RE : APPEAL FROM TRAINER MANSOOR SHAH AGAINST THE DECISION OF THE STEWARDS OF THE CLUB TO SUSPEND HIS TRAINER’S LICENSE W.E.F. 5TH DECEMBER, 2014 TILL THE END OF THE MUMBAI MEETING 2014/15 AND THEREAFTER NOT TO GRANT HIM A TRAINER’S LICENSE, IF HE APPLIED FOR THE SAME, TILL 30TH OCTOBER, 2015 AS ALSO A FINE OF RS.1,00,000/- FOR BEING GUILTY OF DISHONEST, CORRUPT, FRAUDULENT, IMPROPER PRACTICE AND DISHONORABLE ACTION IN CONNECTION WITH RACE – ENQUIRY INTO THE POOR PERFORMANCE OF “TUSCANIA” IN RACE NO.237 – THE WASHINGTON IRVINE PLATE (DIV.II) RUN ON 6TH MARCH, 2014 :

The Board of Appeal at its meeting held on 9th February 2015, considered the appeal from Trainer Mansoor Shah in the above connection. During the hearing of the appeal, Mr. Harresh Mehta, spokesman of Trainer Mansoor Shah insisted on asking certain question to Mr. Pradyumna Singh, the then Senior Stipendiary Steward of the Club who had conducted the enquiry, which he felt was important for Trainer Shah’s defence. Mr. Mehta was informed that as per the Rules of Racing he was not allowed to ask for witnesses at the last minute. However, to further natural justice and as a matter of abundant caution the Board would request Mr. Pradyumna Singh to attend at a future date.

Accordingly, the Board of Appeal decided to permit Mr. Mehta to ask questions to Mr. Pradyumna Singh at the adjourned meeting of the Board of Appeal which was scheduled to be held on 23rd February 2015.

The Board of Appeal at its meeting held on 23rd February 2015 considered all documents and papers that were submitted including in detail the grounds of appeal submitted by Trainer Mansoor Shah as also heard the submissions made by him as also his spokesman Mr. Harresh Mehta. The Board of Appeal whilst deliberating on the matter unanimously felt that Rule No. 202 of the Rules of Racing of the Club would not be the correct rule to apply in this case but held him vicariously responsible in this case as per Rule 114(b)(i). Accordingly, the Board of Appeal unanimously decided to partially allow his appeal by modifying the period of his punishment by suspending his Trainer’s licence w.e.f 8th March 2015 to 8th January 2016 (both days inclusive). However, the fine of Rs.1 lakh remained. The deposit was ordered to be refunded.

Further, after the decision was communicated to Trainer Shah by the Chairman of the Board of Appeal, his spokesman behaved in a very rude manner with the Board of Appeal. Mr. Shah was recalled and informed by the Chairman that the Board took grave exception to the behavior of his spokesman and that such misbehavior by his spokesman will affect him since he was responsible for the behavior of his spokesman at the meeting.
