RE: APPEAL FROM JOCKEY DASHRATH SINGH AGAINST THE DECISION OF THE STEWARDS OF THE CLUB WITH REGARD TO SUSPENSION OF HIS JOCKEY’S LICENSE W.E.F. 8th OCTOBER 2016 TO 22ND OCTOBER 2016 FOR UNSATISFACTORY RIDING – ENQUIRY INTO THE RUNNING AND RIDING OF “DIVINE MAGIC” IN RACE NO:84 – THE ALGECIRAS PLATE (DIV-I) – RUN ON 28TH AUGUST 2016
The Board of Appeal at its meeting held on 3rd October 2016 considered Appeal dated 23rd September 2016 from Jockey Dashrath Singh.
The Board of Appeal studied all documents and papers that were submitted and having considered the submissions made by Jockey Dashrath Singh and his Spokesman, Mr. Narendra Lagad and having viewed the Video recording of the race, in normal as well as in slow motion, deliberated on the matter at length and applied their minds to the entire facts of the case. The Board also noted that his ride was in accordance with the Trainer's instructions. The Board did not agree with the finding of the Stewards that Jockey Dashrath Singh had unbalanced the horse in the final 100 metres. The Board also did not agree with the Stewards on the charge of Unsatisfactory Riding. The Board felt that his ride on DIVINE MAGIC was not mala-fide. However, the Board found Jockey Dashrath Singh guilty of Improper Riding on his mount DIVINE MAGIC.
In view of the above, the Board unanimously decided to partially allow the Appeal and modify the charge to Improper Riding and hence, his Jockey’s License will now stand suspended w.e.f. 8th October 2016 to 9th October 2016 for Improper Riding on his mount DIVINE MAGIC in Race no 84 run on 28th August 2016. The Stewards of the Club at their meeting held on Saturday, 8th October, 2016 interviewed Jockey Neeraj Rawal for careless riding on his mount TRAVIESO in the above race. Having heard him and having viewed the video of the race, the Stewards were not satisfied with the explanation tendered by him and held him guilty of careless riding wherein his mount TRAVIESO drifted out in the last two furlongs and hampered the running of SPORTO (Kavraj Singh). However, keeping in mind that he did make some efforts to correct the horse, the Stewards took a lenient view and decided to only fine him a sum of Rs.5,000/-.

RE : ENQUIRY INTO THE COMPARATIVE PERFORMANCE OF “POLLYANA” IN RACE NO.93 – THE ISHPINGO PLATE, RUN ON 4th SEPTEMBER, 2016 WHICH THE FILLY WON VIS-À-VIS HER RUN IN RACE NO.52 – THE BRUNELLO PLATE, RUN ON 15th AUGUST, 2016 WHERE SHE WAS UNPLACED:
Trainer C. D. Katrak and Jockey R. Shelar who rode the filly in Race No.52, were questioned in the above connection. It was pointed out to Trainer C. D. Katrak that in Race No.52 run on 15th August, 2016 POLLYANA was ridden by Jockey R. Shelar and was available at 20/1 and ran unplaced and his other runner PRISTINA, who was the favourite in that race, won the race. Thereafter, in Race No.93 run on 4th September, 2016 he declared Jockey Amyn Merchant and the filly won as an On Money favourite at 90/100 in less than three weeks time.
The video recording of Race No.52 and Race No.93 were viewed.
Trainer C. D. Katrak said that in Race No.52 he did not give the filly much of a chance and had instructed Jockey R. Shelar to sit in a comfortable position and to do his best. He said that in Race No.93, POLLYANA was an On Money favourite, as such, he instructed Jockey Amyn Merchant to go to the front or to sit in 2nd position and to do his best. He said that in Race No.52 the filly ran in open Class-V race whereas in Race No.93 she ran in a race for maiden 3-year-olds who have run and not placed 2nd or 3rd.
Tr. Katrak was informed that this enquiry was more so regarding the running and riding of POLLYANA in Race No.52 where she was ridden by Jockey R. Shelar and was available at 20/1 and ran unplaced and in less than three weeks time POLLYANA was backed to the core in Race No.93 and won as a On Money favourite, therefore, his explanation was not acceptable especially since his other runner PRISTINA was fancied in Race No.52 and won that race.
Trainer C. D. Katrak accepted that Jockey R. Shelar was feeble in his riding effort in the straight or else the filly would have finished closer. He said that he was not satisfied with the riding of Jockey R. Shelar but that was the calibre of the Jockey. He said that Jockey R. Shelar rides work for him and therefore he gave him this ride in Race No.52, however, after this race he has stopped giving rides to Jockey R. Shelar.
Jockey R. Shelar confirmed the instructions and added that unfortunately one horse was fractious in the gate and was withdrawn and another horse was also playing up so he turned around to look what was happening and just then the start was given and he was not ready. Thereafter, he found it difficult to ride due to the kick back and it was only when he switched the filly to the outside in the straight that she started responding and he did his best. He said that the filly ran a good race and next time out he asked for this ride in Race No.93 but the Trainer refused to give him the ride.
The video of Race No.52 was viewed and it was pointed out to Jockey R. Shelar that after a good start he had fallen back and then made no effort in the early part to improve his position and he was feeble in his riding effort in the straight.
Not being satisfied with the explanation tendered by Trainer C. D. Katrak and Jockey R. Shelar, the matter was reported to the Stewards for unsatisfactory running and riding of POLLYANA in Race No.52.
The Stewards of the Club at their meeting held on Saturday, 8th October, 2016 interviewed Trainer C. D. Katrak and Jockey R. Shelar in the above connection. Having heard them and having viewed the video of the race, the Stewards were not satisfied with the explanation tendered by them, and decided:-
i) to suspend Jockey R. Shelar’s license for four Race Days for unsatisfactory riding on his mount POLLYANA in Race No.52. The suspension will take effect from the first Race Day of the Mumbai Meeting 2016/17 (permitted to ride work/mock race);
ii) to fine Trainer C. D. Katrak a sum of Rs.50,000/- for unsatisfactory running of his charge POLLYANA in Race No.52.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ARAKAWAH” (DRAWN 3 ) IN RACE NO.131 - THE ENAKSI PLATE (DIV.I) (1200 METRES) - RUN ON 18th SEPTEMBER, 2016 :
Tr. Altaf Hussain and Jockey Kavraj Singh were questioned in the above connection. The video of the race was viewed and when questioned, Trainer Altaf Hussain said that Jockey Kavraj Singh was engaged to ride this horse by the Owner and he gave the instructions in the presence of the Owner. He said that ARAKAWAH is a speedy horse and he had instructed the Jockey to take a quick jump and go to the front but if somebody else rushes to take over the running, then to sit in 2nd position and to do his best. He said that he had also told the Jockey that the horse was carrying top weight of 61.5 kg. and the going along the inner rails is soft so he should avoid going in.
The video of the race was viewed and when asked for his observation, Trainer Altaf Hussain said that when the gates opened, the horse’s mouth was open and in his opinion the Jockey had made no effort to go to the front as instructed. Further, coming into the straight the Jockey had taken the horse in despite being specifically told to avoid coming along the rails. He said that he was not satisfied with the Jockey’s riding and the Owner too was not satisfied and had asked him to report the matter to the Stipes.
Jockey Kavraj Singh said that he was instructed to go to the front but if anyone fights for the lead then to sit in 2nd/3rd position and to do his best. He confirmed that he was also told not to come along the rails in the straight. He said that at that start he received interference from LADISLAUS (P. Trevor) and could not hit the front, therefore, he settled the horse in 2nd position and coming into the straight the horse on his own shifted in and he had ridden out the horse. Also, the horse wobbled in the last 100 metres. When asked as to why he did not report to the Stipes that the horse wobbled, he said that he had noticed the wobble subsequently on the replay. To another query, Jockey Kavraj Singh said that he was engaged to ride this horse by the Owner and that he had cantered the horse once over a mile, before this race.
Having heard the submissions made and viewing the video of Race No.131 as also the previous run of the horse in Race No.65, the Stipendiary Stewards were not satisfied with the explanation tendered by Jockey Kavraj Singh, as such the matter was reported to the Stewards for such action as deemed fit for the under-mentioned reasons :-
i) For no apparent reason Jockey Kavraj Singh has not let the horse jump out fluently and take the forward position he likes and was instructed to do.
ii) He was specifically instructed not to go on the inside in the straight, which he failed to follow.
iii) He is known to be more vigorous in the straight.
The Stewards of the Club at their meeting held on Saturday, 8th October, 2016 interviewed Trainer Altaf Hussain and Jockey Kavraj Singh who was accompanied by his Spokesman, Mr. P. Trevor. Having heard them and having viewed the video of the race, the Stewards were not satisfied with the explanation tendered by Jockey Kavraj Singh and decided to suspend his Jockey’s license for a period of Twelve Race Days for unsatisfactory riding on his mount ARAKAWAH in the above race. The suspension will take effect from the first Race Day of the Mumbai Meeting 2016/17. (permitted to ride work/mock race).

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “COMMANDER” IN RACE NO.56 - THE GAMBLE FOR LOVE TROPHY (1600 METRES) - RUN ON 20th AUGUST, 2016 :
The Stipendiary Stewards reported that an enquiry was initiated into the running and riding of COMMANDER in Race No.56 – The Gamble For Love Trophy run on 20th August, 2016. The horse was trained by Trainer Nazak Chenoy and ridden by Jockey Santosh G. In the said enquiry, Jockey Santosh G. had stated that he was instructed by the Trainer not to use the whip. Trainer Nazak Chenoy had denied giving the Jockey specific instructions not to use the whip, however, she said that she never instructs her Jockeys to be “whip happy” and that she would have loved to have won the race. She opined that the Jockey had done his best and if he had tried to pull out his whip and used it, he may have lost valuable time of pushing the horse and that she was very satisfied with this ride and had no complaints. She had further added that a whip is a corrective instrument and she did not feel that the horse needed to be corrected at any stage as a horse like this does not get to where he is if he needs a lot of correcting. It was brought to the attention of Trainer Nazak Chenoy that a whip when used judiciously, is also an aid to encourage the horse to perform better. To this, Tr. Nazak Chenoy had stated that she had scientific evidence that a whip does not help the horse to perform better.
The Stipendiary Stewards were not satisfied with the explanation tendered by the Trainer and Jockey since they felt that the horse would have run better with a little more encouragement and better riding and as such reported the matter to the Stewards for such action as deemed fit.
The Stewards of the Club at their meeting held on 4th September, 2016 having heard the Trainer and Jockey and having viewed the race, were not satisfied with the explanation tendered by Jockey Santosh G. and decided to suspend his Jockey’s license for one race day for riding an incompetent race and no action was initiated against the Trainer.
The Stipendiary Stewards pointed out that COMMANDER raced again in Race No.146 on 25th September, 2016 which he won and it was observed that Jockey Suraj Narredu has used the whip 12 times, contradicting the statement made by Trainer Nazak Chenoy in her previous enquiry.
The Stewards of the Club at their meeting held on Saturday, 8th October, 2016 considered the above report and directed the Stipendiary Stewards to write to Trainer Nazak Chenoy informing her to be consistent and specific with her instructions to Jockeys in the future.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “REPLICA” IN RACE NO.99 - THE NANA RAGHUNATH TROPHY(1400 METRES) - RUN ON 4th SEPTEMBER, 2016
Tr. Adhirajsingh Jodha and Jockey Kavraj Singh were questioned in the above connection. Trainer Adhirajsingh Jodha said that he had instructed Jockey Kavraj Singh to take a quick jump and as the mare does not like to be hassled in the early part, not to push the mare too much, however, if he can sit well up i.e. in the first 2 or 3 that would be ideal or otherwise to sit in the mid bunch and to do his best. To a specific question, he said that the mare had not responded in the early part and after the race the Jockey had informed him that the mare was very uncomfortable on her right leg, however, she had returned sound after the race. Also, the mare does not run two races alike. At this juncture, it was pointed out to the Trainer and Jockey that after the race neither of them had reported to the Stipes any abnormal behavior of the mare in the race.
Jockey Kavraj Singh confirmed the instructions and said that soon after the start he was crowded by the field and dropped back. He added that the mare had trotted sound after the race and hence he did not report anything to the Stipes.
The video recording of the race (different angles) was viewed and on questioning, Tr. Adhirajsingh Jodha said that the Jockey had urged the mare in the early part of the race but the mare was not responding. Also, since she was behind horses, the kick back may have affected her. He said that the mare has a wind problem and had been operated for the same in the past. He reiterated that the mare does not run two races alike, wherein she runs one good race and the next time out she runs poorly. To a specific question, the Trainer said that considering that the mare had run a poor race, he would like to give her time before running her again.
Having heard the submissions made and viewing the video of the race (from various angles) as also the previous run of the mare in Race No.54 wherein she had placed Third, the Stipendiary Stewards noted the explanation tendered by Trainer Adhirajsingh Jodha. However, the Stipendiary Stewards were not happy with the riding effort of Jockey Kavraj Singh and decided to suspend his Jockey’s license for two Race Days for riding an injudicious race. This suspension will take effect after Jockey Kavraj Singh completes his suspension of 12 Race Days for unsatisfactory riding on ARAKAWAH (permitted to ride work/mock race).

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “SQUASH” IN RACE NO.114 - THE PREMIER COLLECTION PLATE (1200 METRES) - RUN ON 11th SEPTEMBER, 2016 :
Tr. Mansoor Shah and Apprentice Raghuveer Singh were questioned in the above connection. Trainer Mansoor Shah said that he had informed Apprentice Raghuveer Singh that the filly does not have early speed and to take a good jump and sit wherever it was possible and not to worry even if the filly lags behind as she will improve by herself coming around the final bend and coming into the straight to ride her out and do his best. Apprentice Raghuveer Singh confirmed the instructions.
The video of the race was viewed and on being questioned, Trainer Mansoor Shah said that he was surprised with the filly’s performance, which he felt was due to the poor handling by the Apprentice. He said that App. Raghuveer Singh rode the filly for the first time and he has decided not to put him on again. He said that his initial choice was Apprentice S. A. Amit but he was not available and hence he had declared Apprentice Raghuveer Singh. He said that probably he would race the filly again after 2 to 3 weeks in a 1200 metres race and try to declare Apprentice S. A. Amit who has won three races on her since the filly has done exceptionally well with him.
Having heard the submissions made and viewing the video of the race in question (various angles) as also the previous run of the filly in Race No.78 wherein she was placed 3rd, the Stipendiary Stewards were not satisfied with the explanation tendered by the Trainer and Jockey and they were informed that the enquiry was being kept open and a close watch will be kept on the future performance of the filly.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “FLAMBOYANT FLAME”IN RACE NO.115 - THE GLENSANDA PLATE, RUN ON SUNDAY 11th SEPTEMBER, 2016:
Trainer Dallas Todywalla and Apprentice Vishal N. Bunde were questioned in the above connection. The video of the race was viewed and when questioned, Trainer Dallas Todywalla stated that the filly was drawn-2 and he had instructed the Apprentice to take a good jump and try to go to the front and to do his best in the straight. He agreed that the filly had run below expectation, however, he said that he did not take objection to the Jockey’s riding. He also pointed out that the common horse DRAGON OF WAR had finished ahead of his filly both the times.
Apprentice Vishal N. Bunde confirmed the instructions and said that he had done his best. The video of the race was viewed and he was asked as to why he left the rails and came from the wide outside in the straight thereby losing valuable ground on a favourite. App. Vishal N. Bunde said that he felt that the filly will run better from the outside and also, there was a lot of kick back on that day and he did not want to take a chance, so he made his move from the outside. The Trainer agreed with the Apprentice and said that he has told all his Jockeys that on a day like this (when it rains) they should leave the rails and come from the outside.
The explanation tendered by Trainer Dallas Todywalla and Apprentice Vishal N. Bunde was noted.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “ARCTIC WHIZZ” IN RACE NO.115 - THE GLENSANDA PLATE (1000 METRES) - RUN ON 11th SEPTEMBER, 2016 :
Tr. A. M. Jadhav and Jockey Kishore Kadam were questioned in the above connection. Trainer A. M. Jadhav said that he had expected DRAGON OF WAR and BARYSHNIKOV to set a fast pace, as such, he had instructed Jockey Kishore Kadam to take a good jump and sit in 5th or 6th position and to do his best. He said that he had also asked the Jockey to be careful and not let the outside field to come in and crowd him as he was drawn-4. He said that the filly does not have initial speed and that could be the reason for her dropping back. He said that his filly had run within five lengths of the common horse FLAMBOYANT FLAME at level weight in Mumbai whereas in the race in question, his filly had 7.5 Kg. handicap advantage over the common horse and he had fancied the filly.
Jockey Kishore Kadam confirmed the instructions. The video recording of the race was viewed and on being questioned as to why he had not followed his riding instructions, he said that the horses drawn on his outside were faster and had come in due to which he was unable to sit 5th/6th as instructed. He said that he had niggled the filly after the start but she did not respond to his urgings. Also, after the race he had reported that the filly had hung in.
To a question, Trainer A. M. Jadhav said that the filly had coughed after the race and hence he had her scoped and found that she had some undulations on her pharynx for which she was treated and he was not planning to run her in the near future.
Having heard the submissions made and viewing the video of the race, the Stipendiary Stewards were not satisfied with the explanation tendered by the Trainer and Jockey. However, keeping in mind that the filly had coughed after the race and was treated for the same as confirmed from the Medical Log Book and also this was the filly’s first run at Pune, Trainer A. M. Jadhav was informed that the enquiry was being kept open and Jockey Kishore Kadam was asked to make more efforts to follow his riding instructions in the future.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “SPORTO” IN RACE NO.123 - THE ADAM’S TREASURE PLATE (DIV.II) (1200 METRES) - RUN ON 17th SEPTEMBER, 2016 :
Tr. Adhirajsingh Jodha and Jockey Kavraj Singh were questioned in the above connection. The video of the race was viewed and when questioned, Trainer Adhirajsingh Jodha said that he had instructed the Jockey to take a quick jump and if the horse was going on his own then to settle him in the first three or four or else settle him wherever he finds him, pull him out in the straight and to do his best.
The video of the race was viewed and when asked for his observation, Tr. Adhirajsingh Jodha said that the horse was loaded first and may have got relaxed in the gate whereby he jumped out tardily and because he was slowly out, the other horses had already gone ahead and seeing open space on the left, the horse tried to drift out and by the time the Jockey tried to correct the horse, he was nearly 10 to 15 lengths behind. Trainer Adhirajsingh Jodha said that he had given up all hope at that stage, however, the horse came with a good run from the outside to finish second. He said that even in Race No.74 over 1000 metres which was his first run, the horse had tried to go out after the start but there was a horse on his outside and he bumped into that horse and straightened up. He said that he had given the horse sufficient gate practice after Race No.74 and the horse did not show the tendency to go out.
Jockey Kavraj Singh confirmed the instructions and added that the horse was slowly out and then veered outwards and in the last furlong he had received interference and yet he had finished 2nd. He said that even in the previous race i.e. Race No.74 the horse had tried to go out but he had managed to correct the horse as there was a horse on his outside and that was the first run of the horse. He said that Jockey D. S. Daman had informed him that once before in work also the horse did the same thing. He said that the horse was given sufficient gate practice in between the two races and did not show the tendency to go out.
On viewing the video of Race No.123 as also the horse’s previous run i.e. Race No.74, it was observed that the horse has tried to go out in both the races. In view of the above, the enquiry has been closed. However, in view of the horse’s behavior of trying to go out after the start, Trainer Adhirajsingh Jodha has been asked to take remedial measures before next accepting with him to race.

RE : ENQUIRY INTO THE RUNNING AND RIDING OF “JARAMA” IN RACE NO.124 - THE ENAKSI PLATE (DIV.II) (1200 METRES) - RUN ON 18th SEPTEMBER, 2016 :
Tr. Mansoor Shah and Jockey S. Sunil were questioned in the above connection. The video of the race was viewed and when questioned, Trainer Mansoor Shah stated that he had instructed the Jockey to settle the filly in 3rd/4th/5th position and to do his best in the straight. When asked about his observation of the race, he said that the filly was drawn-1 and the Jockey has tried not to go to the front and he was well up and coming into the straight the filly started moving along the rails but thereafter did not respond, probably the winning penalty may have been too harsh. He said that Jockey S. Sunil has used the whip and ridden out the filly to his calibre and he was satisfied with the Jockey’s riding. He said that he had declared Jockey S. Sunil in Race No.71 also when the filly won but Jockey S. Sunil could not fulfill his riding engagement and therefore he was replaced by Jockey J. Chinoy.
Jockey S. Sunil confirmed the instructions and stated that coming into the straight when he started pushing, the filly did not respond.
Having heard the submissions made and viewing the video of Race No.124, the explanation tendered by the Trainer and Jockey was noted and the enquiry has been kept open and a close watch would be kept on the future running of the filly.
