appeal against the above decision of the Stipendiary Stewards and would like his punishment to start earlier.
In view of the above, the suspension of his Jockey’s license will now be from 18th January, 2020 to 24th January, 2020 (both days inclusive) for riding an incompetent race on ARMAITY (permitted to ride work/mock race).

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “PRINCESS SCARLET” IN RACE NO.57 – THE BANGALORE TURF CLUB LTD. TROPHY - RUN ON FRIDAY, 27th DECEMBER, 2019 :
Trainer Vinesh and Jockey Nirmal Jodha were questioned in the above connection. Trainer Vinesh said that he had instructed the Jockey to take a good jump and settle the filly in good 5th/6th position and to do his best. He added that the filly was slow to begin, however, the Jockey has ridden the horse out and he was satisfied with the riding.
Jockey Nirmal Jodha confirmed the instructions and added that the filly was slow to begin, however, thereafter he kept niggling the filly and he had done his best. He added that the filly was a bit hesitant.
The video recording of Race No.57 was viewed and it was pointed out to the Trainer and Jockey that whilst the filly was marginally slow, however, the Jockey could have made an effort to sit in a better position, which he failed to do. Further, it was also pointed out that his effort in the straight was found wanting, especially in the manner in which he had changed course frequently for no apparent reason and also he could have been more vigorous in his finish.
When asked for the future plans for this horse, Trainer Vinesh initially stated that he had no particular plans for the filly, however, subsequently he stated that he may be running the filly on the Derby Weekend in a 6 or 7 furlong race.
Having heard the submissions made and viewing the video recording of the race, the Stipendiary Stewards were not satisfied with the explanation tendered by Jockey Nirmal Jodha and decided to suspend his Jockey’s licence for 2 race days i.e. from 1st February, 2020 to 2nd February, 2020 (both days inclusive) (permitted to ride work/mock race) for indifferent riding. Further, the Stipendiary Stewards were also not satisfied with the explanation tendered by Trainer Vinesh and held the view that the Jockey would not have ridden in this manner unless he had the Trainer’s tacit approval, therefore, they decided to fine him a sum of Rs.10,000/-.

RE: ENQUIRY INTO THE LOSS OF WHIP AS ALSO THE FALL OF JOCKEY AKSHAY GAIKWAD ON “ANGELS HARMONY” IN RACE NO.17 – THE BEJAN BHARUCHA PLATE (DIV.I) RUN AT PUNE ON 24th NOVEMBER, 2019:
The Stipendiary Stewards reported that they had questioned Trainer Altaf Hussain and Jockey Akshay Gaikwad in the above question. Trainer Altaf Hussain said that he had instructed the Jockey to take a good jump and sit in 3rd/4th position but if he finds himself further up also he has no problem, and from the bend to ride out and do his best.
It was noted that the odds offered on ANGELS HARMONY were 15/4 and there were two other horse in the betting viz. SANDALPHON at 7/2 and GLORIANA at 13/4.
Jockey Akshay Gaikwad confirmed the instructions and added that he jumped out well and sat in 2nd position and in the straight when he picked up his whip, it slipped out from his hand. Thereafter, under pressure he kept riding out hands and heels and did not realize that his horse was shifting out and then bumped ETERNAL DANCER due to which he was unbalanced and fell.
The video recording of Race No.17 was viewed (all angles). To a specific question, Jockey Akshay Gaikwad said that whilst his mount was shifting out, at the same time ETERNAL DANCER (Kishore Kadam) also shifted in and they bumped each other due to which he had lost his balance and fell.
In view of the loss of whip and the Jockey’s subsequent fall on a fancied runner (which he rarely ever gets to ride), Jockey Akshay Gaikwad was asked to submit his Mobile Phone call records which he has failed to do, made this case very suspicious.
The matter was reported to the Stewards for such action as they deem fit.
The Stewards of the Club at their meeting held on Thursday, 9th January, 2020 interviewed Jockey Akshay Gaikwad and his Spokesman, Mr. P. Trevor, in the above connection and having heard him/his Spokesman and having viewed the video recording of the race as also the blow up of the incident of whip fall and the incident of his fall from the horse, were not satisfied with the explanation tendered by him and decided to initiate action against him.
However, before taking a decision in the matter, the Stewards decided to give him one final opportunity to come out with the truth and help in the enquiry and therefore, the Stewards decided to adjourn this hearing to a future date.
Accordingly, Jockey Akshay Gaikwad has been intimated to Show Cause in writing latest by 19th January, 2020 as to why necessary/appropriate action should not be taken against him by the Stewards of the Club in connection with the captioned matter and also to appear before the Stewards of the Club on the date and time which will be intimated to him. Further, he was asked to submit to this office his Mobile Phone call records for the month of November, 2019.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “TAIMUR” (COLM O’DONOGHUE2) IN RACE NO.50 – THE FAIZ JASDANWALLA TROPHY(1200 METRES) RUN ON 22nd DECEMBER, 2019:
The Stipendiary Stewards reported that Trainer Karthik Ganapathy and Jockey Colm O’Donoghue were questioned in the above connection. Trainer Karthik Ganapathy stated that TAIMUR doesn’t have early speed, as such, he had instructed the Jockey to let him come into stride and ride his race and not get him off the bridle if the others are going at a cracking pace. He said that the horse was slowly off just like he did in his previous start.
Jockey Colm O’Donoghue confirmed the instructions and added that he had worked the horse prior to the race.
The video recording of Race No.50 was viewed and when asked for his observation, Trainer Karthik Ganapathy said that after the race he had asked the Jockey what he felt about the horse and the Jockey informed him that in work, when he asked the horse, he comes on to the bit immediately but the same did not happen in the race and he also felt that the horse was a little off because of which the Jockey had not gone flat out on him. He added that the horse was examined the next morning and found to have shins. He said that after the previous race, Jockey Colm O’Donoghue had informed him that 6 furlongs is a little sharp for the horse and 7 furlongs will be better suited, however, he had persisted to race him over 6 furlongs in view of a 6 furlongs multi-million coming up in Hyderabad, which the colt will now be missing due to the shins.
It was pointed out to Jockey Colm O’Donoghue that his riding efforts were lacking in the straight, to which he responded that he never goes hard on babies.
Having heard the submissions and viewing the video recording of the race in question as also its previous start, the Stipendiary Stewards felt that even in the first race the Jockey was soft on the horse, however, since it was the first run of the horse, no action was initiated.
In the race in question, the Stipendiary Stewards felt that the Jockey has come wide for no apparent reason thereby losing valuable ground on a fancied runner due to which he failed to come on board and do not accept his statement that he is not hard on babies. Keeping all circumstances in mind, Jockey Colm O’Donoghue was reported to the Stewards for having ridden an indifferent race on TAIMUR.
The Sr. V.O. had reported that the horse had returned sound after the race. However, at the request of Trainer Karthik Ganapathy the horse was examined again the next morning by the Club’s V.O. Dr. Yashpal Paithanpagae, who having examined the horse, reported that the horse felt “pain on palpation of the shin, left fore” .
The Stewards of the Club at their meeting held on Thursday, 9th January, 2020 interviewed Trainer Karthik Ganapathy and Jockey Colm O’Donoghue in the above connection and having heard the submissions and having viewed the video of Race No.50 (all angles – in normal as well as slow motion), the Stewards were not satisfied with the explanation tendered by Jockey Colm O’Donoghue and held him guilty of riding an indifferent race. In that, he made no effort to improve his position in the early part of the race. Thereafter he came wide round the final bend for no apparent reason and passing the 400 metres he again changed course and went in thus losing valuable ground on a fancied runner and his riding efforts were lacking in the straight. Therefore, the Stewards decided to fine him a sum of Rs.20,000/- for indifferent riding on TAIMUR. Further, he was severely cautioned for improper behavior.

RE : RACE NO.64 – THE MAHARAJA JIWAJIRAO SCINDIA TROPHY (GR.2) RUN ON SUNDAY, 29th DECEMBER, 2019 - JOCKEY P. S. CHOUHAN, RIDER OF “BRONX” FOUND TO CARRY A WHIP OF AN UNAPPROVED PATTERN:
The Stipendiary Stewards reported that during a random check in the paddock prior to Race No.64 – The Maharaja Jiwajirao Scindia Trophy (Gr.2) run on Sunday, 29th December, 2019, it was found that Jockey P. S. Chouhan, the rider of BRONX, was carrying a whip of an unapproved pattern. The same was immediately confiscated and Jockey P. S. Chouhan was permitted to carry a shock absorbing whip of an approved pattern.
On being questioned immediately after the race, Jockey P. S. Chouhan said that he keeps all his equipment and riding gear in the locker provided in the Jockeys Room and he has a bunch of whips in the said locker and just before the race he had picked up a whip without realizing that it was of an unapproved pattern.
Subsequently, on being questioned again on 3rd January, 2020 Jockey P. S. Chouhan said that he was well versed with the Rules regarding the use of whip and he accepted his mistake.
Though Jockey P. S. Chouhan may not have used the whip of an unapproved pattern in Race No.64 (because he was stopped by the Sr. Stipendiary Steward), however, his very act of carrying the said whip showed his intent to use the same in the race in question.
The Notice in the Racing Calendar regarding the use of whip states “Only shock absorbing whip as approved by the Stewards shall be used by Jockeys in races and during track work”
In light of the above Calendar Notification, whilst a whip of an unapproved nature is not supposed to be used during races or morning track work, the very fact of Jockey P. S. Chouhan carrying such a whip is a transgression of the Rules regarding the use of whip. Jockey P. S. Chouhan was therefore reported to the Stewards for such action as they may deem fit under Rule 202 (x) (b) which reads as under:
202 “The Stewards of the Meeting shall be entitled to suspend Licenses and the Stewards of the Club shall be entitled to suspend and / or withdraw Licenses for any reason (s) of any of the persons mentioned hereinafter, and further the Stewards of the Meeting and / or Stewards of the Club shall fine and / or punish and / or warn off and / or exclude and / or eject and / or disqualify, for ay reason or reasons, from any race course or place where these Rules are in force, any of the following persons viz.
(x) (b) Any person who uses or had in his possession, any electric or electronic apparatus or any improper contrivance capable of affecting the performance of a horse in a race or training gallop”
Therefore, under the circumstances, keeping in mind his past record and not allowing his mount to run on its merits and also his reluctance to share evidence which may have benefitted him, the Stipendiary Stewards did not feel this is an error as claimed by him as there is no reason for him to have in his possession a bundle of whips. Furthermore, it was pointed out that
a) the horse that he was riding was a joint favourite and he has been found guilty of having contravened the above mentioned rules;
b) these whips were banned in 2002;
c) he has procured this whip after 2002;
d) he has taken this whip into the Weighing Room as recently as last month,
The above clearly proves this is no error of a whip lying in the Jockeys Room Box.
The Stewards of the Club at their meeting held on Thursday, 9th January, 2020 interviewed Jockey P. S. Chouhan in the above connection and having heard him and his Witness, Mr. P. Trevor as also the Stipendiary Stewards, were not satisfied with the explanation tendered by him. In that :-
1) The Stewards noted that as per the Calendar Notification under the heading “Use of Whips” - the Jockeys were permitted to use only Shock Absorbing Whips and also that Jockey P. S. Chouhan admitted before the Stewards that he was aware of the above Rules;
2) By his own admission, he had procured these whips 4 to 5 years ago without having obtained prior permission from the Stipendiary Stewards and furthermore he had also sold/given these whips to few of his colleagues;
3) He has taken this whip into the Jockeys Room as recently as last month;
4) The Stewards did not accept his explanation that this was just an error on his part of picking up the wrong whip lying in the locker provided to him in the Jockeys Room.
5) Although he may not have used the whip of an unapproved pattern in Race No.64, however, his very act of carrying the said whip in the paddock showed his intent to use the same in the race in question.
In view of the above, the Stewards held Jockey P. S. Chouhan guilty of having contravened the Calendar Notification and the Rules of Racing in this regard and decided as under :-
a) to suspend his Jockey’s licence for 6 Race Days i.e. from 24th January, 2020 to 16th February, 2020 (both days inclusive) (permitted to ride work/mock race);
b) to fine him a sum of Rs.20,000/-.
