SUBJECT : ENQUIRY INTO THE POSITIVE REPORT IN RESPECT OF b g “OCEAN AND BEYOND” (WINNER) IN RACE NO.71 – THE CASINO ROYALE INDIAN 2000 GUINEAS (GR.1) RUN ON SUNDAY, 19TH DECEMBER, 2010 :
The Stewards of the Club at their meeting held on Tuesday, 23rd August, 2011 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry and having interviewed Trainer S.K.Sunderji, reserved their judgement.
The Stewards of the Club at their meeting held on Tuesday, 30th August, 2011, after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and also having permitted Trainer S.K.Sunderji to make submissions in the subject matter, found that he had no mitigating circumstances to offer in the subject case and as such, held him guilty of breach of the Medication Rules, consequently he became vicariously liable. In that :
1) The Stewards, after due deliberation, did not accept the alleged contamination as mitigating circumstances for various reasons inter-alia :-
(i) There were no Indents in the name of OCEAN AND BEYOND for the alleged contaminated batch of feed supplements viz. Equitop Myoplast, Equitop Pronutrin and Equitop Gonex;
(ii) The feed supplements were not recorded in the Veterinary / Medication Log book;
(iii) The Trainer had, while indenting the supplement, confirmed in writing that the supplements are sourced at his cost / risk;
(iv) The chain of custody for the independent testing done jointly by him along with Trainers P.Shroff and C.D.Katrak, was not as per established procedure, in that, the samples were taken from open boxes and no witness from the Club was present or intimated;
(v) The Stewards noted that there were Indents in the names of 223 horses, including AMARETTO, in Western India for the alleged contaminated batch of Equitop Myoplast 100529 out of which 69 horses were sampled. Similarly, there were Indents in the names 89 horses, including AMARETTO for the alleged contaminated batch of Equitop Pronutrin 100093 out of which 43 horses were sampled there were Indents in the names of 85 horses, including ELOISE, for the alleged batch of Equitop Gonex 100477 out of which 33 horses were sampled. This meant that approximately 200 horses were sampled routinely by the Club for whom Indents were placed for the same batch of feed supplements in Mumbai alone. Out of these 200 horses tested, only two horses viz. ELOISE and AMARETTO tested positive. There were no Indents in the names of the other two horses who were reported positive, viz. OCEAN AND BEYOND and STAR FUTURE.
(vi) The feed supplement Manufacturer, Boehringer, confirms supply of the same supplements world wide in thousands of units with not a single claim of contamination;
(vii) The five recent cases of BOLDENONE finding in random testing with no link to contaminated feed has raised a question mark on the Trainer’s cover. Atleast one of the two Trainers concerned has confirmed to the Stewards that his two horses which were reported positive for BOLDENONE, were not fed these feed supplements at all.
(viii) The Medication Rules contain no provision for additional testing beyond the reference sample or for testing nutritional samples. Further, the Club was legally advised that it was not obliged to test the feed supplements. Also the Club neither compels nor recommends the usage of these supplements by trainers.
Notwithstanding the above, and in view of prima facie evidence of contamination provided by Tr.S.K.Sunderji, and in order to be completely fair, the Stewards accepted to have samples of the alleged contaminated feed of the same batch tested at HFL, UK, to help him prove mitigating circumstance. HFL is a lab accredited by the R.W.I.T.C. Ltd. for testing of samples of all its Classic and Grade-1 races. Vide this office letter dated 25th April, 2011 Tr.S.K.Sunderji was told that the Club will not entertain any further request for testing for either urine or feed and will proceed with the test only based on HFL procedure and conditions. The other RWITC accredited labs were either unable to test the feed supplements or gave no satisfactory response. The Trainer had given his consent in writing vide his letter dated 3rd May, 2011 to these conditions. Once HFL confirmed they can test the feed supplements but at a level of 10 ng, he did not agree to go ahead with the test of the supplements. As informed to him earlier, the Stewards then initiated and completed the enquiry.
2) The Stewards took into consideration that BOLDENONE is banned by the Government of India unless administered for therapeutic purpose by the Club’s Official Veterinarian or licensed practicing Veterinarians of the RWITC Ltd and duly notified to the Sr.V.O. in writing within 24 hours of such administration. Therefore, in April, 2011 the Stewards had decided to remove all Steroids and Sex Hormones from the list of Classification and placed them on a proscribed list. However, since OCEAN AND BEYOND was reported positive for BOLDENONE before the Stewards took the above decision, they applied the old Medication Rules prior to this change;
3) The Stewards have gone by past precedents of ten years where the Stewards have usually taken into consideration the Medical Infringement of the previous five years to determine the number of offences and decide on punishment and gave a lesser weight-age to infringements beyond five years. Accordingly, the Stewards have treated the Medical Infringement of OCEAN AND BEYOND as Tr.S.K.Sunderji’s second offence taking into account that he had a positive on OCEAN WISH in 2009. Further, the Stewards noted that he had two earlier cases of Medical Infringement which were more than 5 years ago. However, in the first case of DAFFODILS who was reported positive for Morphine, the Stewards had accepted his mitigating circumstances and in the second case of HOLLYWOOD WILD who was reported positive for Oxyphenbutazone and Phenylbutazone, these drugs now have a reporting level as per the amended rules and therefore the same was not taken into account.
Taking an overall view, the Stewards decided as under :-
a) to suspend his Trainers license for a period of 45 days;
b) to fine him a sum of Rs.10,000/-.
Tr.S.K.Sunderji was informed that as per the Medication Rules, suspension for breach of the Medication Rules has to start with immediate effect. However, the Stewards would like to give him some time to make his arrangement for the transfer of his horses. Therefore, in consultation with Trainer S.K.Sunderji, it was decided, that his Trainer’s license shall stand suspended w.e.f. 5th September, 2011 to 19th October, 2011 (both days inclusive) and to fine him a sum of Rs.10,000/-.

Once HFL confirmed they can test the feed supplements but at a level of 10 ng, the trainer did not agree to go ahead with the test of the supplements. As informed to Tr.C.D.Katrak earlier, the Stewards then initiated and completed the enquiry.
2) The Stewards took into consideration that BOLDENONE is a drug that is banned by the Government unless administered for therapeutic purpose by the Club’s Official Veterinarian or licensed practicing Veterinarians of the RWITC Ltd and duly notified to the Sr.V.O. in writing within 24 hours of such administration. Therefore, in April, 2011 the Stewards had decided to remove all Steroids and Sex Hormones from the list of Classification and placed on a proscribed list. However, since STAR FUTURE was reported positive for BOLDENONE before the Stewards took the decision, the Stewards applied the old Medication Rules prior to this change;
3) The Stewards have gone by past precedents of ten years where the Stewards have usually taken into consideration the Medical Infringement of the previous five years to determine the number of offences and decide on punishment and a lesser weight-age given to infringements beyond five years. The Stewards noted that Tr.C.D.Katrak had a Medical Infringement on GLORIOUS FANTASY who ran in Race No.133 on 9th October, 2005 which was a few months before the five year cut off period and the Stewards would have been within their right to consider it as his first infringement, but decided to take a strict interpretation of the five year cut off period and treated his Medical Infringement of STAR FUTURE as his first offence.
Taking an overall view, the Stewards decided as under :-
(a) to suspend his Trainers license for a period of 45 days i.e. 30 days as first infringement on STAR FUTURE and an additional 15 days for his past Medication Infringements;
(b) to fine him a sum of Rs.10,000/-.
Trainer C.D.Katrak was informed that as per the Medication Rules, suspension for breach of the Medication Rules has to start with immediate effect. However, the Stewards would like to give him some time to make his arrangement for the transfer of his horses. Therefore, in consultation with Tr.C.D.Katrak, it was decided that his Trainer’s license shall stand suspended w.e.f. 5th September, 2011 to 19th October, 2011 (both days inclusive) and to fine him a sum of Rs.10,000/-.
SUBJECT : POSITIVE REPORT IN RESPECT OF ch g “AMARETTO” (PLACED 2ND) IN RACE NO.158 – THE GOOL S.POONAWALLA MILLION (GR.3) RUN ON SUNDAY, 23RD JANUARY, 2011:
The Stewards of the Club at their meeting held on Tuesday, 30th August, 2011 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry and interviewed Trainer C.D.Katrak who was accompanied by his Spokesman, Mr.Maninder Singh.
The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and also having permitted Trainer C.D.Katrak and his Spokesman to make submissions in the subject matter, found that he had no mitigating circumstances to offer in the subject case and as such, held him guilty of breach of the Medication Rules, consequently he became vicariously liable. In that :-
1) The Stewards, after due deliberation, did not accept the alleged contamination as mitigating circumstances for various reasons inter-alia :-
(i) There were no Indent in the name of AMARETTO for the alleged contaminated batch of feed supplements viz. Equitop Gonex;
(ii) It could not be proved based on log books as to when and which feed supplement was given to which horse;
(iii) The feed supplements were not recorded in the Veterinary / Medication Log book;
(iv) Tr.C.D.Katrak had, while indenting the supplement, confirmed in writing that the supplements are sourced at his cost / risk;
(v) The chain of custody for the independent testing done jointly by him along with Trainers P.Shroff and S.K.Sunderji, is not as per established procedure, in that, the samples were taken from open boxes and no witness from the Club was present or intimated.
(vi) The Stewards noted that there were Indents in the names of 223 horses, including AMARETTO, in Western India for the alleged contaminated batch of Equitop Myoplast 100529 out of which 69 horses were sampled.
(vii) The feed supplement Manufacturer, Boehringer, confirms supply of the same supplements world wide in thousands of units with not a single claim of contamination;
(viii) The five recent cases of BOLDENONE finding in random testing with no link to contaminated feed has raised a question mark on the Trainer’s defense. Atleast one of the two Trainers concerned has confirmed to the Stewards that his two horses which were reported positive for BOLDENONE, were not fed these feed supplements at all.
(ix) The Medication Rules contain no provision for additional testing beyond the reference sample or for testing nutritional samples. Further, the Club was legally advised that it was not obliged to test the feed supplements. Also the Club neither compels nor recommends the usage of these supplements by trainers.
Notwithstanding the above, and in view of prima facie evidence of contamination provided by Tr.C.D.Katrak, and in order to be completely fair, the Stewards accepted to have samples of the alleged contaminated feed of the same batch tested at HFL, UK, to help him prove mitigating circumstance. HFL is a lab accredited by the R.W.I.T.C. Ltd. for testing of samples of all its Classic and Grade-1 races. Vide this office letter dated 25th April, 2011 Tr.C.D.Katrak was told that the Club will not entertain any further request for testing for either urine or feed and will proceed with the test only based on HFL procedure and conditions. The other RWITC accredited labs were either unable to test the feed supplements or gave no satisfactory response. Tr.C.D.Katrak had given his consent in writing vide his letter dated 3rd May, 2011 to these conditions. Once HFL confirmed they can test the feed supplements but at a level of 10 ng, the trainer did not agree to go ahead with the test of the supplements. As informed to Tr.C.D.Katrakk earlier, the Stewards then initiated and completed the enquiry.
2) The Stewards took into consideration that BOLDENONE is a drug that is banned by the Government unless administered for therapeutic purpose by the Club’s Official Veterinarian or licensed practicing Veterinarians of the RWITC Ltd and duly notified to the Sr.V.O. in writing within 24 hours of such administration. Therefore, in April, 2011 the Stewards had decided to remove all Steroids and Sex Hormones from the list of Classification and placed on a proscribed list. However, since AMARETTO was reported positive for BOLDENONE before the Stewards took the decision, the Stewards applied the old Medication Rules;
3) The Stewards have gone by past precedents of ten years where the Stewards have usually taken into consideration the Medical Infringement of the previous five years to determine the number of offences and decide on punishment and given lesser weight-age to earlier infringements. The Stewards noted that Tr.C.D.Katrak had a Medical Infringement on GLORIOUS FANTASY who ran in Race No.133 on 9th October, 2005 which was a few months before the 5 years cut off period and the Stewards would have been within their right to consider it as his first infringement, however, they did not do so and took strict interpretation of the five year cut off period and treated the Medication Infringement on STAR FUTURE as his first offence and his Medication Infringement on AMARETTO as his second infringement.
Taking an overall view, the Stewards decided as under :-
(a) to suspend his Trainers license for a period of 75 days i.e. 45 days as second infringement on AMARETTO and an additional 30 days for his past Medication Infringements;
(b) to fine him a sum of Rs.10,000/-.
The Stewards noted that Trainer C.D.Katrak’s license already stood suspended w.e.f. 5th September, 2011 to 19th October, 2011 (both days inclusive) for his Medication Infringement on STAR FUTURE.
Therefore, the Stewards decided to further suspend his Trainer’s license w.e.f. 20th October, 2011 to 2nd January, 2012 (both days inclusive) and to fine him a sum of Rs.10,000/- for the Medication Infringement on AMARETTO.
