RE : RACE NO.135 – THE SIMPLY SUPREME TROPHY (DIV.II) RUN ON SUNDAY, 11TH SEPTEMBER, 2011 – JOCKEY C.RAJENDRA, RIDER OF “HOME ALONE” – REPORTED TO THE STEWARDS FOR USING THE WHIP IN EXCESS OF THE PRESCRIBED LIMIT ON HIS MOUNT :
The Stewards of the Club at their meeting held on Saturday, 8th October, 2011 interviewed Jockey C.Rajendra in the above connection and having heard the submission made by him and viewing the blow up picture of the use of the whip, accepted the Jockey’s contention that the last whip had not touched the horse and being a borderline case, decided to give him the benefit of the doubt.
RE: ENQUIRY IN TO THE RUNNING AND RIDING OF “MOUNTAIN RULER” IN RACE NO 95 RUN ON SUNDAY 28TH AUGUST 2011 – TRAINER CD KATRAK AND JOCKEY R SHELAR
The Stipendiary Stewards reported that they had questioned Trainer C.D.Katrak and Jockey R.Shelar in the above connection. Trainer Katrak stated that he had instructed the jockey to try to get into a good position and to do his best in the straight. He added that he had also told the Jockey to use the whip in case he was in the fighting line otherwise to only give a couple of cracks and to ride out. Jockey R.Shelar confirmed the instructions and stated that right from the jump out the horse did not respond to his urgings and he could not get into a striking position. He added that the horse has a high action and a dipped back and showed keenness when it was held but hesitated to overtake other horses in the races and he had informed this to the Trainer after the race. Trainer Katrak confirmed that Jockey Shelar had informed him regarding the behavior of the horse and had suggested to use Blinkers and to run him over longer distance and subsequently he had worked the horse with Blinkers and entered in after 28 days in Race No.157 over a mile where the horse came out and won. Trainer Katrak opined that the blinkers and the longer distance had suited the horse.
The explanation tendered by the Trainer and Jockey was noted.
RE : ENQUIRY INTO THE RUNNING AND RIDING OF “STAR BUILDER” IN RACE NO.129 – THE GLENSANDA PLATE RUN ON SATURDAY, 10TH SEPTEMBER, 2011 :
The Stewards of the Club at their meeting held on Saturday, 8th October, 2011 considered the evidence obtained by the Stipendiary Stewards in the above enquiry. The Stewards interviewed Trainer H.J.Antia and Jockey Sunny Chinoy and having heard the submission made by them and viewing the video recording of the race, were not satisfied with the explanation tendered by Jockey Sunny Chinoy and held him guilty of unsatisfactory riding on his mount STAR BUILDER in the above race. Trainer H.J.Antia also agreed that Jockey Sunny Chinoy was feeble in his riding efforts in the straight.
Taking an overall view the Stewards decided to suspend Sunny Chinoy’s Jockey’s license w.e.f. 13th November, 2011 to 24th November, 2011 (both days inclusive) for unsatisfactory riding on his mount (permitted to ride work/mock race). Jockey Sunny Chinoy was further informed that the Stewards took a lenient view this time and he was warned to be more careful in the future.
RE: ENQUIRY IN TO THE RIDING OF JOCKEY SURAJ NARREDU (STAR OF VENUS) AS ALSO THE INCIDENT OF THE LOSS OF WHIP IN RACE NO 159 RUN ON SATURDAY, 24TH SEPTEMBER 2011
The Stewards of the Club at their meeting held on Saturday, 8th October, 2011 interviewed Jockey Suraj Narredu as also Trainer C.D.Katrak in the above connection and having heard the submission made by them and having viewed the video recording of Race No.159 in a loop, (all angles – normal as well as slow motion) as also the blow up picture of the incident of the loss of whip, the Stewards were not satisfied with the explanation tendered by Jockey Suraj Narredu with regard to his riding on STAR OF VENUS as also the manner in which he lost the whip. The Stewards noted :-
1) That Jockey Suraj Narredu had ridden this horse once before during the Mumbai Meeting 2010/11 and won on him, therefore he knew the horse. Further, he admitted that in the race which he won, he had used the whip and the filly had responded. Hence, inspite of being aware that the filly responds well to the whip, he did not use the whip even once in the straight and thereafter lost his whip at a crutial part of the race in the last 100 metres, which may have cost him the race.
2) The fall of the whip, as apparent on the blow up picture of the incident of the whip fall, did not suggest an accidental fall and further there was no reaction on Jockey Suraj Narredu’s part to grab the whip back which happens in most cases where a Jockey loses his whip accidentally during the race.
3) Jockey Suraj Narredu stated before the Stewards that he wanted to give the filly a backhander at which stage he lost the whip, in the motion. However, the position of the whip in his hand at the time when the whip fell out of his hand, as apparent on the blow up picture of the incident of the whip fall, did not give any indication that he was attempting to give a backhander and he had therefore tried to mislead the Stewards.
4) The Stewards also noted that just before the loss of whip, Jockey Suraj Narredu had peeped under his arm and was aware that there was a horse moving fast from his outside and thereafter the whip fell out of his hand in a doubtful manner.
5) Trainer C.D.Katrak confirmed in the Jockey’s presence that STAR OF VENUS responds well to the whip and the loss of whip had cost the filly the race.
6) There was prior information that STAR OF VENUS was not going to win this race and Jockey Suraj Narredu had been warned by the Stipendiary Stewards in the paddock.
Taking an overall view and the circumstantial evidence as stated above, the Stewards were not satisfied with the explanation tendered by Jockey Suraj Narredu. The Stewards decided to give him some benefit for the charge of deliberately dropping his whip and decided to suspend his Jockey’s license w.e.f. 13th November, 2011 to 1st December, 2011 for unsatisfactory riding on his mount (permitted to ride work/mock race).
RE: POSITVE REPORT IN RESPECT OF (1) “CINDERELLA”, (2) “DECLACROIX” AND (3) “HIGH NOON” IN CHARGE OF TRAINER SHYAM S HABBU – COMPULSORY SAMPLING OF HORSES THAT HAD GONE TO STUD FARMS AND HAVE RETURNED TO THE PUNE RACECOURSE:
The Stewards of the Club at their meeting held on 4th October interviewed Trainer Shaym S Habbu along with his Spokesman, Mr. KN Dhunjibhoy. The Stewards took into consideration that the above said horses were non racing horses with a medical history of unsoundness and the Sr.V.O. confirmed that they were unlikely to be assisted with anabolic steroids. Further, the horses were not going to race soon and therefore there was no apparent motive for administration of Boldenone. Also, the trainer confirmed that one of the horses was sent to Pune only for medical investigation and was sold and moved out of Pune even before the reporting of the positive finding. However, Trainer Shyam S.Habbu was unable to establish any mitigating reasons, besides the abovementioned submissions made by him.
After applying their mind to the entire facts of the case, as per rules governing random sampling as prevailing on the date the positive was reported, the Stewards decided, :-
1) For the first infringement on CINDERELLA, to fine you a sum of Rs.25,000/-;
2) For the second infringement on DELACROIX, to fine you a sum of Rs.50,000/-;
3) For the third infringement on HIGH NOON, to fine you a sum of Rs.50,000/- plus another Rs.50,000/- totaling Rs.1,00,000/-
RE: ENQUIRY IN TI THE INCIDENT IN THE STABLE IN RESPECT OF “STAR OF VENUS” PRIOR TO HER RUN IN RACE NO 159 – THE PEGASUS TROPHY – RUN ON SATURDAY, 24TH SEPTEMBER 2011 – TRAINER CD KATRAK:
The Stewards of the Club at their meeting held on 4th October 2011 considered the enquiry conducted by the Stipendiary Stewards and Sr. VO of the Club and interviewed Trainer C.D.Katrak as also his stable staff. The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings reports and records and also having permitted Trainer Katrak to make submissions in the subject matter, were not satisfied with the explanation tendered by him and as such, held him guilty of breach of the Medication Rules. It was noted :-
1) His Jamadar admitted that Amino Speed Excell paste was given to the filly two hours before the race and he had forgotten to give it in the morning as instructed by him (Trainer Katrak).
2) Tr.katrak was well aware that as per Clause VII of the Rules for “Medication Control For Horses In Training And Racing” as published in the Club’s Racing Calendar “No substance, other than those used in the normal feeding of a horse should be administered to the horse within 48 hours before the start of the race” The Stewards did not accept his contention that Amino Speed Excell paste was similar to hygain pre-mix and it was part of the normal feed of a horse, and therefore, it was a breach of Calendar Notification. The Stewards took into consideration Trainer Katrak’s contention that Amino Acid was a nutritional supplement, however, by his own admission, STAR OF VENUS was the only horse to whom the Amino Speed Excell paste was given on race days, therefore, it could not be considered as part of the normal feed of a horse, as also the recommended dosage was to give the dose two hours before the race.
3) It was established by the Manufacturer’s literature, that amino acids have the benefit of improving the athletic performance of a horse.
4) There was contradiction in the statement given by Trainer Katrak in the enquiry, in that, he informed that STAR OF VENUS was highly strung and overly sweating and had therefore to be given amino acids. However, the Syce of STAR OF VENUS denied that the filly was highly strung and overly sweats. Further, his Jamadar during the enquiry before the Stipendiary Stewards also denied that the filly was highly strung and overly sweats and thereafter he kept on changing the statements before the Stewards.
5) Tr.Katrak’s Jamadar initially confirmed that several of his horses were given Amino Excell paste, a statement which he later retacted. By his admission, he had given this paste to STAR OF VENUS each time she ran on the morning of the race day, which was in breach of the Calendar Notification.
Taking an overall view of the facts of the case and taking into consideration the fact that Trainer Katrak has come up repeatedly before the Stewards for Medication and other Infringements, and this being his fourth case within one year, the Stewards decided :-
a) To suspend his Trainer’s license for a period of 90 days;
b) To impose on him a suspended sentence of 90 days for next two years.
In view of the above and taking note that Trainer Katrak’s license has already been suspended up to and inclusive of 26th December, 2011 for an earlier offence, his Trainer’s license will now stand suspended w.e.f. 27th December, 2011 to 25th March, 2012 (both days inclusive). As also to impose a suspended sentence of 90 days over the next two years, i.e. if he was found guilty of a similar offence within the next two years commencing from 26th March, 2012, then the aforesaid suspended sentence of punishment of 90 days suspension would immediately come into force and effect and which aforesaid punishment would be in addition to any other punishment which the Stewards may impose on him for any subsequent act of his as regards the aforesaid.
The Stewards were also not satisfied with the explanation tendered by Trainer C.D.Katrak’s Jamadar Sohansingh and held him guilty of tendering false and misleading evidence in the enquiry.
Taking an overall view of the facts of the case, the Stewards decided to withdraw Mr.Sohansingh’s Jamadar’s license and to warn him off from the premises of the racecourses at Mumbai and Pune and all other places under the control of the Stewards for the purpose of race meeting which would include the days on which betting is taken at Mumbai and Pune in respect of races held at any other centre/s in India and of the premises of the R.W.I.T.C., Ltd. where the powers of the Stewards are in force, w.e.f. 19th October, 2011 till 16th January, 2012.
UNAUTHORIZED USE OF MOBILE PHONE BY RISHI DAS DIDWANI (R/O 16, PEDDER ROAD, 4TH FLOOR, MITRA KUNJ, MUMBAI – 400 026), INSIDE THE W.I.R.H.O.A.LOUNGE
Mr.Rishi Das Didwani was requested to meet the Stewards on 4th October, 2011 in the above connection, however, he failed to do so.
The Stewards of the Club at their meeting held on 4th October 2011 therefore decided to take an ex-parte decision and having considered the Report submitted by the Security Officer, Mumbai Racecourse, decided to exclude Mr. Rishi Das Didwani from the premises of the Racecourse and all other places under the control of the Stewards till such time that he appears before the Stewards.
