RE : ENQUIRY INTO THE POSITIVE FINDING OF “PENTAZOCINE” IN THE URINE SAMPLE OF dk b g “ZODIAC” (PLACED THIRD) IN RACE NO.154 – THE S.A.POONAWALLA MULTI-MILLION (GR.2) RUN ON SUNDAY, 21ST SEPTEMBER, 2014 :
The Stewards of the Club at their meeting held on 14th January, 2015 having heard Trainer Dallas Todywalla and Dr.Anil Kumar, Chief Veterinary Office, Equine Hospital, had adjourned the hearing.
The Stewards thoroughly enquired into the matter and applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and submissions made in the matter and also permitted Trainer Dallas Todywalla to make submissions in the subject matter. The Stewards noted that the Chief Veterinarian, Equine Hospital had stated that PENTAZOCIN was not part of the treatment given to ZODIAC after the race on 21st September, 2014. However, in the facts and circumstances of this case, it was not possible to determine conclusively whether PENTAZOCIN was administered pre or post the post. These therefore, constitutes mitigating circumstances and hence the Stewards gave Trainer Dallas Todywalla the benefit of doubt and no penalty was imposed on him.
RE: ENQUIRY INTO THE COMPRATIVE PERFORMANCE OF “SUMMER EXPRESS” IN RACE NO 140 – THE LOOK OUT PLATE (DIV.II) (1400 METRES) RUN ON 22ND JANUARY, 2015 WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUN IN RACE NO.100 (1200 METRES) RUN ON 1ST JANUARY, 2015 WHERE SHE WAS UNPLACED– TRAINER SANJAY KOLSE :
Trainer Sanjay Kolse was questioned in the above connection. Tr.Sanjay Kolse stated that SUMMER EXPRESS has performed consistently since the time she came to him from Tr.S.K.Sunderji and has always been finishing on board. He said that the filly had worked well and put on condition and he had fancied her in Race No.100 and instructed App.S.J.Sunil to be in front position and to do his best. He said that the filly was right there till 400 metres and thereafter dropped back alarmingly, probably since she was running after a gap of two months. Thereafter, he continued the same pattern of work and he fancied her in Race No.140 also, but more in Place. He said that normally when a horse comes alongside, she drops back, however, in Race No.140, despite traffic problems she came out and won and the win surprised him. It was pointed out to Trainer Sanjay Kolse that SUMMER EXPRESS had shown much improvement vis-à-vis the common horse MAGIC VISION. Trainer Sanjay Kolse said that he himself was surprised with this win, however, he felt that the mare must have striped fitter after her last run. When asked to explain the change of Jockey from App.S.J.Sunil to Jockey A.Sandesh, Tr.Sanjay Kolse said that Race No.100 being a 1200 metres race, he thought she will sprint and hence claimed 5 kg allowance.
The video recording of Race No.100 and Race No.140 were viewed. Trainer Sanjay Kolse agreed with the Stipendiary Stewards that the mare had shown improvement and that he was surprised with this win.
It was pointed out to Trainer Sanjay Kolse that there was a common horse MAGIC VISION who had finished four lengths ahead of SUMMER EXPRESS and in Race No.140 SUMMER EXPRESS has beaten MAGIC VISION by approximately 6 lengths and also there was more betting on her this time.
After scrutinizing the log books, the explanation tendered by Trainer Sanjay Kolse was noted as the horse was in the betting on both occasions and has run consistently on all occasions but for Race No.100.
RE: ENQUIRY INTO THE COMPRATIVE PERFORMANCE OF “NIRBHAYA” IN RACE NO 148 – THE MULTIGEM PLATE (DIV.I) (1000 METRES – JOC.S.G.PRASAD) RUN ON 22ND JANUARY, 2015 WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUN IN RACE NO.121 (1400 METRES – AMYN MERCHANT) RUN ON 8TH JANUARY, 2015 WHERE SHE WAS UNPLACED– TRAINER MANSOOR SHAH :
Trainer Mansoor Shah and Jockey Amyn Merchant were questioned in the above connection. Trainer Mansoor Shah was asked to explain the improvement of more than a distance shown by NIRBHAYA in a short span of 14 days. Trainer Mansoor Shah admitted that the mare had shown improvement in Race No.148. He said that NIRBHAYA is a big horse and probably the heaviest horse in India at 569 kg. with a minimum feed of 12 pounds and he cannot cut down her feed as she may become weak. Hence he has to keep on racing her regularly to maintain her. He said that in her previous run over 1400 metres, the mare was right there till the last furlong and thereafter dropped back. He said that he had not fancied the mare both the times. It was pointed out to Trainer Mansoor Shah that in Race No.121 NIRBHAYA was at 25/1 and there was hardly any betting on her whereas in Race No.148, she was at 7/1 and there was betting on her. Trainer Mansoor Shah said that in her previous run over 1400 metres the mare was right there till the last furlong and this time she was running over 1000 metres and hence punters may have given her a chance, however, he had not fancied her both times and his connections had not backed her the day she won and her odds went up, had she been fancied, the odds would have come down. He said that there was no common horse, the field was weaker this time and also the mare may have stripped fitter after her last run. He said that he intends to race her again after another week. It was pointed out to Trainer Mansoor Shah that both the times NIRBHAYA ran in open Class-IV and hence his excuse that the field was weaker in Race No.148 was not acceptable. Also, there was a difference of only 3 kg. in her body weight when she won.
Jockey Amyn Merchant confirmed the instructions and added that the mare was right there till last 200 metres and thereafter packed up.
After viewing the video recording of both the race and scrutinizing the betting sheets, the Stipendiary Stewards were not satisfied with the explanation tendered by Trainer Mansoor Shah with regard to the improvement by his charge in a matter of 14 days and a significant difference in the betting. However, the Stipendiary Stewards took a lenient view keeping in mind that the pattern of running was similar in both the races and there was no common horse, Trainer Mansoor Shah was only fined a sum of Rs.10,000/- and warned to be more careful in the future.
RE: ENQUIRY INTO THE RUNNING AND RIDING OF “QUEEN OF VENUS” IN RACE NO 143 – THE MULTIGEM PLATE (DIV.II) (1000 METRES) RUN ON 22ND JANUARY, 2015 – TRAINER MANSOOR SHAH AND APP.K.N.BHATI :
Trainer Mansoor Shah and Apprentice K.N.Bhati were questioned in the above connection. Trainer Mansoor Shah said that he had instructed the Jockey to jump and take a forward position and to do his best. He said that he had two runners in this race, QUEEN OF VENUS and ACKER BILK and he had given both the Jockeys the same instructions and that this was the best run of the mare in the last two years. He said that QUEEN OF VENUS is a well bred horse, she is full sister to ATTILA but she has soundness issues and hence has been sparingly raced. He said that they wanted to send her for breeding at the end of the Pune Meeting 2014, however, they later decided to send her at the end of March.
App.K.N.Bhati confirmed the instructions and added that the filly does not have initial speed and he had done his best.
The video recording of Race No.143 was viewed and asked for his observation, Trainer Mansoor Shah said that although his instructions were to be well up, however, this mare does not have initial speed and 1000 metres was sharp for her and she has won only one race over 1200 metres but that was more than 2 years ago.
It was pointed out to Jockey K.N.Bhati that he had made no effort to sit in a forward position as instructed and also did not take the gaps available during the race. App.K.N.Bhati said that after the start he has niggled and pushed the horse all the way but the horse did not have speed and he could not take the gaps since the horse was hanging out.
Not being satisfied with the explanation tendered by App.K.N.Bhati, he has been warned for the future.
RE: ENQUIRY INTO THE COMPRATIVE PERFORMANCE OF “MAJESTERIAN” IN RACE NO 155 – THE MAY FLOWER PLATE (1400 METRES – APP.BHAWANI SINGH) RUN ON 24TH JANUARY, 2015 WHICH THE GELDING WON AS COMPARED TO HIS PREVIOUS RUN IN RACE NO.30 (1400 METRES – VIKRAM JODHA) RUN ON 30TH NOVEMBER, 2014 WHERE HE WAS UNPLACED– TRAINER KARTHIK G. AND JOCKEY VIKRAM JODHA :
Trainer Karthik G. said that in Race No.30, he had instructed Jockey Vikram Jodha to sit in 5th/6th position and to do his best. Jockey Vikram Jodha confirmed the instructions. He said that he had met with interference in the straight and he had done his best.
The video recording of Race No.30 was viewed and when asked for his observation, Trainer Karthik G. said that this is a temperamental horse to ride, he puts his head down and gallops in patches and all the top Jockeys who have ridden him earlier have advised him that he is no good and to pack him off to Chennai. He said that after this race, he had put on a Tongue Strap on this horse and he was working regularly with a good youngster. When questioned regarding the change in the pattern of running, Trainer Karthik G. said in Race No.30 the horse was running in a higher Class and hence he had instructed the Jockey to sit in 5th/6th position and to do his best. This time in Race No.155 the horse was running in a lower Class with a weaker set of horses and he had instructed the Jockey to take a jump and keep pushing the horse continuously. He said that no other Jockey wanted to take this ride and hence he put up App.Bhawani Singh. It was pointed out to Trainer Karthik G. that in Race No.30 there was hardly any betting on the horse whereas in Race No.155 there was substantial betting. Trainer Karthik G. said that the reason could be that the horse was running in a lower Class and the field was weaker as compared to Race No.30. He pointed out that PADMAKOSA who ran second in that race has won subsequently. Also, THE OTHER SONG who ran behind MAJESTERIAN in that race, subsequently ran third to LA TRAVIATA. He added that although he had used a Tongue Strap on the horse this time, he had shown marginal improvement and he was lucky to win the race because the favourite SHIVALIK SKIES met with interference at the start.
The video recording of Race No.30 was viewed and it was pointed out to Jockey Vikram Jodha that he had made no effort to sit as per his instructions and was content to sit last. Also, he had not taken the gap available in the straight and had not ridden out the horse vigorously or else the horse would have definitely finished on board.
Jockey Vikram Jodha reiterated that he had met with interference in the straight and he had done his best. It was pointed out to Jockey Vikram Jodha that the interference was his own doing, when there was a gap available he made no attempt to take the gap and the interference was later.
Trainer Karthik G. concurred with the Stipendiary Stewards that MAJESTERIAN could have finished 4th or 5th if the Jockey had ridden well. He said that he was not fully satisfied with the Jockey’s riding, however, he did not complain since the horse had met with interference in the last part.
Keeping in mind that the horse raced after a gap of 50 days and he won in a lower Class, the explanation tendered by Trainer Karthik G. was noted. However, the Stipendiary Stewards were not satisfied with the explanation tendered by Jockey Vikram Jodha and decided to suspend his Jockey’s license for 15th February, 2015 for incompetent riding on MAJESTERIAN in Race No.30.
RE: ENQUIRY INTO THE COMPRATIVE PERFORMANCE OF “SHARMEELY” IN RACE NO 158 – THE NATIVE KNIGHT GOLD TROPHY (1000 METRES – DASHRATH SINGH) RUN ON 24TH JANUARY, 2015 WHICH THE MARE WON AS COMPARED TO HER PREVIOUS RUN IN RACE NO.120 (1000 METRES – F.IRANI) RUN ON 8THJANUARY, 2015 WHERE SHE WAS UNPLACED– TRAINER FAISAL A.ABBAS AND F.IRANI:
Trainer Faisal A.Abbas was questioned in the above connection. He said that he had given similar instructions to the Jockeys in both the races i.e. to jump out and sit wherever he is comfortable, come into the straight, pull her out and to do his best. He explained that this mare came to him during the Pune Meeting 2014 from Trainer H.J.Antia. He said that SHARMEELY is a highly strung filly and she is not a very sound filly and is also bad in the gates and has to be led to the start riderless and most Jockeys are scared to ride her. The mare raced twice in his charge in Pune and her performance was disappointing and hence the owners sold her. He added that in her early career SHARMEELY has beaten horses who are today in Class-I however she subsequently went wrong. He said that he has worked hard to improve her and she has shown improvement after every run and Jockey F.Irani has also put in hard work to improve her. He that in Race No.120 she raced with younger horses as compared to her winning Race i.e. Race No.158 which was a race for horses 5 years old and over and she opened at 7/1 and drifted to 10/1 and there was no gamble on her. It was pointed out to Trainer Faisal A.Abbas that there were four common horses and two of them had finished ahead of her in Race No.120. Also, in Race No.120 the mare was at 33/1 and there was hardly any betting on her whereas in Race No.158 she opened at 5/1 and went up to 7/1 and there was substantial betting on her. Trainer Faisal A.Abbas said that the filly has been showing improvement after every run, even in Race No.120 she was moving well towards the end which indicated that she may do well over 1200 metres to 1400 metres, however, he wanted to see how she would perform again over 1000 metres with a good Jockey and requested Jockey Dashrath Singh to accept the ride.
Trainer Faisal A.Abbas was informed that the Stipendiary Stewards were not satisfied with his explanation since the mare had shown tremendous improvement in a short span of 16 days vis-a-vis two common horses and also there was a big leap in the quantum of betting on her the day she won. Trainer Faisal A.Abbas said that the pattern of running was same in both the races and the mare won by a short-head due to Jockey Dashrath Singh’s hard riding.
Jockey F.Irani confirmed the instructions and stated that he had done his best.
The explanation tendered by Trainer Faisal A.Abbas for the comparative performance of SHARMEELY has been noted. However, the Stipendiary Stewards were not satisfied with the explanation tendered by Jockey F.Irani and decided to suspend his Jockey’s license for 15th February, 2015 for incompetent riding on SHARMEELY in Race No.120.
The Stewards directed the Stipendiary Stewards to ask Trainer Faisal A.Abbas to appear before the Stewards in the above connection as they felt that both the Trainer and Jockey were responsible for the running and riding of SHARMEELY.
RE: ENQUIRY INTO THE RUNNING AND RIDING OF “OCEAN STAR” IN RACE NO 148 – THE MULTIGEM PLATE (DIV.I) (1000 METRES) RUN ON 22ND JANUARY, 2015 – TRAINER H.J.ANTIA AND JOCKEY VIKRAM JODHA :
Trainer H.J.Antia and Jockey Vikram Jodha were questioned in the above connection. Trainer H.J.Antia said that he has watched all the races of this mare, Trainers who had this mare earlier and had fancied her and asked Jockeys to sit well up, have got no response from her whatsoever in the last part. He said that the more you sit on her, better she performs and he had instructed the Jockey to settle her back, not to make haste and to do his best in the straight. Unfortunately, the Jockey has not followed the instructions, the Jockey has put pressure on her right from the start whereby she did not respond towards the end. He said that when he questioned the Jockey after the race why he did not settle her behind, the Jockey informed him that he did not want to hold her back as he feared that he would be called up for questioning after the race. He said that in the previous run, OCEAN STAR finished third, a neck behind an 5-year-old horse, MAALIK (who ran second).
Jockey Vikram Jodha confirmed the instructions. He said that in the straight CEASARINA was taking him wide, so he held his mount back hoping that CEASARINA will shift out and thereafter he would bring his mount in. He said that he had done his best.
The video recording of the race was viewed and it was pointed out to the Trainer and Jockey that the Stipendiary Stewards take exception to the Jockey’s riding in the straight, more so in the last 400 metres since he kept changing course and was hiding behind the front horses instead of making his move..
Not being satisfied with the explanation tendered by Jockey Vikram Jodha, he has been cautioned for the future.
