Permission was granted to Trainer Adhirajsingh Jodha to saddle the horses of Trainer Magansingh P.Jodha viz. BONOBO & CACTUS CASH in the 1st & 2nd race respectively, at his (Trainer Magansingh P.Jodha’s) risk and responsibility.

On a request from Trainer Janardhan, permission was granted to Trainer Vinesh to saddle his charges LADYBIRD & FIBONACCI SEQUENCE in the 5th & 6th race respectively, at his (Trainer Janardhan’s) risk and responsibility.

RACE NO.1(8) – THE  GRAND PASSION PLATE: (About) 1600 Metres – Runners - 4 

 

Near 600 metres CUMBRE VIEJA (I.Pasha) was tightened for room and inconvenienced when SUNTAN BEAUTY (Darren Williams) passed the former from the outside.

 

After the race, BONOBO and CUMRE VIEJA were found to be sound.

 

RACE NO.2(9) – THE SIR RAHIMTOOLA CHINOY TROPHY : (About) 1600 Metres – Runners - 3

 

JANIS JAY (Y.S.Srinath) lugged-out in the straight. Trainer Imtiaz A.Sait has been asked to take remedial measures before next accepting to race the filly.

 

After the race, THE MYTH was observed to have broken a blood vessel and is not to race for the stipulated ban period of four weeks. The filly has to be passed fit by the Club’s V.O. before next accepting to race.

 

RACE NO.3(10)  – THE STAR ADMIRAL PLATE : (About) 1200 Metres – Runners – 6

 

ROMANTIC RACER (Neeraj Rawal) was restless in the stall and thereafter lost about 3 lengths at the start. Trainer Imtiaz A.Sait has been asked to give the gelding more gate practice and show him to the satisfaction of the Starter at morning starting trials, before next accepting to race.

 

Near 400 metres, CHINOOK (C.S.Jodha) and WITHOUT FEAR (I.Pasha) shifted in and out respectively and made contact with each other.

 

WITHOUT FEAR (I.Pasha) lugged-in in the straight. Trainer Narendra Lagad has been asked to take remedial measures before next accepting to race the filly.

 

After the race, ZAAGROS was found to be sound, but having a gum injury.  CHINOOK was found to be sound.

 

RACE NO.4(11) – THE SNOW PLATE : (About) 1200 Metres – Runners -  6

 

At the start, SAMURAI (Kishore Kadam, dr.2) jumped out awkwardly and made contact with PEIZIERES (C.S.Jodha, dr.1).

 

BON VIVANT (D.K.Ashish) lugged-in during the race, in that, soon after the start the filly went on to SAIL PAST (Darren Williams), who in turn went on to PEIZIERES (C.S.Jodha) and then BON VIVANT continued to lug-in in the straight. Since the filly was reported to be sore, no further action was initiated.

 

JOY OF LIFE (Zameer Sayyed) lugged-in in the straight. Trainer S.S.Shah has been asked to take remedial measures before next accepting to race the colt.

 

After the race, BON VIVANT was found to be sore by the right fore leg. The filly has to be passed fit by the Club’s VO before next accepting to race.

 

RACE NO.5(12) – THE  J.V.SHUKLA-ASHWAMITRA TROPHY: (About) 1000 Metres – Runners - 11

 

At the start, SILSILA (Kavraj Singh, DR.4) jumped out awkwardly and jostled with DIVINE SOLITAIRE (Anil Baandal, dr.3) who was checked and thereby lost position.

 

Near 700 metres, SILSILA (Kavraj Singh) became keen and due to lack of room, shifted out and carried MY LAKSHMI (A.Ashhad Asbar) outwards.

 

After the race, PASSION PRINCE was found to be sound.

 

RACE NO.6(13) – THE  RACE OF HOPE GOLD CUP: (About) 1400 Metres – Runners - 10

 

FEAST OF LOVE (S.Mosin) lugged-in in the straight. Trainer S.S.Shah has been asked to take remedial measures before next accepting to race the filly.

 

SIMPLY SWEET (C. S. Jodha) lugged-out in the straight. Trainer Imtiaz A. Sait has been asked to take remedial measures before next accepting to race the filly.

 

After the race, NEPTUNE’S OCEAN, FORGOTTEN VOICE and SIMPLY SWEET were found to be sound.

 

RACE NO.7(14)– THE  KIARA PLATE : (About) 1000 Metres – Runners -  12

 

AMAZON CAT (S.Mosin) lost about 4 lengths at the start. Trainer Ivor Fernandes has been asked to give the gelding more gate practice and show him to the satisfaction of the Starter at morning starting trials, before next accepting to race. 

ENGLISH LASS (Kavraj Singh) hung-in in the straight. Trainer Adhirajsingh Jodha has been asked to take remedial measures before next accepting to race the filly.

 

After the race, ENGLISH LASS was found to be sound, but having a cut injury above the right hock.

The post race urine sample of the winner of the 4th, 5th and 6th race, viz. BON VIVANT, LADYBIRD and SIMPLY SWEET, and the special sample of BONOBO (1st race), THE MYTH (2nd race), ARTISTE (5th race) and FORGOTTEN VOICE (6th race), were collected for detection of prohibited substance.

RE: HORSE OBSERVED TO HAVE BROKEN A BLOOD VESSEL DURING MORNING TRACK WORK :

 

The Sr.V.O. reported that AUTUMN LOVE was observed to have broken a blood vessel after morning track work on 07/11/2014. The filly is not to race for the stipulated ban period of four weeks and until passed fit by the Club’s V.O.

The Stewards of the Club at their meeting held on 25th October, 2014 have decided to exclude the under-mentioned person from the premises of the racecourse, Mumbai/Pune and all other places wherever the Rules of Racing of this Club are in force, with effect from  26/10/2014 till the end of the Mumbai meeting 2014/15. :-

RE : ENQUIRY INTO THE POSITIVE REPORT IN RESPECT  OF dk b f “BULLSEYE”WHO WAS COMPULSORILY SAMPLED ON 6TH DECEMBER, 2013 FOR THE PRESENCE OF ANABOLIC STEROIDS AND SEX HORMONES SINCE THE FILLY HAD ARRIVED TO TRAINER P.SHROFF FROM THE STUD FARM – MATTER REFERRED BACK TO THE STEWARDS OF THE CLUB BY THE BOARD OF APPEAL – DE-NOVO ENQUIRY :

 

The Stewards of the Club at their meetings held on 28th July, 2014, 27th August, 2014, 17th September, 2014 and 28th October, 2014 considered the above matter.

 

At the outset, Trainer P.Shroff was informed that all the Stewards were not satisfied with the wording of his letter of apology. He was asked by Mr.Dixit to rephrase it in a manner that would indicate a proper apology and which would be accepted by all Stewards. The wordings of the letter of apology was given to Tr.P.Shroff to consider and submit it in this manner. 

 

Trainer P.Shroff had initially stated that there was nothing wrong with his letter of apology and that it should suffice. However, as this was unacceptable to all the Stewards, he said that he would give the new letter the following day. As the enquiry continued, Trainer P.Shroff, of his own accord, signed the letter in the room in the presence of all the Stewards and handed his new letter of apology to the Chairman.

 

The Stewards considered all the submissions made by Tr.P.Shroff and also permitted him to bring in witnesses. The Stewards after having enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings reports and records and also having permitted Tr.P.Shroff to make submissions in the subject matter, decided that he was in breach of the Medication Rules governing the finding of BOLDENONE (an anabolic steroid) in the urine sample of BULLSEYE and held him vicariously responsible for the following reasons:-

 

1)            BULLSEYE had left his yard in mid-April, 2013 for summering at Nanoli Stud as per the Left Charge form submitted by him. Though BULLSEYE went for sampling directly from Nanoli Stud on 6th December, 2013 it is a fact that she was under his care till 15th August, 2013 and thereafter was not subjected to any test of her urine by the R.W.I.T.C. Ltd. As an anabolic steroid could remain in the system of a race horse for up to 180 days, it cannot be conclusively established as to when and where the BOLDENONE was administered. Also, the reports submitted by Nanoli Stud and Agricultural Farms from two international labs on the segmental hair testing analysis carried out by them in respect of BULLSEYE cannot be relied upon since there was no chain of custody of the hair sample.

 

2)            Though BULLSEYE went for sampling directly from Nanoli Stud in December, 2013, all the charges of “conspiracy and sabotage” are yet to be proved and the Crime Branch investigation in respect of the F.I.R. filed by Tr.P.Shroff, is still in progress. It has been established in the enquiry that there is a close relationship between Tr.P.Shroff and the proprietor of Nanoli Stud and his horses often shuttle between Nanoli Stud and his yard. Also it was noted that Nanoli Stud had employed a farrier who was warned off by the RWITC Ltd. and he was one of the prime suspect of sabotage, as alleged by Tr.P.Shroff.

                                                                                                                         

3)            Tr.P.Shroff has stated that a private sample collected at the Stud Farm was sent by Nanoli Stud in November, 2013 which was clean and this strengthened his suspicion of sabotage, though the Rules of Racing do not take cognizance of the result of such private samples as there is no chain of custody under the control of the RWITC. Ltd.

 

4)            From the experience of past positives for the same drug of horses coming from Nanoli Stud, and in his own interest, Tr.P.Shroff ought to have had the sample of BULLSEYE tested by the Club’s accredited lab before she left Nanoli Stud and ensured her security before her sampling in Mumbai.

 

5)            The Stewards noted that as per the earlier decision of the Stewards which has been notified in the Club’s Racing Calendar, should the urine sample of any horse whenever tested, be reported positive for the presence of any anabolic steroid the Stewards would deal with such cases at their absolute discretion in the most stringent manner. The Stewards also noted that even as per the Calendar Notification dated 24th September, 2008 concerning “Sampling of Racing Stock at the Stud Farms” states “in case of a positive, the same penalties will be applicable to the Trainer as are published in the Racing Calendar for the breach of norms for Random Sampling of horses in Training” and hence the responsibility for the horse which had specifically gone for summering remained with Tr.P.Shroff. The Stewards further noted that at various meeting of the Turf Authorities of India starting from November, 11, 2013 and recommended unanimously by the Chairmen of the Turf Authorities of India and by the Veterinary Commission of India, and not objected to by the RWITC Ltd. Stewards at any stage a two year ban on a trainer is applicable on the finding of an anabolic steroid in the sample of any horse in training.

 

6)            The Stewards were seized of the fact that as per Calendar Notification “all horses coming from Stud Farm/s after a spelling/summering sting should be Compulsorily sampled on arrival at the Pune/Mumbai Race course” and that in case of horse being found positive for anabolic steroids or sex hormones, the Stewards would deal with such cases in the most stringent manner at their absolute discretion.

 

Taking into view the ongoing police investigation and that certain facts had surfaced which threw some doubts, and considering the police report filed in the bail application in court dated 22nd May, 2014 of Mr.Deepak Popat, the Stewards took everything into consideration and revised their decision. The police investigation is till going on and not concluded and the Stewards are awaiting the final report in the matter.

 

Notwithstanding all these facts, taking an overall view and taking into view the submissions made by Tr.P.Shroff, the Stewards took a very lenient view and decided as under :-

 

1)   To fine him a sum of Rs.1,00,000/-.

 

2)    For a period of three years starting from 29th October, 2014 he will not be allowed to take charge of any race horse from any Stud Farm except 2-year-olds from stud farms or his other horses leaving and returning from another racing centre.

 

Tr.P.Shroff is at liberty to continue with his investigation and should he present irrefutable fresh evidence in support of his claim of sabotage, the Stewards may reconsider the matter at their sole discretion.

The Stewards of the Club at their meetings held on 28th July, 2014, 27th August, 2014, 17th September, 2014 and 28th October, 2014 considered the above matter.

 

The Stewards enquired into the matter and applied their minds to the entire facts and circumstances of the case and considered all papers, proceedings, reports and records including the documents submitted by Dr.Ravinder Reddy and heard Mr.K.N.Dhunjibhoy and Dr.Ravinder Reddy in the matter at length. Taking into account that there have been several cases in the past also of horses testing positive of Anabolic Steroid from Nanoli Stud Farm, and in order to safeguard the interest of the sport of racing and the reputation of the R.W.I.T.C., Ltd. as also the interest of M/s Nanoli Stud and Agricultural Farms, the Stewards felt that it would be prudent not to allow the to and fro movement of all racing horses between R.W.I.T.C., Ltd. and M/s Nanoli Stud and Agricultural Farms for a period of three years. However, in the absence of any specific Rule in the Rules of Racing of the Club or any norm published in the Racing Calendar under which the Stewards could charge a stud farm, they decided not to initiate any action against Nanoli Stud and Agricultural Farms in the subject case.

 

However, Mr.K.N.Dhunjibhoy was requested that in order to safeguard the interest of the sport of racing and the reputation of the R.W.I.T.C., Ltd. as also the interest of M/s Nanoli Stud and Agricultural Farms, he may voluntarily stop the to and fro movement of his horses between Nanoli Stud & Agricultural Farms to the R.W.I.T.C. Ltd. Mr.K.N.Dhunjibhoy stated that on his own he has not moved any of his horses to and fro between Nanoli Stud & Agricultural Farms to the R.W.I.T.C.,Ltd. since last few months, and will continue this till police investigation is concluded.

RE :  ENQUIRY INTO THE POSITIVE REPORT IN RESPECT  OF dk b g “ZODIACE” (PLACED THIRD) IN RACE NO.154 – THE S.A.POONAWALLA MULTI-MILLION (GR.2) RUN ON SUNDAY, 21ST SEPTEMBER, 2014 - - IN CHARGE OF TRAINER DALLAS TODYWALLA :

 

The Stewards of the Club at their meeting held on Thursday, 20th November, 2014 interviewed Tr.Dallas Todywalla regarding the positive report dated 30th October, 2014  from LGC, New Market, UK, in respect of the sample of urine taken from his charge ZODIAC (Placed Third) in Race No.154 – The Poonawalla Multi-Million (Gr.2) run on 21st September, 2014 which read as under :-

 

 “THE CONFIRMATORY ANALYSIS WAS PERFORMED USING DOCUMENTED LGC METHODS, WHICH IDENTIFIED THE PRESENCE OF BUTORPHANOL, XYLAZINE, PENTAZOCINE, FLUNIXIN AND BETAMETHASONE IN THE URINE SAMPLE”

 

The Sr.V.O. informed the Stewards that after the race ZODIAC had showed symptoms of distress in the sampling yard and was treated by the Veterinarians of the Equine Hospital with the following drugs as reported by the Equine Hospital :-

 

“BUTORPHANAOL, XYLAZINE, FLUNIXIN, BETAMETHASONE, CALCIUM, BOROGLUCONATE and RINGERS LACTATE”.   PENTAZONE was not part of medication of the emergency treatment given to ZODIAC

 

At this meeting, Trainer Dallas Todywalla was handed over a copy of the above report and was requested to inform the Sr. Veterinary Officer of the Club, in writing, within five days of opening the envelope that identifies the sample, i.e. latest by 25th November, 2014, whether he wished to send the split sample to The Hong Kong Jockey Club Lab or L C H, France, for Confirmatory analysis and also the name of the witnessing analyst, if any, failing which the Stewards shall treat the report of the primary laboratory as conclusive.

 

Tr.Dallas Todywalla was asked to conduct his own enquiries and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.V.O. of the Club, as and when he would be required to.

RE :  ENQUIRY INTO THE POSITIVE REPORT IN RESPECT  OF b g “STROGANOFF” (WINNER) IN RACE NO.221 – THE GOEL GANGA GROUP SUPER SPRINT RUN ON SATURDAY, 18TH OCTOBER, 2014 - - IN CHARGE OF TRAINER FAISAL A.ABBAS :

 

The Stewards of the Club at their meeting held on Thursday, 20th November, 2014 interviewed Tr.Faisal A.Abbas regarding the positive report dated 30th October, 2014  from Racing Laboratory, The Hong Kong Jockey Club, in respect of the sample of urine taken from his charge STROGANOFF (Winner) in Race No.221 – The Goel Ganga Group Super Sprint  run on 18th October, 2014 which read as under :-

 

 “THE ANALYSIS HAS SHOWN THE PRESENCE OF BOLDENONE”

 

At this meeting, Trainer Faisal A.Abbas was handed over a copy of the above report and was requested to inform the Sr. Veterinary Officer of the Club, in writing, within five days of opening the envelope that identifies the sample, i.e. latest by 25th November, 2014, whether he wished to send the split sample to LGC, New Market, UK, or L C H, France, for Confirmatory analysis and also the name of the witnessing analyst, if any, failing which the Stewards shall treat the report of the primary laboratory as conclusive.

 

Tr.Faisal A.Abbas was asked to conduct his own enquiries and to also attend the enquiry to be held by the Stipendiary Stewards and the Sr.V.O. of the Club, as and when he would be required to.
