RE : ENQUIRY
INTO THE POSITIVE RESPECT IN RESPECT OF b g “CAPTAIN” (WINNER) IN RACE
NO.74 – THE MARIINSKY PLATE (DIV.II) RUN ON SATURDAY, 27th AUGUST,
2016 - IN CHARGE OF TRAINER FAISAL A. ABBAS – THE HORSE WAS POSITIVE FOR
GUAIFENESIN, NORKETAMINE AND DEHYDRONORKETAMINE”:
The
Stewards of the Club at their meeting held on Tuesday, 31st January,
2017 considered the evidence obtained by the Stipendiary Stewards/Sr. V.O. in
the above enquiry and interviewed Tr. Faisal A. Abbas and his Spokesman, Dr.
Prashant Wandhare wherein they were given full opportunity to prove their
mitigating circumstances.
The Stewards considered all
submissions, papers, proceedings, documents including the scientific opinion
from Professor Bertrand Baudot, Club’s Scientific Expert and heard Trainer
Faisal A. Abbas and his Spokesman, Dr. Prashant Wandhare. Having applied their
minds to the entire facts and circumstances of the case and all submissions
made, the Stewards concluded that though Trainer Faisal A. Abbas pleaded that
contamination was the probable cause, he failed to conclusively establish his
theory of contamination. Further the Stewards held the view that this case was
in any event compounded by acts of gross negligence on the Trainers part
including housing the horse in the same stall/stable which was earlier
occupied by a stablemate (Holy Smoke) who had been heavily medicated due to eye
surgeries. In view of the above it is evident that the requisite degree of care
was missing and Trainer Faisal A. Abbas failed to conclusively establish any
mitigating circumstances.
Further, the Stewards observed that
Trainer Faisal A. Abbas failed to take proper/required interest in the running
of his stable and left critical decisions to the Jamadars. Also, it was not
acceptable that a non racing horse who had been
heavily medicated should be kept within the racing stable. Therefore, the
Stewards held Trainer Faisal A. Abbas guilty of gross negligence.
The Stewards noted that this was
Trainer Faisal A. Abbas’ second infringement of the Medication Rules in the
last five years, the first infringement being for Boldenone, a proscribed drug,
for which he was punished with four months suspension.
Taking an overall view and having
deliberated the matter the Stewards held Trainer Faisal A. Abbas vicariously
responsible for the positive finding of Guaifenesin, Norketamine and
Dehydronorketamine in the urine sample of his horse CAPTAIN (Winner) in Race
No.74 – The Mariinsky Plate (Div.II), run on 27th August, 2016.
Further, the Stewards also held him guilty of gross negligence in the
management of his stable and decided:-
i)
to suspend his Trainer’s license for
an aggregate period of 90 days (for the current breach of Medication Rules plus
25% of his earlier suspension which was for a period of four months) i.e. with
effect from 15th February, 2017 to 16th April, 2017 (61
days). Thereafter, if he applies for a Trainer’s license for the Season
2017/18, it may be granted to him, however, the same shall stand suspended for
the balance period of 29 days starting from the first day of the Pune Meeting
2017;
ii)
to fine him
a sum of Rs.50,000/-
