RE : ENQUIRY INTO THE POSITIVE REPORT IN RESPECT OF “MONTREAL” (WINNER) IN RACE NO.18 – THE MUNICIPAL COMMISSIONER’S TROPHY RUN ON 24TH NOVEMBER, 2013  – IN CHARGE OF TRAINER C.D.KATRAK :

The Stewards of the Club at their meeting held on Friday, 4th April, 2014 considered the evidence obtained by the Stipendiary Stewards/Sr.V.O. in the above enquiry and interviewed Trainer C.D.Katrak who was accompanied by his Spokesman, Mr.Zubin Marker..

The Stewards after having thoroughly enquired into the matter and having applied their minds to the entire facts and circumstances of the case and to all papers, proceedings, reports and records and submissions made in the matter and also having permitted Trainer C.D.Katrak/his spokesman to make submissions in the subject matter, found that he had no mitigating circumstances to offer in the subject case and as such, held him guilty of breach of the Medication Rules, consequently he became vicariously liable.

The Stewards noted that in an earlier enquiry into the incident in the stable in respect of STAR OF VENUS prior to Race No.150 on 24th September, 2011 wherein the filly was administered Amino Speed Excell paste before the race, it was decided to suspend Trainer’s C.D.Katrak’s license for a period of 90 days. Further, in the said enquiry, the Stewards had also imposed on Trainer C.D.Katrak a suspended sentence of 90 days i.e. if he was again found to be guilty of breach of the Medication Rules within the next two years commencing from 13th February, 2012, then the aforesaid suspended sentence of punishment of 90 days would ipso facto come into force and effect.

Therefore, the Stewards decided :-

a)       that for breach of the Medication Rules in respect of MONTREAL, Mr.C.D.Katrak’s Trainer’s license shall stand suspended for a period of 45 days with a fine of Rs.10,000/-;

b)       Further, the Stewards informed him that as per the previous order cited above in respect of STAR OF VENUS, the suspended sentence of 90 days ipso facto comes into effect i.e. his license shall stand suspended for a further period of 90 days. (Total period of suspension – 45 days + 90 days = 135 days and a fine of Rs.10/000/-)

Trainer C.D.Katrak informed that he did not wish to appeal against the above decision of the Stewards of the Club and requested that his punishment may start with immediate effect.

In view of the above, Trainer C.D.katrak’s license stands suspended w.e.f. 5th April, 2014 to 30th April, 2014. Thereafter, should he apply for a Trainer’s license for the Season 2014/15, it may be granted to him, however, his license shall stand suspended w.e.f. 24th July, 2014 to  26th October, 2014 and from 16th November, 2014 to 29th November, 2014.

RE: POSITIVE REPORTS IN RESPECT OF HORSES COMING FROM M/S NANOLI STUD FARMS FOR THE PRESENCE OF ANABOLIC STEROIDS:

The Stewards at their meeting held on 14th March, 2014 noted with concern that the positive case of BULLSEYE is the second case within three years (three horses in the first case and one horse in the present case) of horses arriving from M/s Nanoli Stud and Agricultural Farms after summering being reported positive for BOLDENONE. Hence it was felt that action needs to be taken about horses arriving from the M/s Nanoli Stud and Agricultural Farms.

The Stewards of the Club at their meeting held on Friday, 4th April, 2014 heard Mr.K.N.Dhunjibhoy and Dr.Ravinder Reddy in reference to the captioned subject matter.

The Stewards thoroughly enquired into the matter and applied their minds to the entire facts and circumstances of the case and considered all papers, proceedings, reports and records including the documents submitted by Dr.Ravinder Reddy at the meeting of the Stewards on 27th March, 2014 and heard Mr.K.N.Dhunjibhoy and Dr.Ravinder Reddy in the matter at length. Having done so and in order to safeguard the interest of the sport of racing and the reputation of the R.W.I.T.C., Ltd. as also the interest of M/s Nanoli Stud and Agricultural Farms, the Stewards felt that it would be prudent not to allow the movement of all racing horses from M/s Nanoli Stud and Agricultural Farms to R.W.I.T.C., Ltd. for a period of two years i.e. up to and inclusive of 4th April, 2016. Accordingly, it was decided not to allow movement of all racing horses from M/s Nanoli Stud and Agricultural Farms to R.W.I.T.C., Ltd. for a period of two years i.e. up to and inclusive of 4th April, 2016.

Notwithstanding the above, the Stewards decided that M/s Nanoli Stud and Agricultural Farms are at liberty to undertake any further investigation and should irrefutable fresh evidence be presented at any time in the future in support of their claim of sabotage, the Stewards may reconsider the above matter.

Further, acceding to the request made by Mr.K.N.Dhunjibhoy, the Stewards have agreed in principle, to assist M/s Nanoli Stud and Agricultural Farms in a thorough investigation in the matter. Mr.Dhunjibhoy mentioned to the Stewards that he would submit to the Club in writing the terms of reference in this regard. The Stewards of the Club have decided to consider the terms of reference as and when received.
