RE: ENQUIRY INTO THE IMPROVED PERFORMANCE OF “MYSTIC ROMANCE” IN RACE NO.96-THE Dr.P.K.SARDESHMUKH MAHARAJ TROPHY-DIV-I, RUN ON SUNDAY, 30TH AUGUST, 2015.

The Stipendiary Stewards reported that they had questioned Trainer Nirad Karanjawala in the above connection. He stated that MYSTIC ROMANCE had  decent racing form to go by, however, after her last run in Mumbai on the 15th of February 2015 the filly started getting tied up, hence he could not race the filly for 6 months. Thereafter, the filly recovered gradually and  she was kept on light work, she was only cantering and had one or two pace works and then raced on the 15th August 2015 in a Class III race. He explained that the filly  may have benefited after her first run at Pune and in the race in question on 30th August 2015 the filly ran in a lower class and one fancied runner was withdrawn and the favourite ROMAN FLAME ran a poor race, further the remaining field was weak, however, he had not fancied the filly.

Trainer Nirad Karanjawala’s attention was drawn to the Calendar Notification and also that his filly had shown improvement of over 12 lengths vis-a-vis the common horse, CHLOBUD in only 15 days time, to which he concurred, however, he reiterated that he had not fancied the filly and she was at longer odds.

After going through the Log Books, watching both the races and even considering that the filly was at longer odds on both occasions, Trainer Nirad Karanjawalla has been fined Rs.10,000/- for contravening of the Calendar Notification “Re : Comparative Performance of Horses winning within a short span of time:

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “NAUMEE” IN RACE NO.106-THE RADIO ONE RUN,  RUN ON SATURDAY, 5TH SEPTEMBER, 2015.

The Stipendiary Stewards reported that they had questioned Trainer Nirad Karanjawala and Jockey S.Sunil  in the above connection. The video of the race was viewed and when questioned, Trainer Nirad Karanjawala stated that this was only the second run of the filly and he had instructed the Jockey to take a good jump and sit well up and to do his best.  He said that the filly did not get an opening in the straight and thereafter the Jockey again rode her out and finished  fifth. He felt that in the absence of not getting an opening, at best, the filly could have finished third or fourth. He reiterated that this was only the second run of the filly and she was showing improvement after her first run. The Jockey confirmed the instructions and added that he received interference in the straight and thereafter he rode out and did his best.

After hearing the submissions made by the Trainer and the Jockey and considering that this was only the second run of the filly and she was still a maiden and that she had received interference in the straight and was at longer odds, the Stipendiary Stewards  decided to only caution the Trainer and the Jockey and informed them that a close watch would be kept on the future performance of the filly as they felt that the Jockey could have been more vigorous in the straight.

After being loaded, PHOENIX KNIGHT had reared up in the stall. The horse was unloaded and examined by the Club’s Sr.V.O. who certified him fit to race and he finished fourth. After the race the horse was reported lame by the right fore. Subsequently the part-owners had  expressed their displeasure as they felt that the horse should have been withdrawn at the start. Ms Zinia Laywer had lodged a complaint stating that the odds had drifted and the horse was not in the race.

The Stipendiary Stewards questioned the Trainer and the Jockey as also the Club’s Vet and taking into account all submissions made and after thorough scrutiny of the log books which showed nothing out of the ordinary, decided to close the enquiry.

RE:ENQUIRY INTO THE POOR PERFORMANCE OF “EL CAMINO” IN RACE NO.111-THE SADDLE UP DOUBLE STAKES, RUN ON SUNDAY 6th SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer P.Shroff and Jockey P.Trevor in the above connection. Trainer P.Shroff stated that the Jockey had reported after the race that the gelding did not enjoy the underfoot conditions and was hesitant to raise a gallop due to the kick back which was confirmed by the Jockey and the Trainer believed that this was the reason for the poor performance.

On viewing the video of the previous race and the video of the race in question it was observed that the Jockey had made all reasonable efforts to ride out his mount in a similar manner despite which the gelding ran such a poor race. After scrutinizing the Work Log Book and considering that the going was firm, the explanation tendered by the Trainer and Jockey was noted for future reference.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “NIOBRARA” IN RACE NO.112-THE RAPIER PLATE DIV-II, RUN ON SUNDAY 6TH SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Nirad Kranjawala and Jockey S.Zervan in the above connection. The video of the race in question as also the previous run of the horse were viewed and when questioned, Jockey S.Zervan stated that his instructions were to try and go to the front. The Trainer confirmed the instructions and added that he had also asked the Jockey not to break the horse’s stride because the moment you do so, he would not gallop. He felt that the pace was fast and the horse did not enjoy being hassled and was fighting with the horse alongside and used himself up. The Jockey stated that in his opinion the horse did not like being rushed in the early part and he gave up as soon as a horse came alongside. He opined that the horse may do well over a longer trip and had informed the trainer accordingly, after the race.

The Trainer in his letter dated 17th September 2015 pointed out that the horse’s first run at Pune was over five furlongs where he was rushed to the front and he ran a poor race. Thereafter he had run the horse over six furlongs

where he got to go to the front comfortably without being hassled and gave up towards the end and finished second. After this run, the owner had asked him to again run the gelding over five furlongs as he felt that six furlongs was too long for the horse.

After hearing the submissions made by the Trainer and Jockey and going through the Work Log Book, the Stipendiary Stewards decided to caution the Trainer and informed him that a close watch would be kept on the future performance of the gelding and he was warned for the inconsistent running of his horses keeping in mind the common horse JOSHUA and Jockey S.Zervan was fined Rs.5,000/- for not riding out till the end of the race.

RE : RACE NO.113 – THE BOUNTIFUL TREASURE PLATE (DIV.I) RUN ON SUNDAY, 6TH SEPTEMBER, 2015 – APP.AKSHAY GAIKWAD, RIDER OF “BLUE FLAME” – CARELESS RIDING :

It was observed that soon after passing the Red Marker, BLUE FLAME (App.Akshay Gaikwad) shifted in sharply on to ZABISCO (App.Yash Narredu – the favourite),  causing the latter to stumble and lose position. Trainer Narendra Lagad concurred with the Stipes view that App.Akshay Gaikwad had no reason to shift in at that stage. After questioning App.Akshay Gaikwad in the presence of his Master, Trainer Narendra Lagad and viewing the video of the race, the Stipendiary Stewards were not satisfied with the explanation tendered by App.Akshay Gaikwad and decided to suspend his App.Jockey’s license w.e.f. 10th October, 2015 to 11th October, 2015 (both days inclusive) for careless riding. Further, App.Akshay Gaikwad was informed that the Stipes had given him grave benefit of the doubt for deliberately causing interference to a favourite and he has been warned to be more careful in the future.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “BELGIAN BLUE” IN RACE NO.116-THE RAPIER PLATE DIV-I, RUN ON SUNDAY 6TH SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Vishal Gaikwad and Jockey D.K.Ashish in the above connection. The video of the race was viewed and when questioned, Trainer Vishal Gaikwad stated that he had instructed the Jockey to take a good jump and go to the front. The Jockey confirmed the instructions and added that the horse took a fly jump and he had brushed his horse and sat alongside the front runner. He said that it was a fast run race and if had to hit the front to sit 2/3 lengths ahead, he would have had to pass the horse on his inside, hence he decided to sit alongside the other runner and not take a long break so as to preserve his mount.

The Trainer in his letter dated 17th September 2015 explained that BELGIAN BLUE is a front runner and in the race in question, the horse jumped out slow due to which he could not go to the front without being hassled. Also, the horse was running in the higher class with a penalty of 9 kgs. He said that the horse was scoped the same day and was observed to have (Gr.II E.I.P.H. plus  mucus in trachea).

After hearing the submissions of the Trainer and the Jockey who had reported that the horse had wobbled which is evident in the video, viewing the video of both the races and considering the letter from the Trainer, the Stipendiary Stewards decided not to initiate any action in the matter. However, the Trainer was informed that a close watch would be kept on the future performance of the horse.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “SANSANI” IN RACE NO.117-THE CAPITULATE PLATE, RUN ON SUNDAY 6TH SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Altaf Hussain and Apprentice S.J.Sunil in the above connection. The video of the race was viewed from various angles and when questioned, Trainer Altaf Hussain stated that he had instructed Apprentice S.J.Sunil to take a good jump and sit in 3rd/4th position and to do his best. App.S.J.Sunil confirmed the instructions and added that his mount had stumbled soon after the start, as such, he could not sit as instructed in the early part. While agreeing that the horse had stumbled after the start, the Trainer felt that Apprentice S.J.Sunil should have made more effort to get into position thereafter, to which Apprentice

S.J.Sunil stated that he could not have a clear run and also he had got into the horse from the 3 furlong marker and did his best.

Since the odds have drifted and the Trainer was not happy with the Jockey’s riding, the matter was reported to the Stewards for such action as they deem fit.

The Stewards of the Club at their meeting held on Saturday, 26th September, 2015 interviewed Trainer Altaf Hussain and App.S.J.Sunil and having heard them and viewing the video of the race, decided that no action was called for in the matter.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “ANNIE” IN RACE NO.119-THE SPEARHEAD PLATE, RUN ON SATURDAY 12th SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer P.Shroff and Jockey D.K.Ashish in the above connection. The video of the race in question as also the previous run of the horse was viewed and when questioned, Jockey D.K.Ashish stated that his instructions were to sit 3rd/4th and to do his best in the straight. The Trainer confirmed the instructions.

To a specific question, both Jockey and Trainer stated that the horse was tightened for space just before the bend and due to which he lost ground and position. The Jockey stated that he had done his best and the Trainer while stating that he was satisfied with the running and riding of his charge, also pointed out that the individual timing of the filly was similar to that of her winning race and that he felt that she had performed to her ability.

After hearing the submissions made by the Trainer and Jockey and viewing the video of the race, the explanation was noted for future reference.

RE:ENQUIRY INTO THE RUNNING AND RIDING OF “VERBIER” (DRAWN 5) IN RACE NO.128-THE JUVENTUS TROPHY DIV_II, RUN ON SUNDAY 13th SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Vishal Gaikwad and Jockey N.S.Parmar  in the above connection. The video of the race was viewed and when questioned, Trainer Vishal Gaikwad stated that this was the first run of the filly and he had instructed the Jockey to take a good jump and go to the front or sit in 2nd/3rd position and to do his best. He said that he was not aware why the odds had drifted since he has no control over the odds or morning odds. He reiterated that this being the filly’s first run, he felt that she had run a good race and he was happy with the jockey’s riding.

Jockey N.S.Parmar confirmed the instructions and stated that the filly had walked out of the gates, may be, due to lack of experience as this was her first run and she lacked speed in the early part of the race but later gained momentum. He felt that the filly would do better over a longer distance.

After hearing the submissions made by the Trainer and Jockey and keeping in mind that this was the first run of the filly, no action has been initiated and the matter was closed.

RE:ENQUIRY INTO THE RUNNIN AND RIDING OF “SHE IS SPECIAL” IN RACE NO.132-THE JUVENTUS TROPHY DIV_I, RUN ON SUNDAY 13th SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Altaf Hussain and Jockey Kishore Kadam in the above connection. The video of the race was viewed and when questioned, Trainer Altaf Hussain stated that he had instructed the Jockey to take a good jump and sit 3rd ,4th or 5th  and to do his best this was confirmed by the jockey. The Trainer further stated the he had first requested Jockey T.S.Jodha to ride the filly however he declined the ride as he had to ride his stable runner NEVER SURRENDER in the same race, hence he declared Kishore Kadam on SHE IS SPECIAL. When questioned about his observation of the race, Trainer Altaf Hussain stated that the filly threw her head up at the start. Jockey Kishore Kadam stated that  the filly jumped out awkwardly and was throwing her head and he had lost his right  stirrup after a couple of strides.

Not being satisfied with the explanation tendered by Jockey Kishore Kadam, the matter was reported to the Stewards as the Stipendiary Stewards believed that the Jockey had not allowed the horse to jump out on an even keel.

The Stewards of the Club at their meeting held on Saturday, 26th September, 2015 interviewed Trainer Altaf Hussain and Jockey Kishore Kadam and having heard them and viewing the video of the Race No.132 as also the previous run of the filly i.e. Race No.315 run during the Mumbai Meeting 2014/15, the Stewards were not satisfied with the explanation tendered by Jockey Kishore Kadam and held him guilty of unsatisfactory riding on his mount. The Stewards noted that SHE IS SPECIAL was a fancied runner and Jockey Kishore Kadam was instructed to sit in 3rd/4th/5th position. However, he has not allowed the filly to jump out on an even keel and was lying last and thereafter

he did not make sufficient efforts to improve his position and sit closer. Also, his statement that he had lost his right stirrup soon after jump out, was not borne out on the video recording. Having viewed the previous run of the filly, it was noted that the filly took a fair start and did not show any erratic behavior on jump out.

Taking an over all view, the Stewards decided to suspend his Jockey’s license w.e.f. 11th October, 2015 till the end of Pune Meeting 2015 and for 15th November, 2015 for unsatisfactory riding on his mount (permitted to ride work/mock race).

RE:ENQUIRY INTO THE RUNNIN AND RIDING OF “BEYOND HORIZONS” IN RACE NO.133-THE LIVE LEGEND PLATE, RUN ON SUNDAY 13th SEPTEMBER 2015.

The Stipendiary Stewards reported that they had questioned Trainer Sanjay Kolse and Jockey C.S.Jodha  in the above connection. The video of the race was viewed and when questioned, Trainer Sanjay Kolse stated that he had instructed the Jockey to take a jump and sit in a good position. Also, he had specifically told him that if the filly missed the kick not to panic, just settle her and come into the straight and do his best which was confirmed by the Jockey.  The Trainer further stated that the Jockey had reported to him after the race that his goggles had fogged up and he could not ride. At this juncture it was pointed out to Jockey C.S.Jodha that he could have removed his goggles to which he stated that the reason he did not remove them was that the kickback was too much and it could have been even worse. The Trainer stated that in view of the monsoon weather, he had used Pacifiers for the first time and the filly may have reacted to them.

After hearing the submissions made by the Trainer and the Jockey and keeping in mind the weather conditions that prevailed on the day, the Stipendiary Stewards reluctantly gave the benefit of doubt to the Jockey.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “POLISHED CHROME” IN RACE NO. 139 RUN ON 19TH SEPTEMBER 2015 – TRAINER DALLAS TODYWALLA AND APP. RAGHUVEER SINGH :

The Stipendiary Stewards reported that they had questioned Trainer Dallas Todywalla and App. Raghuveer Singh in the above connection. Trainer Dallas Todywalla said that he had instructed Apprentice Raghuveer Singh to take a good jump and go to the front but if someone is cutting pace with him, then to sit in the 2nd position. App. Raghuveer Singh confirmed the instructions and said the horse jumped out slowly and he tried to sit in 2nd position but he could not do so as the horse was hanging out and he tried his best but he could not bring her in. When questioned, the Trainer said that filly has always jumped out smartly and never hung out and he was not happy with the Jockey’s riding. He added that the filly is a Track record holder and if she had jumped out well and had come the shortest way, she would have won the race. When asked why he put App. Raghuveer Singh on this horse, he said that it was the Owner’s decision to put an allowance claimer and he put him up as he was the best claimer presently.

Not being satisfied with the explanation tendered by App. Raghuveer Singh, he was held guilty of incompetent riding. In that, he has not made any effort to bring his horse in throughout the race thereby not giving the horse the best chance in the race. However, considering that he is a 5 kg. allowance claimer, the Stipendiary Stewards took a lenient view and decided to suspend his Apprentice Jockey’s license w.e.f. 10-10-2015 to 11-10-2015 (both days inclusive) for incompetent riding (permitted to ride work/mock race).

RE: ENQUIRY INTO THE RIDING OF “BENEZEER” IN RACE NO. 140 – RUN ON 19TH SEPTEMBER 2015 – TRAINER NIRAD KARANJAWALA HAD COMPLAINED THAT JOCKEY C.S.JODHA HAD NOT FOLLOWED HIS INSTRUCTIONS :

The Stipendiary Stewards reported that they had questioned Trainer Nirad Karanjawala and Jockey C.S.Jodha in the above connection. Trainer Nirad Karanjawala said that he had instructed Jockey C.S. Jodha to sit 2nd, 3rd or 4th position and coming into the straight to pull the filly out and gallop from the centre of the track. Jockey C.S. Jodha stated that the Trainer had instructed that if the filly goes to the front then let her go, but if not, then  to sit 2nd or 3rd. The Trainer stated that Jockey C.S. Jodha knows the horse as he had worked the filly and he had entered the horse in this particular race as the Jockey had advised him to do so. When asked as to where he took objection to the Jockeys riding, the Trainer said that the Jockey had no business to go inside since he had specifically told the Jockey to gallop the horse from the centre of the track. He felt that the filly would have run very close to the Winner if the Jockey had followed the instructions.

After viewing the race in question and its previous race, the Stipendiary Stewards would have held the Jockey guilty of not following the Trainer’s instructions. However, since the filly was reported sore after the race which could have caused her to shift in, the Jockey was given the benefit of grave doubt and the enquiry was closed.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “MAKE IT SHINE” IN RACE NO. 143 – RUN ON 20TH SEPTEMBER 2015 – TRAINER S. WAHEED AND JOCKEY T.S. JODHA :

The Stipendiary Stewards reported that they had questioned Trainer S. Waheed and Jockey T.S. Jodha in the above connection. When questioned, Jockey T.S. Jodha said that he was instructed to take a good jump, sit 4th/5th position and coming into the straight, to do his best. Trainer S. Waheed confirmed the instructions. He said that it was the second run of the filly in his charge and earlier she was in the charge of Trainer C.D. Katrak. When asked why had he kept changing the riders on this horse, he said he does not have any rider of his own and he had asked Jockey T.S. Jodha to work her once and since he was free, he gave him the ride. Jockey T.S. Jodha said there was no response from the filly at any stage and she did not improve at all in the straight inspite of him using the whip a few times. Jockey T.S.Jodha was shown his riding on JOY OF LIFE which he won and it was pointed out to him that he was much more vigorus in that race. Since the Trainer was satisfied with the ride, no action was initiated in the matter, however, their explanation was noted and the case is being kept open for the next couple of runs of the horse.

RE: ENQUIRY INTO THE RUNNING AND RIDING OF “NAME OF THE GAME”  IN RACE NO. 151 – THE ELOISE PLATE (DIV.I) RUN ON 20TH SEPTEMBER 2015 – TRAINER C. RAJENDRA AND JOCKEY MALCOLM KHARADI

The Stipendiary Stewards reported that they had questioned Trainer C. Rajendra and Jockey Malcolm Kharadi in the above connection. Jockey Malcolm Kharadi stated that the Trainer had instructed him to sit well up and  if the front runners are too keen then to settle the filly. However, when he entered the Paddock, the part-owner Mr. Zaheer Lalkaka told him to ride in a similar manner as he rode FIBONACCI SEQUENCE. Jockey Malcolm Kharadi said that on the way to the start,  the seemed to be very keen as she was full of herself and was sweating a lot. After jumping out, he tried to settle her but could not and at about 800 metres he got a check and at the bend and she just packed up. He added that the other partner Mr. Parvez Andhyarujina had also given him other set of instructions which were to settle her. Jockey Malcolm Kharadi believed that the horse had a fall in the Saddling Enclosure which was not informed to anyone and may be that was the reason the filly ran in this manner. To a specific question, he said that at no stage did he feel that the filly was unsound, whether in the Paddock or on the way to the Starting Gates. To another question, he replied that never before had he received three sets of instructions.

Trainer C. Rajendra said that he had told the Jockey to sit well up, not to fidget with the filly and to allow her to run at her own will. He added that he did not know how FIBONACCI SEQUENCE ran so he had no clue what the owner Mr.Zaheer Lalkaka meant..

As the horse has run well below expectation and the Jockey did not ride as per the Trainers instructions and further as the Jockey had received three sets of different instructions, being an unprecedented case, the matter was reported to the Stewards for such action as deemed fit.

The Stewards at their meeting held on Saturday, 26th September, 2015 interviewd Trainer C.Rajendra, Jockey Malcolm Kharadi as also Mr.Pervez Andhyarujina and Mr.Zaheer Lalkaka, the part-owners of the horse, and having heard them and having viewed the video of the race, decided that no action was called for in the matter.
